Kind: Board Policy GENERAL POLICY Pursuant to federal and state law, NMSA Chp. 51 all employers must contribute to a fund from which unemployment insurance is paid. NMSBVI therefore extends coverage to its employees in accordance with the New Mexico Compensation Act. 2. 3. ELIGIBILITY 2.1 Unemployment Compensation is extended to all NMSBVI employees. 2.2 Eligibility is determined by the New Mexico State Employment Security Department based on the circumstances of the case and the provisions of the Unemployment Compensation Act. PROCEDURE 3.1 The Employment Security Department allows an employer only five (5) days in which to respond to an employment compensation claim. It is, therefore, important that all forms, plus any other pertinent data (i.e. letter of resignation, discharge notice, etc.) be processed and in the Human Resources Office as soon as possible.
