Section 1.
Purpose: In order to provide for the needs of Low Incidence (TMR,
SPMR, HI, PH, SED, NI, VI, and Preschool) Exceptional students on a fair and equitable
basis, the Lincoln Intermediate Unit and each of its member districts located in Adams
County, including Hanover Public and South Western School Districts, agree to the
following guidelines covering a "Fair Share" Plan.
Section 2. Guidelines:
1.
By October 1st of each year, the Lincoln Intermediate Unit Director of Special
Education will notify the Conewago Valley School District of the number of lowincidence handicapped children identified among the District's preschool and
school-age member population. The District low-incidence handicapped child
count includes all children so identified from within the District, regardless of
whether any of these children are placed in a program located at the Yorkshire
Center or at an Approved Private School.
2.
The District will develop and submit to the Lincoln Intermediate Unit by July 1,
1989 a "Fair Share Plan" (hereinafter "The Plan") which reserves for the Lincoln
Intermediate Unit classrooms located within District facilities.
3.
The District will allocate classrooms to the Fair Share Plan in accord with the
following specifications:
a.
The plan will provide the Intermediate Unit with one special education
class for low incidence students at the rate of one class for every 10
students. (Round off to the nearest whole number, i.e., 14 students would
equal one (1) classroom; 26 students would equal three (3) classrooms;
35 students would equal 3 classrooms);
b.
All handicapped classrooms placed within school buildings should be
appropriately located with age-appropriate peers that permits an equitable
assignment of space and an opportunity for appropriate integration and
ease of entrance;
c.
All classes should be distributed appropriately within the District's
elementary, middle, and high school buildings; this distribution is based
upon the population of the low incidence students in the region;

d.
All classrooms assigned to the I.U. to use for low incidence students
should be equal to or greater than the average size classroom in each
respective building;
e.
Classes designated for SPMR, PH, and Preschool must have toilet
facilities included in the classroom and should have hot and cold running
water, as well as outlets for telephones; classrooms for the Hearing
Impaired students should be carpeted and all rooms must meet the
current criteria for building construction as established by the Department
of Education;
f.
If the District chooses to use temporary classrooms to meet its Plan
obligations, it is to place handicapped students in these classrooms only
when an equal number of non-handicapped students are placed in such
facilities;
g.
When the District identifies available rooms it will commit the same
number of rooms in that particular district for a minimum of three (3)
years. After that time period the Director of Special Education shall meet
with the District Superintendent to assess the feasibility of maintaining
these rooms for low incidence students for an additional three (3) years.
4.
By October 1 of each year, the Lincoln Intermediate Unit Director of Special
Education will notify the District Superintendent of the current count of lowincidence handicapped students and its associated Plan goal.
5.
By May 15 of each year, the Superintendent will notify the Lincoln Intermediate
Unit Director of Special Education of the location of new rooms to be available for
the coming school year. Beginning with the 1989-90 school year, the District
agrees to add at least one room to its total number of rooms allocated under the
Plan until such time as the District's total allocation of Plan classrooms meets its
minimum Plan goal. If the Superintendent of any School District within the region
is unable to meet their quota of rooms, it will be their responsibility to make other
accommodations with their fellow Superintendents within that region.
6.
The Lincoln Intermediate Unit Director of Special Education will be responsible
for determining which classes are placed in to the School Districts' available
classrooms. This decision should be based on an equitable division of lowincidence students within the region as well as consideration being given to
where the various students reside. Consultation will be provided by local
Superintendents between the months of January and May to guarantee that all
concerns within the region are met and that no students are placed in
substandard classrooms.
7.
All personnel working in buildings where the special education classes are
located will be expected to follow the integration services procedure as adopted
by the District and Lincoln Intermediate Unit.
