INTERGOVERNMENTAL RELATIONS FRAMEWORK
ACT, NO. 13 OF 2005
Purpose :
To establish a framework for the national government, provincial governments
and local governments to promote and facilitate intergovernmental relations;
to provide for mechanisms and procedures to facilitate the settlement of
intergovernmental disputes; and to provide for matters connected therewith.
 Cape Winelands is fully participating at all PCF meetings (represented by

Executive Mayor and Municipal Manager).
 Participation at Provincial Technical
Communications, IDP and others.
Committees,
e.g.
Transport,
 Speakers Forum is active in the Western Cape though not legislated.
 Cape Winelands plays a secretariat role for the Western Cape MM Forum.
 All of the above strategically feed to the PCF agenda setting.

This forum consists of the district and local municipal mayors and they
are convened by the District Mayor, Ald. C.A. de Bruyn. Municipal
Managers also attend to provide support.

A dedicated Administrative Officer, Mr. Dorian Heath provides the support
to the DCF and other IGR structures under control of political leadership.

The DCF is quarterly meeting with standing items on circulars and SALGA
inputs or comments.
 Circulars and its effects to Local Government
 National and Provincial presentations and its effects on municipalities.
 Presentation of district budget (projects) for practical implementation challenges
(avoiding duplication).
 Presentation by parastatals, e.g. Eskom, Telkom.
 Shared services, e.g. Task Evaluation Administrator, Risk and Performance
Management, etc.
 DCF resolutions are fed to all municipalities internal administrative processes for
actions.
 No consistency on attendance by Executive Mayors.
 Agenda setting often left to the District Mayor.
 Powers of DCF (limited to consultation and participation).
These forums are coordinated under the directive and support of the District Municipal
Managers Forum.

district, local and provincial government.

Functions of Speakers as per Local Government Municipal Structures Act,
No. 117 of 1998, with specific reference to section 37
(a) Presides at meetings of the council;
(b) Performs the duties and exercises the powers delegated to the speaker in terms
of section 59 of the Local Government Municipal Systems Act, 2000 (Act No. 32
of 2000).
(c) must ensure that the council meets at least quarterly;
(d) must maintain order during meetings;
(e) Must ensure compliance in the council and council committees with the Code of
Conduct set out in Schedule 1 to the Local Government Municipal Systems Act,
2000 (Act No. 32 of 2000); and
(f) Must ensure that council meetings are conducted in accordance with the rules
and orders of the council.

 Policies that affects Councillors, such as Travelling, Tools of the Trade and

 Conduct of Councillors including Declaration of Interest
 Promotion to Access of Information
 Filling of Council vacancies and By-elections
The Forum has engaged with the Provincial Minister of Local Government for his
support .

 Conducting capacity Workshops including Ward Committee Members on
Participatory Democracy , involvement in IDP and inputs on bills that
directly affects communities e.g. Land reform bill .

SALGA matters :
 Participation on Working Groups is monitored by Executive Mayor
 SALGA circulars regarding policy matters are included in the agendas of
Mayoral Committee meetings, which are then also submitted to Council
meetings.

PROVINCE TO FEED TO THE PCF, E.G. SUSTAINABLE
WATER, ELECTRICITY , ETC.
