The changes will start to happen in September 2014. The ‘Children and Families Act’. Part 3 relates to how children and young people with special educational needs will be assessed and supported. Southern Derbyshire Clinical Commissioning Group North Derbyshire Clinical Commissioning Group Erewash Clinical Commissioning Group Hardwick Clinical Commissioning Group Support & Aspiration Some of the most significant changes happening are listed below: A coordinated assessment process for 0-25 year olds (across health, education, social care) An Education, Health and Care Plan which brings services together and is focused on improving outcomes. This will replace statements of special educational needs (SEN) and extend statutory protections to young people aged 16-25 in colleges. An offer of a personal budget for families with an Education, Health and Care plan. The existing school-based SEN categories of 'School Action' and 'School Action Plus' are to be replaced by a single, schoolbased category. Local Authorities must publish and review information about a range of services available for children and young people with special educational needs and disabilities (SEND) aged 0-25 years. This is to be known as the ‘Local Offer’. The ‘Local Offer’ should provide clear information about support and opportunities that are available (e.g. schools, health services, groups and activities). Derbyshire must involve parents, children and young people in developing and reviewing its Local Offer. The Local Offer should not simply be a list of services but it should be a way of looking at what services are available in Derbyshire and identifying where there may be gaps in services. There is no extra money to provide more services so it is especially important that the services that are available are the right ones for families. If your child/young person already has a Statement of Educational Needs, this will be transferred to an EHC Plan in the next 3 years. Once your child/young person has an EHC Plan you will have the right to request support through a Personal Budget. If there are other professionals involved with your child/young person a Team around the Family Meeting may be arranged. You can all agree who will act as your Keyworker. If the help is mainly needed at the early years setting, school or college, someone at school can act as your Keyworker. This would be the professional who is involved with your child and is best placed to help you to get the support you need. Families have said that the times when they need a Keyworker could be when your baby is born with health needs, starting nursery or school, changing school or college and teenage years. We are exploring in Derbyshire how to introduce the role of key workers when families need them. The plan will be reviewed. In most cases the support from the Local Offer and the Single School Category for Special Educational Needs at the setting will be enough. Once completed it will be submitted to the Local Educational Authority with a request for the additional resources which will be needed to give your child the support which has been identified in the Local Support Plan. Your Key Worker would make sure that all the information about your child, young person and your family is up to date using an Early Help Assessment and Person Centred tools. If the Local Support plan is not agreed, advice will be given on how further support can be accessed through the Local Offer and the Single School Category funding for special Educational Needs. In both cases Your Key Worker will plan a review meeting with you to make sure the right support is in place. This would be possible through an Education, Health and Care Plan, so a Request for Statutory Assessment of Educational Needs would be completed by your key worker. Parents also have the right to request a Statutory Assessment of Special Education Needs. All relevant previous assessment and information about your child/young person will be used to inform the coordinated assessment.
