The 1994 CDM regulations place a legally binding responsibility on the part of the Client to ensure that the designers, planning supervisors and principal contractors are all “competent”. Notifiable projects require a considerable amount of supporting documentation in order to satisfy the HSE. Failing to ensure that the designer, planning supervisor and principal contractors are appointed, and competence are two offences that can be committed under section 33 of the 1974 Health & Safety at Work Act. Failing to ensure that the Health & Safety File and Health & Safety Plan are prepared and available for inspection are also offences that can be committed by the Client.
