A Resolution encouraging Austin Peay State University’s Student Government
Association to administer a cap on campaign contributions and spending.
WHEREAS, SGA exists "to serve as the voice of the students, and to make sure their
thoughts and needs are heard and addressed to increase their quality of life”.
WHEREAS, current SGA Senators and anyone involved in SGA along with APSU
students have expressed concerns with SGA candidates being able to spend an extremely
high amount of money to campaign for SGA.
WHEREAS, the election of SGA EC members and Senators should be based off of
grassroots campaigning not out spending another candidate.
WHEREAS, a cap on the contributions and spending of candidates will allow greater
competitive participation in Student Government Association Elections, and will
force candidates to use resources wisely and creatively, and
WHEREAS, this resolution will affect all candidates equally, thereby making it
Constitutional as per Alabama Student Party v University of Alabama Student
Government Association 867 F.2d 1344, 1346 ( 1989) and Flint v Dennison 488 F.3d
816 (2007),
THEREFORE BE IT RESOLVED BY THE 64TH GENERAL ASSEMBLY OF THE
AUSTIN PEAY STATE UNIVERSITY STUDENT GOVERNMENT ASSOCIATION
THAT:
Section 1: Upon passage of this Resolution, Article 5 of the electoral act of the
student government association shall be amended and Section 7 should be added to
read: “Campaign contributions and or expenditures, combined or separate, shall
not exceed 500 dollars for any candidate.”
Section 2: Section 8 shall be added to Article 5 of the Electoral act to read:
“Contributions shall be considered a gift of any kind from any organization or any
person.”
Section 3: Section 9 shall be added to Article 5 of the Electoral Act to read: “All
contributions and spending must have a receipt with the business heading and
contact information, and all receipts must be delivered to the Internal Affairs
committee via the Chief Justice no later than 24 hours after items are purchased
and/or donated. Any materials not accompanied by a receipt will be valued at retail
price.”
Section 4: Section 10 shall be added Article 5 of the Electoral Act to read: “The
Internal Affairs Committee shall be responsible for overseeing all contributions and

expenditures, and shall hear any discrepancies concerning contributions and
spending.”
Section 5: These amendments shall be implemented immediately following passage
of this resolution and shall control all elections beginning Spring 2010.
