I , Councillor John Warmisham, Lead Member for Childrens Services ,
in exercise of the powers conferred on me by Paragraph D 4 (a) (xii)
of the Scheme of Delegation of the Council do hereby authorise and approve
the attached new Instrument of Governments for the schools listed below, to reflect the reconstitution
of their governing bodies as requested by their governing bodies in accordance with the Education Act
2002 and under the School Governance (Constitution) (England) Regulations 2003:

The reasons are:
1. On 1st September 2003 the School Governance (Constitution) (England) Regulations 2003
came into force. These regulations require all governing bodies to review their composition
and reconstitute with a new Instrument of Government in place by 31 st August 2006.
Governing bodies decide when is the best time for them to do this and still comply with this
requirement.
2. The governing bodies listed above approved their draft Instruments of Government, to comply
with the School Governance (Constitution) (England) Regulations 2003, at their governing
body meetings held on the dates shown below:

Approval for The Instrument of Government for The Cathedral School of SS Peter and John
Roman Catholic Primary has been sought and received from the Roman Catholic Schools
Commission of the Salford Roman Catholic Diocese.
The legal process for a new Instruments of Government to be made is by an Order of Salford
Local Education Authority, in accordance with School Governance (Constitution) (England)
Regulations 2003.
The drafts attached have been drawn up in accordance with the Regulations.
Once approved, the new Instruments of Government will come into effect from the date
shown on the instrument.
Options considered and rejected were:
None - as once the draft Instrument of Government has been approved by the governing body a new
Instrument of Government is required under School Governance (Constitution) (England) Regulations
2003.

ROMAN CATHOLIC PRIMARY SCHOOL

The name of the school is “The Cathedral School of SS Peter and John RC Primary”.
The school was founded by and is part of the Catholic Church. The school is to be
conducted as a Catholic School in accordance with the canon law and teachings of the Roman
Catholic Church, and in accordance with the Trust Deed of the Diocese of Salford and in
particular:
a)
religious education is to be in accordance with the teachings, doctrines, discipline and
general and particular norms of the Catholic Church;
b)
religious worship is to be in accordance with the rites, practices, discipline and liturgical
norms of the Catholic Church;
and at all times the school is to serve as a witness to the Catholic faith in Our Lord Jesus
Christ.
3.
The school is a voluntary aided school.
4.
The name of the governing body is: The governing body of “The Cathedral School of SS
Peter and John RC Primary”.
5.
The governing body shall consist of:
a)
2 x parent governors;
b)
1 x LEA governor;
c)
2 x staff governors (including the headteacher);
d)
7 x foundation governors of whom 2 shall, at the time of their appointment, be eligible for
election or appointment as parent governors.

Total number of governors is 12.

Foundation Governors are appointed and may be removed by the Bishop of Salford (or any
other person exercising Ordinary jurisdiction on his behalf).

The holder of the following office shall be a foundation governor ex-officio;
The parish priest of St John's Cathedral, Salford.
b)
The foundation body or person named in paragraph 7 above shall be entitled to appoint
a foundation governor to act in the place of the ex-officio foundation governor whose
governorship derives from the office named in a) above, in the event that the ex-officio

foundation governor is unable or unwilling to act as a foundation governor, or there is a
vacancy in the office by virtue of which is governorship exists, or the ex-officio governor
has been removed from office at the request of the foundation body or person named in

request the removal of any ex-officio foundation governor and to appoint any
substitute governor.

religious character in accordance with the principles of the Church of England
and in partnership with the Church at parish and diocesan level.
