State has ended in a major victory for Ms. Upton and her
union with the State Human Rights Commission ruling
t h a t t h e S t a t e D e p a r t m e n t of
Correctional Services h a d disc r i m i n a t e d a g a i n s t Ms. U p t o n on
t h e basis of h e r sex.
T h e S t a t e H u m a n R i g h t s Commission c h a i r m a n , J a c k M. Sable,
recently ruled t h a t Ms. U p t o n
should be r e i n s t a t e d to her former position as a cook a t t h e
Adirondack Correctional Facility
with full back pay for two years,
medical expenses, lost b e n e f i t s
a n d p a y m e n t of $1,500 by t h e
S t a t e for m e n t a l a n g u i s h a n d h u miliation s h e s u f f e r e d a s a result
of being laid off in S e p t e m b e r
1972, a f t e r 18 years as a cook
a t t h e correctional facility. T h e
H u m a n R i g h t s Commission ruled
t h a t Ms. Upton a n d CSEA were
correct in c h a r g i n g t h a t s h e was
laid off a s t h e insult of a discrimi n a t o r y ruling t h a t h e r position
sliould go to a male.

yard. A question comes to mind
as to why t h e power would have
been restored without the permission of t h e Fire D e p a r t m e n t .
Maybe the permission h a d been
given. Operations were all b u t
finished. I t was four hours a f t e r
the fire began. Only " t a k i n g u p "
operations were going on. T h e
wire was simply n o t visible. I t
was a n accident which any firefighter would quiclcly a t t r i b u t e
to being " p a r t of t h e job."

registration operation h a s saved
$130,000.
• T h e D e p a r t m e n t of Motor
Vehicles h a s recently completed
a u t o m a t i o n of its procedures for
revocation a n d suspension of driver's licenses following court
convictions. T h i s move will get
u n s a f e drivers off t h e road m o r e
quickly, a n d save approximately
$80,000 annually..

will save $42,000 a n n u a l l y by
using computerized typesetting
equipment
for u p d a t i n g

At the scent of the fire on
23rd Street some years ago in
which 12 firefighters died,
Commissioner O'Hagan, in an
interview, said that when a
firefighter is killed, each of
us dies a little that day.
Nothing could be more true.

people to live in a city where fixed expenses are among the

If City Council can solve the problem, the members will
all deserve to be elected to Congress, because the same
problems in other forms exist there. For now, though, we
give them an "A" for effort.

Sick Leave Bank
Contested
In June 1973, Appellate Division, Fourth Department,
was faced with a question of whether a board of education
of a school district coirtd agree to the establishment of a
"sick leave bank" in collective bargaining negotiations with
the teachers' union.
It was agreed in the negotiations in 1968 and 1969 that
for the two-year period beginning September 1, 1969, each
teacher:
"shall be permitted to contribute up to three (3)
days from his sick leave accumulation reserve each
school year to a sick leave bank, which shall be established to aid teachers who suffer prolonged illness and whose sick leave accumulation has been
exhausted. The Board shall match each such contribution up to a maximum total reserve of 3,000
days. The line item in the 1969 budget shall be
$10,000."
The contract further provided that in case of a prolonged
illness, a teacher with three years or less of service who
would otherwise be qualified, could draw up to 40 days of
credit from such accumulated days in the sick leave bank,
and that a tenured teacher could draw up to 90 days' credit
from the sick leave bank.
AFTER THE EFFECTIVE date of the contract, the State
Comptroller ruled that the provision for transfer or assignment of sick leave credits of one public employee to another
was unlawful, and that payment by the Board of Education
under this agreement with the teachers' union would not be
approved. The Board of Education notified the union of
this opinion, and the teachers' union thereupon commenced
this lawsuit in which there was no dispute as to the facts.
Plaintiff moved for summary judgment in its favor, and
the State Comptroller, who was a third party defendant,
cross-moved for summary judgment in his favor. Special
term agreed with the Comptroller that there was no authorization for the transfer or assignment of sick leave
credits from one employee to another, and that sick leave
was by its very nature personal and unassignable.
The Appellate Division reversed the lower court and
held that the provision in the contract for a sick leave bank
was lawful, and that a judgment should be entered declaring
such provision to be valid. In making its decision, the court
pointed out that the Taylor Law requires negotiations as
to terms and conditions of employment between the public
employer and its employees and to enter into written agreements with the employee organization in determining such
terms and conditions of employment. Therefore, once it is
determined that the question of sick leave is a term and condition of employment, the employer is required to negotiate
with regard to it. The court further pointed out that an
understanding would have to be incorporated into a collective agreement unless some statutory provision circumscribes
its power to do so.
IN THE OPINION, the court dlscusssed the now landmark Huntington case. In which the Court of Appeals stated
that a public employer is presumed to possess the broad
powers needed to negotiate with employees as to terms and
conditions of employment. This presumption may be rebutted
by showing a statutory provision which expressly prohibits
collective bargaining as to a particular term or condition,
but "in the absence of an express legislative restriction
against bargaining for that term of an employment contract
between a public employer and its employees, the authority
to lu-ovide for such term resides In the school board under
the broad powers and duties delegated by the statutes." The
defendant in this case cited no statute which circumscribed
the power of the board of education to include such provision in the contract.
This case was appealed to the New York State Ck>urt of
Appeals, which came down with its decision last week af*
firming the Appellate Division by stating as follows: "One
should construe the language in the Huntlnfton case to
mean that collective bargaining under the Taylor Law has
broad scope with respect to the terms and conditions of

Court-Ordered Remedies:
Back Pay a n d Affirmative Action.
Where the courts have found discrimination, they have ruled t h a t remedies
m u s t not only open the doors to equal
employment for all, b u t also mxist
"make whole" a n d "restore the rightful economic s t a t u s of all those In a n
"affected class"; I.e., those who have
suffered and continue to suffer effects
of past discrimination. In practice, this
has resulted in extremely expensive assessments for back pay a n d legal costs.
Under Title VTI, back pay may be
awarded to a n entire "affected class"
extending up to two years prior to the
date a discrimination charge is filed.
T h e lengthy processes of Investigation,
attempted conciliation a n d legal action
often add years to this period, at great
additional cost to the employer.
Remedial affirmative action programs
ordered by the courts have varied In
nature a n d scope, depending on the
type of discrimination found.
Courts have required f u n d a m e n t a l
changes in all aspects of employment
systems a n d they have specified n u m bers or percentages of minorities and
females to be hired, trained, or promoted in specific job categories, until
certain goals are reached. They usually
require a n employer to undertake such
action quickly, with followup monitoring by the court.
Here a r e some recent examples of the
kinds of practices ruled discriminatory
by the courts, costs to the employers,
and nature of affirmative action ordered:
• Anaconda Alumlntim Company was
ordered to pay $190,000 In back wages
and court costs to 2(76 women who
alleged t h a t the company maintained
sex-segregated Job classlflcaltons. Jobs
formerly classified "Female" a n d "Male"
h a d been reclassified as "light" and
"heavy," but women still were prevented f r o m transferring to "heavy"
Jobs, a n d a f t e r layoffs, the company
hired new male employees into "heavy
lobs" r a t h e r t h a n recalling females with
seniority In "light" Jobs. T h e company
was ordered to assure opportunity for
all Jobs to anyone who could qualify.
• Virginia Electric Power Company
w<as ordered to pay $250,000 to compensate black workers for wages they would
have earned If they h a d not been kept
from promotion by a discriminatory system. T h e company was also ordered to
eliminate use of High School diploma
(oi" equivalent), a n d a p t i t u d e tests as
hiring or promotion criteria for blue
collar jobs, because these selection
methods were not job-related; to eliminate existing t r a n s f e r a n d promotion
systems based on Job and departmental
seniority (which perpetuated effects of
past discrimination) a n d allow upward
mobility movement based on total employment seniority. Affirmative hiring
was also ordered; a t least 25 percent of
new union hlrees were to be non-whites,
until their level of employment in union
jobs reached 21.5 percent. Grdals were
also set for clerical Jobs.
• Black employees of the Lorlllard
Corporation were awarded $50,000 In
back pay when the court found t h a t
departmental seniority and
limited
transfer rights In contracts between
this company a n d its union limited access of blacks to most Jobs. Every black
employee who h a d suffered loss of
promotional a n d pay-raise opportunity
was compensated according to w h a t he
would have received, based on company seniority, h a d the discriminatory
practices not existed. T h e company was
ordered to establish plant-wide seniority
and to assure t h a t no employee t r a n s f e r ring to a d e p a r t m e n t f r o m which he hac'
been excluded would receive a wage cut.

change seniority a n d assignment systems to assure t h a t blacks h a d equal
opportunity for assignment and promotion to all Jobs.
• Household F i n a n c e Corporation
paid more t h a n $125,000 to white-collar
female employees who charged they
were denied promotion because of sex.
Under terms of a consent decree, the
company also agreed to hire 20 percent
females for branch representatives openings (subject to availability) until such
representatives were 20 percent female,
and to hire 20 percent f r o m specified
minority groups for clerical, credit and
branch representative jobs until total
employees reached 65 percent of their
population in the labor area. HFC also
agreed to train female and minority

ordered to pay $120,000 In back wages

represent," plus $25,000 In attorney
fees and court costs. This company was
ordered to hire black workers in a 2-1
ratio for four years, until the combined
production a n d clerical work force h a s
a ratio of blacks in proportion to the
non-white work force in the company's
labor area.
• Llbbey-Owens-Pord Company, under
a consent decree, agreed to open bidding
for all Jobs to women, including those
previously barred because of State laws
requiring overtime pay a n d welghtllftln« restrictions. T h e company a n d its
union agreed to s t a r t a training program to aid women employees in t r a n s ferring to better jobs, to undertake specific recruitment a n d advertising to a t tract women applicants and—depending
upon availability—to select two women
out of the nejrt four foremen hired in
certain departments.

and effects of p a s t discrimination is
reflected i n the m a j o r agreement signed
by American Telephone a n d Telegraph
Company with EBOC a n d the D e p a r t ment of Labor, a f t e r more t h a n two
years of litigation. This agreement, confirmed by a federal court consent decree, may serve both as a costly w a r n ing a n d a helpful guide to other employers. Its m a j o r provisions Include:
• Approximately $15 million—by f a r
the largest single back pay award ever
made—in one-time payments to thousands of employees charged to have s u f fered f r o m discriminatory employment
practices.
• An additional estimated $50,000 In
yearly p a y m e n t s for promotion a n d wage
a d j u s t m e n t s to minority and female
employees.
• Affirmative actions to Include:
• Specific hiring and promotion t a r gets, Including goals to significantly increase utilization of women a n d minorities in every Job classification. These
targets will be reviewed regularly by
EEOC and t h e Office of Federal Contract Compliance.
• Goals for employing males in previously all-female jobs.

T h e Social Services Committee met
twice since the last delegates meeting. A
meeting was held in conjunction with
the County delegates meeting. I t was
held in Buffalo in J u n e . A review of t h e
1974 legislation as It affected the Social
Services law was reviewed. Much emphasis was placed on the Family Services
Laiw of 1974 which had passed t h e Assembly and the Senate, b u t was vetoed
by the Governor. T h e veto was largely
due to the efforts of CSEA, and, In p a r ticular, the Erie County unit.
A regional meeting was held In August at the Holiday Inn, Johnstown. I n put was by a m a n a g e m e n t team f r o m
the New York State Department of Social Services. The meeting was well a t tended and f u t u r e regional meetings
are planned.
The most recent meeting of the Committee took place on Friday, Sept. 27, a t
Albany. T h e Committee met with Norma
Wedlake, executive secretary of the
Temporary Commission to Revise the
Social Services Law a n d Byron Hippie,
research director of the Commission.
Support of CSEA of this Family Service
Department was sought.
It was the feeling of the Committee
• Women a n d minorities now in n o n m a n a g e m e n t n o n - c r a f t Jobs will be able
to compete for c r a f t Jobs based on their
qualifications and company seniority.
• Promoted employees will be paid,
generally, on the basis of their length
of service.
• All female college graduates hired
since 1965 will be assessed to determine
Interest a n d potential for higher level
jobs a n d a specific development program will prepare these women for
promotions.
After two years of contesting extensively documented government charges
of discrimination, m a i n t a i n i n g t h a t t h e
company was carrying out a n effective
a f f i r m a t i v e action program, a n AT&T
official statement sximmed u p :
" . . . Rapidly evolving legal req{ilrements plus . . . new administrative rules
and guidelines have changed t h e ground
rules. Now t h a t we h a v e cleai«d aiway
t h e uncertainties, we are eager to get

Numerical Goals a n d Timetables
It is clear f r o m these legal developments t h a t where violations of the law
are found, broad remedial action to
"remove vestiges of p a s t discrimination
. . . eliminate present a n d assure the
non-existence of f u t u r e barriers to full
e n j o y m e n t of equal job opportunities"
will be required, and t h a t remedial action often requires some kind of special t r e a t m e n t for a period of time.

requiring
companies a n d unions to provide preapprentlce a n d apprentice training, to
hire, promote a n d t r a i n minorities a n d
females who have suffered f r o m discrimination In specified numerical r a tios, In specified Job categories, until
specified remedial goals are reached.
Although Title v n bars preferential
hiring simply to eliminate racial employment Imbalances In relation to population ratios. Federal Courts consistently have found numerical goals a n d
timetables to be a Justified and necessary remedy a n d m e a n s of eliminating
tiie present effects of p a s t discriminatory practices.

T h e new amendments to Title VII of
the Civil Rights Act, known as t h e
Equal Employment Opportunity Act
of 1972, give t h e EEOC a n d the Dep a r t m e n t of Justice new enforcement
responsibilities for eliminating discriminatory employment practices among
state a n d local governments, Including
authority for the EEOC to seek court
enforcement of its decisions and a u t h ority for t h e D e p a r t m e n t of Justice to
bring civil actions against state or local governments.
Second, under t h e Intergovernmental
Personnel Act. the Civil Service Commission assists state a n d kx;al governments; for Instance, the Commission
gives g r a n t s to Improve testing a n d
selection procedures. One of t h e Commission's objectives in this assistance
is to help ensure non-discrlminatlon in
t h e various s t a t e a n d local personnel
systems.

service-delivery systems; e.g., the u a .
Employment Service, in which the local workers remain local, r a t h e r t h a n
federal, employees. Regulations under
these laws require t h a t such local systems be operated on a n o n - d l s c r l m l n a '
tory basis.
Fourth, state a n d local governmental
units. Insofar as they may be c o n t r a c tors with the Federal Government, are
covered by Executive Order No. 11»46,
which forbids discrimination on the
part of the Federal contractors.

Given Grant

Executive Alfred B. DelBello
announced the receipt of a
grant of $101,480 from the
National Council on Aging t o operate a senior services employmen<t program in Westchester.
According to Mr. DelBello, t h e
program is designed to hire 50
low-income, elderly persons to
work p a r t - t i m e in community
service activities.
T h e senior c o m m u n i t y services
employment program is funded
by t h e D e p a r t m e n t of Labor u n der Title DC of t h e Older American's Act of 1965. Mr. DelBello
said Westchester is one of only
t h r e e coimties in t h e s t a t e to receive f u n d i n g .
T h e County Office of t h e Aging, dh-ected by Marvin Sicherm a n , will administer t h e program. Mae C a r p e n t e r h a s been
appointed Project Director.

Renew Legislation
At a recent meeting of the
statewide retirees conunittee a n d
retiree c h a p t e r presidents, we r e viewed t h e legislation t h a t h a d
been passed in the 1974 legislative session. T h e li974 session
adopted legislation, now C h a p t e r
426 of the Laws of 1974, providing additional supplemental p e n sion for pensioners a n d beneficiaries who retired prior to J a n .
1, 1969 a n d those retirees who
became 62 years of age prior to
J u n e 1,19712. W e were h a p p y a n d
t h a n k f u l for t h e passage of this
bill as a good percentage of our
retirees benefited thereby. .However, it did not fully meet the
expectations we h a d hoped for, in
particluar t h a t t h e supplemental
p a y m e n t is still on t h e y e a r - t o year basis.
At our meeting, t h e question of
our constitution was b r o u g h t u p .
T h e r e are certain aspects of It
we c a n n o t abide by because of
t h e vast a m o u n t of territory some
of our chapters cover. We r e quested all committee members
and chapter presidents to send in
suggestions to our staff coordinator for proposed changes. We
then will submit a model constitution to t h e constitution a n d
by-laws cotnmittee for approval.

to cover all retirees. W e do not

a n d it is most i m p o r t a n t t h a t
this bill be on a p e r m a n e n t basis.
3. Under t h e provisions of
law, persons retiring in the years
1966, 1967, a n d 196® receive upon
retirement an insurance c e r t i f i cate in t h e a m o u n t of $2,000.
Persons retiring in 1969 a n d
t h e r e a f t e r receive a certificate in
the a m o u n t of $3,000. We b e - ^
lieve this type of b e n e f i t s h o u l t ^
be m a d e available to persons who
retired prior to t h e year 1966 a n d
t h a t legislation ~ be introduced
providing therefore.
Reduce UtlUty Bills
3. T h e third item we would
like to recommend is a 16 percent
reduction on utilities for senior
citizens. Some of our m e m b e r s
have spoken to t h e i r local companies a n d f i n d t h e m quite r e - ^
ceptive to the idea.

4. As the f o u r t h issue, we suggest a legislative study
on
m e a n s of f i n a n c i n g t h e educational system other t h a n real
estate. We feel t h a t retirees, a r e
in jeopardy of losing homes b e cause of rising education taxes.
5. T h e f i f t h issue we would like
to propose is t h e establishment
of free or a reduction of r a t e s
for public t r a n s p o r t a t i o n
for^
senior citizens. Tliis h a s been i r p stituted
in
numerous
areas
t h r o u g h o u t t h e S t a t e , b u t we
would like to see i t encompass
t h e whole of New York S t a t e .
6. T h e last item t o be proposed
would be on t h e federal level. We
would like to see t h e f i r s t $5,000
of pension income exempt f r o m
tax.
