RULE TITLE:
Adjustments to Reflect Consumer Price Index
PURPOSE AND EFFECT: The purpose of the amendment is to adjust the firefighter
death benefits provided in section 112.191(2), F.S., for the 2015-2016 year based
on the Consumer Price Index (CPI) for All Urban Consumers published by the
United States Department of Labor.
SUMMARY: In April 2015, the CPI for All Urban Consumers decreased 0.2 percent
over the last 12 months. The proposed amendments will adjust the firefighter death
benefits provided in section 112.191(2), F.S., for the 2015-2016 year, based on the
CPI for All Urban Consumers published by the United States Department of Labor.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST AND LEGISLATIVE
RATIFICATION: The agency has determined that this rule will not have an adverse
impact on small business or likely increase directly or indirectly regulatory costs in
excess of $200,000 in the aggregate within one year after the implementation of
the rule. A SERC has not been prepared by the agency.
The agency has determined that the proposed rule is not expected to require
legislative ratification based upon the statement of estimated regulatory costs or if
no SERC is required, the information expressly relied upon and described herein:
The Department conducted an economic analysis of the potential impact of the
proposed rule and determined that there will be no adverse economic impact or
regulatory increases that would require legislative ratification.
Any person who wishes to provide information regarding the statement of
estimated regulatory costs, or to provide a proposal for a lower cost regulatory
alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:
69A-64.005 Adjustments to Reflect Consumer Price Index.
(1) Section 112.191, F.S., requires that the Division adjust the statutory
amount(s) payable to show price level changes in based on the Consumer Price
Index for all Urban Consumers published by the United States Department of Labor.
On June 15 of each year, the Division shall calculate the adjusted statutory
amounts using the most recent month for which Consumer Price Index data is
available. The adjusted statutory amounts shall adjustment is to be effective on
July 1 of each year using the most recent month for which data is available as of
the time of the adjustment.
(2) The amounts payable for the period from July 1, 2015 2014 through June
30, 2016 2015, using the Consumer Price Index for All Urban Consumers published
by the United States Department of Labor for April, 2015 May, 2014, which is the
most recent month for which data is available as of the time of the adjustment,
are:
(a) For those benefits paid or to be paid under paragraph (a) of subsection (2)
of Section 112.191, F.S.: $65,909.66 66,041.74.
(b) For those benefits paid or to be paid under paragraph (b) of subsection (2)
of Section 112.191, F.S.: $65,909.66 66,041.74.
(c) For those benefits paid or to be paid under paragraph (c) of subsection (2) of
Section 112.191, F.S.: $183,626.17 183,994.16.
