Development Control Committee (West) 1 31 January 2008 (239) DECLARATIONS OF INTEREST Councillor J D Savory declared an interest, the details of which are given under the minute of the item concerned. APPLICATION CONSIDERED BY THE COMBINED COMMITTEE Councillor Mrs C M Wilkins (Chairman of Development Control Committee (East) chaired the meeting for this item. (240) HOLT - 20050518 – Change of use of land to car and coach park, formation of access and erection of toilet block; land adjacent to Thornage Road for Mr G F Chapman The Combined Committee considered item 1 of the officers’ reports in respect of a planning application for the change of use of land to car park and coach park and associated development. Public Speakers Mrs Dann (Holt Town Council) Objecting: Mr Shepherd, Mr Stevenson, Dr Jolliffe, Mr Baldwin Supporting: Mrs Sutton, Mr Pert, Mr Bruce Lockhart, Mr Lintott Councillor Mrs C M Wilkins stated that all Members had been lobbied and received letters in respect of this application. The Senior Planning Officer reported that a further amended plan had been received to indicate a reduction in the site area to allow access to an adjacent field. He explained the amendments that had been made since the site visit on 24 January 2008. The Senior Planning Officer reported that five further letters of support had been received from traders in the town. Two further letters of objection had been received from one of the objectors which raised additional concerns in respect of light, noise, atmospheric pollution, adverse impact on Holt Primary School and policy grounds. The objector also considered that it was premature to consider the application as the reconsultation period had not expired. A further response had been received from the Conservation, Design and Landscape Manager in respect of the amended plan. He considered that the scale of the development and impact on the surrounding area was substantial and would not preserve or enhance the Glaven Valley or the Holt Conservation Areas. In response to the hydrologist’s report the Landscape Officer considered that some concerns had been alleviated but run off from the car park was likely to flow into Spout Hills Spring. The construction methodology, drainage and surfacing would need to be agreed prior to commencement of any works. However, the Landscape Officer maintained her objection on visual impact on the landscape and possible decline of water quality and biodiversity of the County Wildlife Site. The Strategic Director (Communities) had referred to comments he had made previously and considered that these still applied. Development Control Committee (West) 2 31 January 2008 Additional details had been received from the applicant’s agent in respect of a pedestrian walkway which had been forwarded to Norfolk County Council, the Town Council and the Conservation, Design and Landscape Manager. Further details had also been received in respect of surface and foul water drainage which would be forwarded to the relevant consultees. An email had been received from Councillor Mrs H T Nelson in respect of the Council’s priority to encourage year-round tourism. She supported the application despite its encroachment into the AONB. She had referred to the importance of tourism to Holt and welcomed the inclusion of public toilets. The Senior Planning Officer reported that Natural England had no objection to this application. An objection had been received from the Environment Agency which was set out in the report. Further details would be sent to the Environment Agency. The Senior Planning Officer referred to an e-mail from the Highway Authority which was appended to the report stating that a transport assessment would be required if this were a new application. He requested Members to consider if a transport assessment was necessary and, if so, if it should be requested at this stage. He recommended deferral of this application pending the receipt of further information regarding lighting and the receipt of consultee responses in respect of drainage and works to Valley Lane. Councillor P J High, a local Member, outlined the alternative sites that had been considered and the reasons for their rejection. He proposed that the Head of Planning and Building Control be authorised to approve the application subject to the outstanding requirements being met. This was seconded by Councillor J H PerryWarnes. Councillor N P Ripley read to the Committee the comments of Councillor M J M Baker, a local Member, urging the Committee to determine this application. He considered that refusal would undermine an upmarket commercial centre which attracted much investment into the wider North Norfolk area. Councillor B Cabbell Manners stated that the joint Committee had given its view two years previously and he had not changed his view. He stated that cars were a necessity in North Norfolk and referred to the lack of public transport. Councillor H C Cordeaux referred to the comments made by the former Head of Regeneration in 2005 in respect of the ratio of car parking spaces to retail floor space compared to other towns. He considered that parking problems had become worse since then. He considered that the proposed car park would end the hunt for car parking spaces which increased carbon footprint. He stated that roadside parking ruined the approach into the town. He suggested that part of the car park be designated as long-stay. Councillor Mrs B McGoun referred to car parking in Hoveton. She stated that a car park which was a similar distance from the village as the proposed car park was from Holt was under-used as people preferred to park nearer the centre. She considered that people would still drive around searching for parking spaces in the town. She considered that further investigation should be made into a possible park and ride scheme. Development Control Committee (West) 3 31 January 2008 Councillor J H Perry-Warnes stated that he represented Holt as a County Councillor. He considered that the proposed car park would be a planning gain. He considered that the proposed planting belt would improve the area. He also considered that there would be an advantage to the Primary School as children could be dropped off in the car park and walk along Valley Lane to the school. Councillor Mrs A R Green considered that the in-town parking spaces should be made short-stay and that people working in the town should use the proposed car park. Councillor Mrs A C Sweeney stated that she formerly worked in the Holt Tourist Information Centre and had seen the anger and frustration of visitors who were unable to park. Councillor P Bevan Jones supported Councillor Mrs McGoun’s comments regarding a park and ride scheme. She was concerned that there was insufficient information regarding drainage, possible effect on aquifers, and lighting. Councillor T H Moore referred to the need for coach parking and supported the application. The Committee considered the need for a transport assessment. Having regard to the Committee’s understanding of problems experienced by drivers of traffic currently circulating the town in trying to find a parking space, on being put to the vote it was RESOLVED That no transport assessment be required. It was proposed by Councillor P W High, seconded by Councillor J H Perry-Warnes and RESOLVED by 14 votes to 3 with 1 abstention That the Head of Planning and Building Control be authorised to approve this application with appropriate conditions and subject to the receipt of further information and procedural matters as outlined in the report and no objections being received from outstanding consultees or new points being raised as a result of readvertisement of the application. ITEMS CONSIDERED BY DEVELOPMENT CONTROL COMMITTEE (WEST) Councillor H C Cordeaux in the Chair. (241) BINHAM – 20060688 – Retention of Wash-Down Facility and Diesel Tank; Manor Farm, Field Dalling for Taylor Farms Partnership Limited Councillor J D Savory declared a personal, non-prejudicial interest in this application as he did business with the applicant’s father. The Committee considered item 2 of the officers’ reports requesting reconsideration of a planning application following a previous resolution to give delegated authority to the Head of Planning and Building Control to approve in the light of drainage negotiations. Development Control Committee (West) 4 31 January 2008 Public Speaker Mr Cogman (supporting) Councillor J D Savory, a local Member, considered that land drains were the main cause of water on Field Dalling Road rather than the wash down facility and that the hard surfaced farmyard also contributed to run-off. He considered that it was not necessary to install a drainage channel and requested that a time limit be placed on the remaining work. It was proposed by Councillor J D Savory, seconded by Councillor B Cabbell Manners and RESOLVED That this application be approved without the requirement to install a drainage channel and subject to the imposition of appropriate conditions to include a requirement to complete the remaining works within six months of the date of the permission. (242) SHERINGHAM – Tree Preservation Order (Sheringham) 2007 No.8 9b and 11 Holt Road, Sheringham The Committee considered item 3 of the officers’ reports in respect of a Tree Preservation Order at the above site. Councillor Mrs J P Moss, a local Member, stated that she lived close to the site and supported the confirmation of the Order. It was proposed by Councillor P Bevan Jones, duly seconded and RESOLVED unanimously That Tree Preservation Order (Sheringham) 2007 No. 8 at 9b and 11 Holt Road, Sheringham be confirmed as served. PLANNING APPLICATIONS Where appropriate the Planning Officers expanded on the planning applications; updated the meeting on outstanding consultations, letters/petitions received objecting to, or supporting the proposals; referred to any views of local Members and answered Members’ questions. Background papers, including correspondence, petitions, consultation documents, letters of objection and those in support of planning applications were available for inspection at the meeting. Having regard to the above information and the report of the Head of Planning and Building Control, the Committee reached the decisions as set out below. Applications approved include a standard time limit condition as condition number 1 unless otherwise stated. Development Control Committee (West) 5 31 January 2008 (243) BLAKENEY - 20080010 - Removal of condition 8 of planning permission reference 20061800 to provide use of reflective glass; The Coast House Back Lane for Mr and Mrs J Hartley The Committee considered item 4 of the officers’ reports. The Senior Planning Officer reported that no response had been received from the RSPB and he had been informed that it did not normally respond in matters such as this. Natural England had no evidence as to whether or not non-reflective glass increased the incidence of bird strikes. He suggested that Norfolk Wildlife Trust be approached for an opinion. He requested delegated authority to approve this application subject to no objection from Norfolk Wildlife Trust. Councillor Mrs L M Brettle, the local Member, referred to the Parish Council’s objections. It was proposed by Councillor B Cabbell Manners, seconded by Councillor S C Mears and RESOLVED unanimously That the Head of Planning and Building Control be authorised to approve this application subject to no objection being received from Norfolk Wildlife Trust. (244) BODHAM - 20071223 - Change of use of agricultural land to site for one static caravan and one touring caravan and the provision of one transit pitch; land off Hart Lane for Mr R Drake The Committee considered item 5 of the officers’ reports. Public Speaker Mr Bruford (Bodham Parish Council) Councillor J H Perry-Warnes, the local Member, stated that the area was very important in landscape terms and unsuitable for the proposed use. Councillor Mrs A C Sweeney stated that there were two caravan sites in Bodham and she considered there was no need for another site. It was proposed by Councillor J H Perry-Warnes, seconded by Councillor B Cabbell Manners and RESOLVED unanimously 1. That this application be refused on grounds relating to the harmful impact of the proposals on the appearance of this part of the Area of High Landscape Value and the inadequacy of the local road network to accommodate safely the associated traffic as recommended by the Highway Authority. 2. That the Head of Planning and Building Control be authorised to serve an Enforcement Notice to require the removal of all caravans and unauthorised structures from the site and return the land to agricultural use within six months of the effective date of the Notice for the reasons stated above. Development Control Committee (West) 6 31 January 2008 (245) BRISTON - 20071520 - Conversion and extension of garage to provide one-anda-half-storey living accommodation and double garage; Acorn Lodge Macks Loke for Dr and Mrs Brueggemann The Head of Planning and Building Control stated that he knew the applicants but they had not spoken to him in respect of this application. The Committee considered item 6 of the officers’ reports. Public Speaker Dr Brueggemann (supporting) The Acting Development Control Manager reported that amended plans had been received. It was proposed by Councillor J H Perry-Warnes, duly seconded and RESOLVED unanimously That this application, as amended, be approved in accordance with the recommendation of the Head of Planning and Building Control. (246) CORPUSTY - 20071647 - Erection of two single-storey dwellings, five twostorey dwellings and two flats; adjacent 11 Heydon Road for Broadland Housing Association The Committee considered item 7 of the officers’ reports. Public Speaker Mr Mumford-Smith (supporting) The Acting Development Control Manager reported that negotiations were ongoing in respect of the provision of a footpath. He requested delegated authority to approve this application subject to resolution of the highway issues and the applicant entering into a Section 106 Agreement to secure off site highway works. Councillor J H Perry-Warnes, the local Member, considered that the application should be approved and that any discussions regarding a possible footpath should take place independently of the application. He stated that the land required to provide a footpath was in various ownerships and it would not be possible to provide a footpath over the bridge. He considered that the footpath issue should not delay the provision of affordable housing. It was proposed by Councillor J D Savory, seconded by Councillor Mrs A R Green and RESOLVED unanimously That this application be approved subject to the imposition of appropriate conditions without a requirement for the provision of a footpath. Development Control Committee (West) 7 31 January 2008 (247) FAKENHAM - 20071561 - Erection of twenty-four dwellings; land adjacent 95 Holt Road for Anglian Water Group The Committee considered item 8 of the officers’ reports. Public Speaker Mr Mustoe (supporting) The Locum Solicitor explained that the saved Local Plan policy 56 in respect of affordable housing provision set a threshold of 25 dwellings. The national minimum was 15 and the threshold proposed under the Local Development Framework was lower than this. However, this application had to be determined under saved Local Plan policy 56. The Head of Planning and Building Control reported that the Conservation, Design and Landscape Manager was uncomfortable with the indicative designs that had been submitted but this was a matter that could be addressed under the reserved matters application. He suggested that a note be placed on the permission to request the applicants to enter into design negotiations prior to submission of a reserved matters application. The Acting Development Control Manager drew attention to the comments of Environmental Health in respect of the telecommunications equipment on the water tower. He requested delegated authority to approve this application subject to the resolution of the issues raised by Environmental Health, completion of a Section 106 Agreement to secure off-site highway improvements and subject to the imposition of appropriate conditions. Councillor S C Mears, a local Member, requested a further site inspection to appreciate the scale of the development. Councillor P Bevan Jones stated that there was a need for affordable housing and asked if it would be possible to increase the number of units to trigger a requirement for affordable housing provision. Councillor P W High stated that the applicants had previously been requested to reduce the number of dwellings proposed on this site. The Head of Planning and Building Control explained that this would depend on the applicants being willing to negotiate an increase in the number of affordable units and would require deferral of this application. Councillor J H Perry-Warnes raised concerns with regard to landscaping. The Acting Development Control Manager explained that landscaping would be dealt with under reserved matters. It was proposed by Councillor B Cabbell Manners, seconded by Councillor Mrs A R Green and RESOLVED by 9 votes to 0 with 1 abstention That the Head of Planning and Building Control be authorised to approve this application subject to satisfactory resolution of the issues raised by Environmental Health, completion of a Section 106 Agreement to secure off-site highway improvements and subject to the imposition of appropriate conditions. Development Control Committee (West) 8 31 January 2008 (248) FAKENHAM - 20071780 - Erection of 2 single-storey dwellings; Copper Beech Lodge Heath Lane for Mr D Coles The Committee considered item 9 of the officers’ reports. Public Speaker Mr Coles (supporting) The Senior Planning Officer reported that an e-mail had been received from Councillor S T Towers, a local Member, referring to the concerns raised by local residents. She considered that the loss of the trees was unfortunate but as they were not protected or required a felling licence she had no objection to the application. It was proposed by Councillor J A Wyatt, seconded by Councillor J H Perry-Warnes and RESOLVED unanimously That this application be approved in accordance with recommendation of the Head of Planning and Building Control. the (249) FAKENHAM - 20071788 - Erection of two four-storey blocks to provide eighteen flats; 107-109 Holt Road for Fairstead Homes The Committee considered item 10 of the officers’ reports. The Acting Development Control Manager stated that the site had permission for the erection of sixteen dwellings under planning application 20051170 which had been omitted from the ‘Planning History’ section of the report. He referred to the Locum Solicitor’s comments with regard to affordable housing under minute 247 above. The Head of Planning and Building Control read to the Committee the comments of the Conservation, Design and Landscape Manager. He was concerned that, whilst the area surrounding the site was of nondescript character, no attempt had been made to relate the design to the character of Fakenham. The Head of Planning and Building Control considered that there was a case for further negotiations in respect of this application. The Acting Development Control Manager recommended deferral of this application for design negotiations. Councillor J D Savory stated that the modern development adjacent to the ‘Hungry Horse’ public house was a good example. He proposed deferral for negotiations and a site inspection which was seconded. Councillor B Cabbell Manners considered that the density was too high. As an amendment, he proposed refusal of this application on design and overdevelopment grounds, which was duly seconded. On being put to the vote, 5 Members voted in favour of the amendment and 5 against, and on the casting vote of the Chairman the amendment was declared lost. Development Control Committee (West) 9 31 January 2008 RESOLVED That this application be deferred: 1. To allow negotiations in respect of design and a reduction in the number of units. 2. To allow a site inspection by the Committee and that the local Member and Chairman of the Parish Council be invited to attend. (250) HELHOUGHTON - 20071248 - Demolition of dwelling and erection of two twostorey detached dwellings and detached garage; 1 and 2 Raynham Road for Mr G Morris The Committee considered item 11 of the officers’ reports. Public Speakers Mrs Freeman (Helhoughton Parish Council - also speaking on application 20071249 below) Mr Morgan (objecting - also speaking on application 20071249 below) In response to concerns raised by the Parish Council that it had not had sufficient time to consider the amended plans, the Head of Planning and Building Control explained that any decision to approve this application would be subject to no objections being received on the expiry of the reconsultation period. Development Control Committee (West) 10 31 January 2008 (252) HINDOLVESTON - 20071804 - Erection of four dwellings; 3 Melton Road for Mr N Beckett The Committee considered item 13 of the officers’ reports. Public Speakers Mr Howard (Hindolveston Parish Council) Mr Evennett (supporting) Councillor R Combe, the local Member, requested a site inspection and the submission of a street scene drawing. It was proposed by Councillor J A Wyatt, seconded by Councillor P Bevan Jones and RESOLVED unanimously That consideration of this application be deferred to allow a site inspection by the Committee and that the local Member and Chairman of the Parish Council be invited to attend. (253) LANGHAM - 20071789 - Erection of seven dwellings; land at Holt Road/ Swans Close for Hastoe Housing Association The Committee considered item 14 of the officers’ reports. Public Speaker Ms Stephan (supporting) The Acting Development Control Manager reported that the Highway Authority was satisfied with the revised access arrangements and had no objection subject to the imposition of highway conditions. The comments of the Landscape Officer were awaited. The Acting Development Control Manager recommended approval subject to the imposition of appropriate conditions including a full landscaping scheme and materials schedule. It was proposed by Councillor J D Savory, duly seconded and RESOLVED unanimously That this application be approved subject to the imposition of appropriate conditions including a full landscaping scheme and materials schedule. Development Control Committee (West) 11 31 January 2008 (254) SHERINGHAM - 20071180 - Erection of twenty-two flats; Central Garage 49 High Street for Mr N J Wright The Committee considered item 15 of the officers’ reports. The Acting Development Control Manager read to the Committee the applicant’s response to the Committee’s request to include retail within the scheme. The applicant was not prepared to include a retail element but had requested that a letter be attached to the decision indicating that retail development would be welcomed, which he would include in the sale particulars for the site. The Acting Development Control Manager stated that whilst officers considered that it was a missed opportunity, residential use was acceptable in policy terms and the application, as submitted, should be approved. The Locum Solicitor summarised a letter which had been received from an objector who considered that the proposal was premature and contrary to PPS6 and the emerging LDF. He advised the Committee that it was difficult to justify refusal based on prematurity unless it would have a major and significant impact on the policies emerging in the LDF. He did not consider that the impact would be major or significant. Councillor Mrs J P Moss, Member for Sheringham South, stated that she consulted informally with relevant parties and whilst development of the site welcomed there was a consensus that it should be a mix of housing and retail. referred to the Appleyard development in Holt which had enhanced the town considered that a similar scheme should be encouraged in Sheringham. had was She and Councillor P Bevan Jones, a local Member, supported Councillor Mrs Moss. She stated that access and egress was poor. The site had enormous potential but required careful thought. She suggested that a care home for the elderly was a possibility. The Head of Planning and Building Control explained that the Committee was not being asked to consider retail development. He stated that the proposals in the LDF were not firm enough to justify refusal of this application. The site was being considered as part of the Site Specific Proposals which were at least one year from submission. The Committee was being asked to consider residential use. The scale and nature of traffic generated was, however, a material consideration. The Chairman suggested that evidence be sought of the number of traffic movements currently associated with the site compared with projected traffic movements associated with residential use. It was proposed by Councillor J A Wyatt, seconded by Councillor Mrs A C Sweeney and RESOLVED unanimously That consideration of this application be deferred to obtain a survey of current traffic movements in and out of the site. Development Control Committee (West) 12 31 January 2008 (255) SHERINGHAM - 20071735 - Demolition of dwelling and erection of three flats; 18 New Street for B S F Norfolk Limited The Committee considered item 16 of the officers’ reports. Councillor P Bevan Jones, a local Member, requested a site inspection as she was concerned with regard to the safety of the adjoining dwelling. The Locum Solicitor explained that the adjoining owner had a right of support and protection but this was a civil matter and the Committee had to assume that the works would be carried out correctly. Councillor P W High stated that the Committee had recently visited an adjacent site and considered that Members were already familiar with the area. Councillor P Bevan Jones withdrew her request for a site inspection. It was proposed by Councillor P W High, seconded by Councillor J D Savory and RESOLVED unanimously That this application be approved in accordance with recommendation of the Head of Planning and Building Control. the (256) UPPER SHERINGHAM - 20071615 - Conversion of former public house to two dwellings, demolition of outbuildings and erection of two-storey dwelling; former Red Lion Public House The Street for John Aston’s Children’s Settlement The Committee considered item 17 of the officers’ reports. Public Speakers Mr Horne (Upper Sheringham Parish Council) Mr Woodrow (supporting) The Acting Development Control Manager requested delegated authority to approve this application subject to a condition to prevent the commencement of works until a contract is let for Usher’s Barn and to prevent occupation of the former public house until Usher’s Barn is completed. Councillor Mrs A C Sweeney, the local Member, expressed concern that work had not yet commenced on Usher’s Barn. She stated that the storeroom building at the rear of the Red Lion had been part of the public house premises and should not be treated differently from the conversion of the public house. The Head of Planning and Building Control explained that as a compromise it was being suggested that work be allowed to commence on the proposed dwelling at the rear, but not on the conversion of the public house, until a contract for Usher’s Barn had been let. There was a danger that if too much were allowed to happen, the development of Usher’s Barn would not take place. However, if nothing was allowed to happen then there would be no funding to develop it. The Locum Solicitor advised the Committee that he considered that a Section 106 Agreement would be more appropriate than a condition. Development Control Committee (West) 13 31 January 2008 On the basis of the advice from the Locum Solicitor, the Head of Planning and Building Control requested delegated authority to approve this application subject to the completion of a Section 106 Agreement which would prevent conversion to commence until a contract was signed for Usher’s Barn and would prevent occupation of the dwellings until Usher’s Barn was complete. Councillor P Bevan Jones referred to the concerns in respect of the dwelling at the rear of the site and, whilst she supported the officer’s recommendation, she considered that no occupation of any part of the development should be allowed until Usher’s Barn was completed. It was proposed by Councillor P Bevan Jones, seconded by Councillor S C Mears and RESOLVED That the Head of Planning and Building Control be authorised to approve this application subject to the completion of a Section 106 Agreement: 1. To ensure that no works were commenced on the conversion of the public house to two dwellings until a contract for Usher’s Barn is let. 2. To prevent occupation of the detached dwelling at the rear until a contract for Usher’s Barn is let. 3. Public Speaker Mr Putman (supporting) The Senior Planning Officer reported that a letter of objection had been received from a resident of Waveney Close in respect of loss of amenity and additional noise and disturbance. Norfolk Landscape Archaeology had no objection subject to the imposition of a condition requiring an archaeological evaluation. The Conservation, Design and Landscape Manager had no objection in principle to the proposed design but was concerned about the position of the dormer windows. The Senior Planning Officer recommended approval of this application subject to the receipt of an amended plan in respect of the dormer windows and subject to the imposition of appropriate conditions. Councillor J D Savory, a local Member, stated that he had visited the site and spoken to one of the objectors. He stated that parking in the area was difficult, the footpath was frequently obstructed by vehicles and the site was in close proximity to a youth club and a public house. He was also concerned with regard to overlooking and loss of light.
