Two substitute Members attended the meeting as shown above. (86) MINUTES The Minutes of a meeting of the Committee held on 19 June 2008 were approved as a correct record and signed by the Chairman. (87) ITEMS OF URGENT BUSINESS The Chairman stated that there were no items of urgent business which he wished to bring before the Committee. (88) DECLARATIONS OF INTEREST Councillors H C Cordeaux and T H Moore declared interests, the details of which are given under the minute of the item concerned. (89) SHERINGHAM – Tree Preservation Order (Sheringham) 2008 Number 2, Inglewood, 10 Cremers Drift, Sheringham The Committee considered item 1 of the officers’ reports in respect of a Tree Preservation Order at the above site. Councillor Mrs H T Nelson informed the Committee that all Sheringham Members were in agreement that the tree should not be felled as it was a beautiful specimen and part of the well-treed landscape of Sheringham. Development Control Committee (West) 1 14 July 2008 It was proposed by Councillor B Cabbell Manners, seconded by Councillor J H PerryWarnes and RESOLVED unanimously That Tree Preservation Order (Sheringham) 2008 No. 2 at Inglewood, 10 Cremers Drift, Sheringham be confirmed as served. PLANNING APPLICATIONS Where appropriate the Planning Officers expanded on the planning applications; updated the meeting on outstanding consultations, letters/petitions received objecting to, or supporting the proposals; referred to any views of local Members and answered Members’ questions. Background papers, including correspondence, petitions, consultation documents, letters of objection and those in support of planning applications were available for inspection at the meeting. Having regard to the above information and the report of the Head of Planning and Building Control, the Committee reached the decisions as set out below. Applications approved include a standard time limit condition as condition number 1 unless otherwise stated. (90) BLAKENEY - 20080779 - Display of illuminated advertisement; 139-141 High Street for Blakeney British Legion The Committee considered item 2 of the officers’ reports. Public Speaker Mrs Temple-Crowe (supporting) The Senior Planning Officer recommended that a further condition be added to ensure that the sign was illuminated only during opening times of the premises. Councillor Mrs L M Brettle stated that she had reservations with regard to the visual impact of the sign but appreciated the need to advertise the premises. Councillor B Cabbell Manners supported the Parish Council’s views and considered that the sign was out of keeping. The Committee discussed alternative locations for the sign. The Development Control Manager explained that the sign had been negotiated with the Conservation and Design section. He suggested that there may be scope for siting the sign further back into the site but stated that the applicants required it to be visible. It was proposed by Councillor S C Mears, seconded by Councillor P W High That this application be approved subject to the imposition of appropriate conditions. Development Control Committee (West) 2 14 July 2008 As an amendment it was proposed by Councillor B Cabbell Manners and duly seconded That consideration of this application be deferred to negotiate the positioning and height of the sign. On being put to the vote, the amendment was declared carried by 8 votes to 2 and on being put as the substantive proposition it was RESOLVED accordingly. (91) BLAKENEY - 20080790 - Alterations, extension and re-modelling of roof and erection of conservatory, attached car port and front porch; Cones Back Lane for Mr J Gwynne The Committee considered item 3 of the officers’ reports. Public Speaker Mr Witcomb (supporting) Councillor Mrs L M Brettle expressed concern as to the impact of the balcony on the neighbour’s privacy. She supported the application provided that this issue was addressed. Councillor B Cabbell Manners considered that the proposal was an imaginative use of space. The Senior Planning Officer stated that the balcony looked towards the neighbour’s front garden, which was already visible from public views. The view would be partially obscured by the proposed conservatory. He stated that there was insufficient headroom to allow easy access to the balcony. It was proposed by Councillor B Cabbell Manners, seconded by Councillor Mrs A R Green and RESOLVED by 6 votes to 2 with 1 abstention That this application be approved subject to the imposition of appropriate conditions. In granting planning permission Members were not agreeing to the loss of any trees covered by the Tree Preservation Order. (92) CLEY-NEXT-THE-SEA - 20080709 - Erection of single-storey dwelling; The Store Old Post Office Lane High Street for Mr and Mrs S W Tart Councillor H C Cordeaux vacated the Chair during consideration of this application to allow him to speak from the floor as local Member. Councillor J A Wyatt (Vice-Chairman) in the Chair. The Committee considered item 4 of the officers’ reports. Public Speaker Professor Woodward (objecting) Development Control Committee (West) 3 14 July 2008 The Senior Planning Officer reported that the views of the Highway Authority were still awaited. He considered that it was unlikely that the Highway Authority would object given its views on previous applications on this site. He stated that the land was in two ownerships and a Section 106 Agreement would be necessary to tie the two parcels of land together, to secure an appropriate level of amenity space for the dwelling. The Senior Planning Officer requested delegated authority to approve this application subject to no new grounds of objection from the Highway Authority, completion of a Section 106 Agreement to tie the land together and the imposition of appropriate conditions. Councillor H C Cordeaux, the local Member, stated that he had spoken to the applicants and had received correspondence from them. He referred to the planning history of the site. He stated that the quality of the plans was poor and queried the position of the door as it was shown in different positions on the elevations and layout plans. He suggested the Members visit the site given the complex history. In the event of approval he requested that conditions be imposed to remove permitted development rights, require the use of flint on all publicly visible elevations and natural clay pantiles or reclaimed pantiles, erection of a flint wall on the southern boundary and the installation of conservation rooflights. Councillor B Cabbell Manners considered that a site visit was not necessary and that this application should be approved. Councillor J H Perry-Warnes stated that he was opposed to this application as it would result in a substandard dwelling. He considered that all the land in the applicant’s ownership should be included to allow a better dwelling to be built. Councillor T H Moore stated that the Inspector had dismissed the appeal against refusal of the previous application only on grounds of lack of amenity space. This had been addressed in the current application and he considered that there were no grounds for refusal. It was proposed by Councillor H C Cordeaux, seconded by Councillor Mrs A C Sweeney That consideration of this application be deferred to allow a site inspection by the Committee and that the local Member and Chairman of the Parish Council be invited to attend. On being put to the vote, the proposition was declared lost by 3 votes to 6. It was proposed by Councillor B Cabbell Manners, seconded by Councillor T H Moore and RESOLVED by 5 votes to 2 with 2 abstentions That the Head of Planning and Building Control be authorised to approve this application subject to no new grounds of objection from the Highway Authority, receipt of an accurate plan, the completion of a Section 106 Agreement to tie the land together and the imposition of appropriate conditions to include the removal of permitted development rights, materials to include flint on all publicly visible elevations and natural clay pantiles or reclaimed pantiles, erection of a flint wall on the southern boundary and the installation of conservation rooflights. Development Control Committee (West) 4 14 July 2008 (93) CORPUSTY - 20080635 - Erection of first floor rear extension and single-storey extension/conservatory; 5 Hills Close for Mr A Greenacre The Committee considered item 5 of the officers’ reports. Public Speaker Mrs Crossland (objecting) The Senior Planning Officer stated that condition 3 should be amended to prevent the insertion of additional windows in the north, south or west elevation of the first floor extension without planning permission. Councillor J H Perry-Warnes stated that he had been approached by the neighbour who was concerned about overlooking. He considered that it would be possible to design a more reasonable scheme. He did not support this application. It was proposed by Councillor P W High, seconded by Councillor B Cabbell Manners and RESOLVED unanimously That consideration of this application be deferred to allow a site inspection by the Committee and that the local Member and Chairman of the Parish Council be invited to attend. (94) EDGEFIELD - 20080579 - Erection of one two-storey dwelling and one singlestorey dwelling; Jordan’s Yard Norwich Road for Cockertons Councillor T H Moore declared a personal interest as he knew the applicant. The Committee considered item 6 of the officers’ reports. Public Speaker Mr Nicholson (supporting) The Senior Planning Officer reported that layout had been deleted from application. Approval was sought for access only. The comments of Conservation, Design and Landscape Manager (Landscape) were awaited. Councillor J H Perry-Warnes, the local Member, stated that he had been approached by the owner of Fourways. He considered that the hedges should be retained as far as possible or replaced with improved planting. He stated that it was important to ensure that the dwellings were not sited too close to Fourways to ensure there was no overlooking. Development Control Committee (West) 5 14 July 2008 Councillor B Cabbell Manners considered that there was adequate space for the development. He considered that the hedge along Pecks Lane could be removed and replaced with a better hedge. He supported the relocation of the holly hedge provided it could be done successfully. The Development Control Manager suggested that a condition be imposed to retain the holly hedge given the concerns as to whether or not it could be successfully relocated, and a letter sent to the applicant stating that the relocation of the hedge could be considered at a later date if it could be demonstrated that relocation was possible. He considered that it may be possible to design a scheme to allow the holly hedge to be retained in situ. It was proposed by Councillor B Cabbell Manners, seconded by Councillor J H PerryWarnes and RESOLVED unanimously That the Head of Planning and Building Control be authorised to approve this application subject to no objections from the Highway Authority and Conservation, Design and Landscape Manager (Landscape), no new grounds of objection following readvertisement of the amended plan and the imposition of appropriate conditions. (95) SHERINGHAM - 20080813 - Use of land for the display of sculptures; The Leas opposite Burlington Hotel The Esplanade for Sheringham Plus Councillor H C Cordeaux declared a personal interest as he was the Council’s representative on the Sheringham Plus Board. The Committee considered item 7 of the officers’ reports. Public Speaker Mrs Mold (supporting) The Senior Planning Officer reported that whilst there was a potential alternative site on the opposite side of the hedge, it would limit the views through the monolithic sculpture. Councillor Mrs H T Nelson, Member for Sheringham South, considered that this was a very good project and would enhance the end of the Sculpture Trail. She stated that the location of the sculptures was important and urged the Committee to support the application. It was proposed by Councillor P W High, seconded by Councillor S C Mears and RESOLVED unanimously That the Head of Planning and Building Control be authorised to approve this application subject to confirmation of option 2 for the monolithic sculpture and the imposition of appropriate conditions. Development Control Committee (West) 6 14 July 2008 (96) WELLS-NEXT-THE-SEA - 20080467 - Alterations to barn and removal of condition 2 of planning permission 20021709 to enable full residential occupancy; The Merchant House 48 High Street for Ms S Keynejad The Committee considered item 8 of the officers’ reports. Public Speaker Mr Angles (objecting) The Senior Planning Officer stated that a letter had been received from the owner of the dwelling adjacent to the garden area who was concerned with regard to over looking and the effect of the demolition on the stability of the boundary wall. A letter had been received from Hayes and Storr reiterating the concerns set out in the report. The Senior Planning Officer recommended refusal of this application subject to the amendment of the reason to refer to the building as a “listed curtilage building”. This was the same for both applications (see also 20080468 below). The Development Control Manager advised the Committee in respect of the relationship between the dwellings and stated that whilst officers were not recommending refusal on the overlooking issue, Members may wish to take this into account. The relationship between the existing and proposed dwellings also failed to meet the Basic Amenity Criteria. The Locum Solicitor advised the Committee that the impact on the structure of the adjoining building was a civil matter. It was proposed by Councillor Mrs L M Brettle, seconded by Councillor B Cabbell Manners and RESOLVED That this application be refused in accordance with the recommendation of the Head of Planning and Building Control and on grounds of noncompliance with the basic amenity criteria and overlooking of the neighbouring dwelling.
