Two substitute Members attended the meeting as shown above. (105) MINUTES The Minutes of a meeting of the Committee held on 14 July 2008 were approved as a correct record and signed by the Chairman. (106) ITEMS OF URGENT BUSINESS The Chairman stated that there were two items of urgent business which he wished to bring before the Committee, relating to: 1. 2. A planning application at Blakeney, reference 20080946. A planning application at Fakenham, reference 20080810. In both cases the reason for urgency was to expedite processing of the applications by undertaking a site inspection. (107) DECLARATIONS OF INTEREST No interests were declared. Development Control Committee (West) 1 14 August 2008 PLANNING APPLICATIONS Where appropriate the Planning Officers expanded on the planning applications; updated the meeting on outstanding consultations, letters/petitions received objecting to, or supporting the proposals; referred to any views of local Members and answered Members’ questions. Background papers, including correspondence, petitions, consultation documents, letters of objection and those in support of planning applications were available for inspection at the meeting. Having regard to the above information and the report of the Head of Planning and Building Control, the Committee reached the decisions as set out below. Applications approved include a standard time limit condition as condition number 1 unless otherwise stated. (108) BLAKENEY - 20071574 - Installation of underground LPG supply tanks; Blakeney Hotel The Quay for Blakeney Hotel The Committee considered item 1 of the officers’ reports. The Senior Planning Officer reported that in response to concerns regarding possible conflict with the LP Gas Association code of practice, the applicant’s agent had stated that the design of scheme had resulted from consultation with Calor Gas and the contractors would be required to supply a method statement in respect of safety. The Senior Planning Officer requested delegated authority to approve this application subject to no further objections from the Environmental Protection Team in respect of the comments from the applicant’s agent and subject to imposition of appropriate conditions. It was proposed by Councillor Mrs L M Brettle, seconded by Councillor N P Ripley and RESOLVED That the Head of Planning and Building Control be authorised to approve this application subject to no further objections from the Environmental Protection Team in respect of the comments from the applicant’s agent and subject to imposition of appropriate conditions. (109) BLAKENEY - 20080823 - Raising of roof to provide first floor accommodation and erection of one-and-a-half-storey extensions; Villeroche Langham Road for Mr and Mrs J Scargill The Committee considered item 2 of the officers’ reports. Public Speaker Mr Scargill (supporting) The Senior Planning Officer reported that the Landscape Officer had no objection subject to replacement of the boundary hedgerow. Development Control Committee (West) 2 14 August 2008 The Senior Planning Officer recommended approval as set out in the report subject to a condition in respect of the roofing materials. Councillor Mrs L M Brettle, the local Member, considered that the building would be too high and reiterated the concerns of the Parish Council. She considered that a single-storey extension would be more acceptable. Councillor N P Ripley considered that the proposed extensions would enhance the existing building. It was proposed by Councillor N P Ripley, seconded by Councillor P W High and RESOLVED by 8 votes to 2 That this application be approved subject to conditions to include planting on the north-east boundary and roofing materials. (110) CORPUSTY - 20080635 - Erection of first floor rear extension and single-storey extension/conservatory; 5 Hills Close for Mr A Greenacre The Committee considered item 3 of the officers’ reports. The Senior Planning Officer displayed a model indicating the shading impact of the proposal on the neighbour’s garden at 4 Hills Close and advised that there would not be a significant detrimental impact compared with the existing situation. Councillor J H Perry-Warnes, the local Member, referred to the neighbour’s concerns regarding overshadowing and stated that the neighbour was already overshadowed by large trees in the applicant’s garden which were protected. He considered that overlooking would not be a problem as obscured glass would be used in the windows facing the neighbour. It was proposed by Councillor J H Perry-Warnes, seconded by Councillor J A Wyatt and RESOLVED unanimously That this application be approved in accordance with recommendation of the Head of Planning and Building Control. the (111) HOLT - 20080943 - Erection of detached three storey dwelling; land rear of 58 Grove Lane for Mr and Mrs D Foreman The Committee considered item 4 of the officers’ reports. Councillor P W High, the local Member, referred to the neighbour’s concerns regarding overlooking. He considered that the main issue related to access onto Grove Lane. Councillor M J M Baker, a local Member, stated that he had not been lobbied on this matter by anyone. He stated that the applicants and their family were known to him. He stated that Mr Foreman was a competent builder who was known for his high quality individual buildings which gave character to the area. Development Control Committee (West) 3 14 August 2008 It was proposed by Councillor P W High, seconded by Councillor J H Perry-Warnes and RESOLVED by 9 votes to 0 with 1 abstention That consideration of this application be deferred to allow a site inspection by the Committee and that the local Members, Chairman of the Town Council and a representative of the Highway Authority be invited to attend. (112) HOLT - 20081006 - Erection of detached single-storey dwelling; land adjacent 21 Pearsons Close for Mr P Doy The Committee considered item 5 of the officers’ reports. The Senior Planning Officer reported that the Building Control Manager had requested a condition in respect of a drainage survey. The applicant had indicated that he would be willing to undertake the necessary drainage survey. The comments of the Highway Authority were still awaited. Councillor M J M Baker, a local Member, stated that there were issues regarding drainage and access. He requested a site inspection. He read to the Committee a letter he had received from an elderly resident in respect of traffic concerns. Councillor P W High, a local Member, stated that he had been lobbied by residents of Grove Lane. It was proposed by Councillor P W High, seconded by Councillor Mrs P Bevan Jones and RESOLVED That consideration of this application be deferred to allow a site inspection by the Committee and that the local Members, Chairman of the Town Council and a representative of the Highway Authority be invited to attend. (113) SHERINGHAM - 20080566 - Continued use of ground floor as two separate residential units; 17 Waterbank Road for Mr C Simpson The Committee considered item 6 of the officers’ reports. Development Control Committee (West) 4 14 August 2008 (114) SHERINGHAM - 20080836 - Demolition of bungalow and erection of three, oneand-a-half-storey dwellings; 18 Hadley Road for Mr K Welch The Committee considered item 7 of the officers’ reports. Public Speaker Mr Ivins (supporting) The Senior Planning Officer reported that the applicant had requested that the scheme be approved as submitted. The Senior Planning Officer read to the Committee the comments of Councillor Mrs J P Moss, a local Member, who had requested a site inspection. Councillor B J Hannah, Member for Sheringham North Ward, stated that he disagreed with the Highway Authority. He stated that many people used Common Lane as an entrance and he considered that The Rise was more than adequate. He stated that the visibility problem was caused by overhanging trees which the Highway Authority had a right to require to be cut back. Hadley Road was a wide road and he considered that the lack of a pedestrian footway was not a problem. He supported a site inspection. Councillor Mrs H T Nelson, a local Member, supported Councillor Hannah’s views. It was proposed by Councillor Mrs P Bevan Jones, seconded by Councillor S C Mears and RESOLVED That consideration of this application be deferred to allow a site inspection by the Committee and that the local Members, Town Mayor and a representative of the Highway Authority be invited to attend. (115) SHERINGHAM - 20080937 - Demolition of public house and erection of three two-storey terraced dwellings; Sherry N Ham 18 Beech Avenue for Homan Property Investments The Committee considered item 8 of the officers’ reports. The Senior Planning Officer reported that an amended plan had been received in respect of the eastern property. He requested delegated authority to approve this application subject to no new grounds of objection following readvertisement and reconsultation on the amended plan, and subject to the imposition of appropriate conditions. Councillor Mrs H T Nelson, a local Member, stated that she was very unhappy about this application but there were no planning grounds to refuse it. She stated that the Sherry N Ham was some distance from other facilities and it was a steep walk into the town for Sunway Park residents, many of whom were elderly. The Development Control Manager stated that the previous application had been refused on overdevelopment and design grounds. This application had been submitted on the basis of that decision and Officers considered it would be unreasonable to introduce further reasons based on the Local Development Framework (LDF) Core Strategy policies which were awaiting formal adoption by the Council. Development Control Committee (West) 5 14 August 2008 Councillor Mrs P Bevan Jones stated that she was Elderly Persons’ Champion. The needs of local people had to be considered and she considered that more time was needed to consider the LDF to ensure there was no other way to address the issues. She proposed a site inspection which was not seconded. The Locum Solicitor stated that the LDF Core Strategy was being phased in and it would be difficult to bring in the Core Strategy as a means to refuse this application. It was proposed by Councillor P W High, seconded by Councillor N P Ripley and RESOLVED by 7 votes to 3 That the Head of Planning and Building Control be authorised to approve this application subject to no new grounds of objection following readvertisement and reconsultation on the amended plan, and subject to the imposition of appropriate conditions. (116) SHERINGHAM - 20081020 - Erection of replacement Salvation Army hall; Salvation Army Hall Cremer Street for The Salvation Army The Committee considered item 9 of the officers’ reports. Public Speakers Mrs Tricker (objecting) Mr Maddern (supporting) The Senior Planning Officer reported that the Conservation, Design and Landscape Manager had raised concerns regarding the scale and massing and impact on the street scene in terms of the view from Co-operative Street. The Community Safety Manager had commented that there were problems with criminal damage and antisocial behaviour in the area and had made recommendations with regard to crime prevention measures. The agent had indicated that his client was willing to negotiate in respect of design. The Senior Planning Officer recommended deferral of this application to allow negotiations on design and for the Committee to undertake a site inspection. The Senior Planning Officer reported that Councillor Mrs H T Nelson considered that the building was worthy of listing. Norfolk County Council had been consulted on this matter. Councillor B J Hannah, a local Member, referred to concerns with regard to car parking and the loss of the existing building. He considered that these issues were outweighed by the need to keep the facility in Sheringham. He supported this application. Councillor Mrs H T Nelson, Member for Sheringham South, stated that she had great admiration for the work of the Salvation Army and appreciated the need for improved facilities. However, concerns had been raised in respect of Section 17 and she requested that the comments of the Community Safety Manager be circulated and the Architectural Liaison Officer be invited to speak at the next meeting. She also requested consultation with the CPRE. She referred to the concerns raised by neighbours. Development Control Committee (West) 6 14 August 2008 The Development Control Manager stated that the Community Safety Manager had requested better gates and means of enclosure. The CPRE was not a statutory consultee. It was proposed by Councillor Mrs P Bevan Jones, seconded by Councillor S C Mears RESOLVED unanimously That consideration of this application be deferred to allow a site inspection by the Committee and that the local Members and Town Mayor be invited to attend. ITEMS OF URGENT BUSINESS The Chairman stated that he had determined that the following items be considered as matters of urgency pursuant to the powers vested in him by Section 100B(4)(b) of the Local Government Act 1972. (123) BLAKENEY - 20080946 - Erection of two-storey dwelling; land at The Habit, Back Lane for Mr R Daley The Senior Planning Officer informed the Committee that this application was locally controversial and recommended that the Committee visit the site prior to a report being submitted to the next meeting. RESOLVED That consideration of this application be deferred to allow a site inspection by the Committee and that the local Member and Chairman of the Parish Council be invited to attend. Development Control Committee (West) 7 14 August 2008 (124) FAKENHAM - 20080810 - Construction of short-stay facilities for gypsies and travellers; land south of A148, Holt Road for North Norfolk District Council The Senior Planning Officer reported that whilst this application was in its early stages it was likely to be controversial. He recommended that the Committee visit the site prior to a report being submitted to a future meeting. RESOLVED That consideration of this application be deferred to allow a site inspection by the Committee and that the local Members and Town Mayor be invited to attend. The meeting closed at 11.35 am.
