In reviewing the Observations of the LMG in the above-captioned matter, our clients
have realized that one point was omitted by error. Therefore, with the permission of the
Régie, please consider the following paragraph to be part of the Observations of the LMG at
p. 5, just above the actual last paragraph on the page:
More generally, possible later contracts cannot undo the
damage caused by the failure of the substantive outcome of call
for tenders A/O 2005-03 to respect the policy choice of the
provincial Cabinet and the requirements of the Constitution.
Notably, approval of the contracts now before the Regie would
mean that later wind projects with Aboriginal participation in the
Gaspé risk being refused or becoming non-competitive because
of limitations on the available transmission capacity on HydroQuébec’s system.
