Pape that officials of a governmental body may be sued under Section 1983 of Title 42 of the United States Code. In this landmark case, police searched the wrong house without a search warrant. Police found narcotics, however the search was deemed improper and the individuals were released. A suit was filed in federal court pursuant to Section 1983 alleging that the City of Chicago and the individual officers involved violated the rights of the arrestees against an unreasonable search and seizure under the Fourth Amendment. The United States Supreme Court reversed the lawsuit, which the lower courts dismissed. The higher court stated the phrase “under color of” included acts of an official acting under color of state authority. This two-day seminar will address the administrative civil liability under Section 1983.
