Memorandum of Understanding
Between the Title III Consortium Lead and Member Counties
Introduction
Under the Title III program, if a county does not have a sufficient number of English language learners
(ELLs) enrolled to qualify for a minimum subgrant of $10,000, the county can only receive funding by
participating jointly in consortia with other districts.
Purpose
A consortium of counties receiving a Title III subgrant must meet the same requirements as counties
receiving subgrants individually. This Memorandum of Understanding (MOU) outlines how the
consortium will meet Title III requirements and details the roles and responsibilities of the member
districts and Lead of the consortium.

In its role as the lead LEA, (Lead LEA County), will support programs and services as indicated below:
Fiscal Responsibilities









Claim up to 2% Administrative Costs.
Review and pay invoices for services provided by consortium members, if applicable.
Continue serve as the Lead for the Consortium for the duration of the 27 months grant period
and/or until all the funds are expended.
Maintain separate financial records related to the grant.
Keep all financial records for at least three years following receipt of the grant.
Make financial records available to the West Virginia Department of Education and consortium
members upon request.
Disburse funds in accordance with the purpose and regulation of Title III.
Maintain control of funds for the consortium.
Maintain control of consortium inventory.
Program Duties and Responsibilities






Ensure that the Title III director for the consortium lead will serve as the liaison or contact for
the consortium.
Ensure with the assistance of the WVDE that counties in its consortium fulfill their requirements
as listed below.
Assist each county in its consortium to meet AMAOs.
Complete ESEA consolidated application Title III section (developed through consensus with
consortium members).
Facilitate ongoing professional development regarding effective ELL student instructional
practices as specified in the Consolidated ESEA Application.
Promote parental and community participation in programs for ELLs as specified in the
Consolidated ESEA Application.
Program/Services Consortium Member
In its role as a member of an assigned consortium, each member county will support programs and
services as indicated below:
Fiscal Responsibilities


Submit invoices and supporting documentation for services conducted as part of the consortium
agreement.
Prior to incurring any costs members will obtain approval from the lead county.
Program Duties and Responsibilities













Ensure that the local Title III director performs duties associated within WVBE Policy 2417.
Maintain a Home Language Survey and language screening test on file for each ELL.
Notify parents of their child’s eligibility for ESL services.
Ensure there is at least one ESL endorsed teacher in the county.
Develop a plan for each ELL.
Provide appropriate ELL services.
Annually assess the language proficiency of all ELLs.
Monitor process for exited ELLs.
Maintain accurate records of ELLs within the district and verify annually via WVEIS.
Notify parents of missed Annual Measurable Achievement Objectives (AMAOs) for the district.
Develop and implement an improvement plan if AMAO targets are not met for two consecutive
years. The improvement plan must address factors that prevented the AMAO targets from being
met.
Conduct local parental and community engagement activities.
Complete Consolidated ESEA Application Title III STATE ESL section.
Amendment or Termination of MOU
This MOU will become effective from the beginning of the State fiscal year in which it is signed and will
remain in effect until the end of the fiscal year (June 30) in which it is signed. A new MOU will be signed
each year for which counties choose to receive funding and participate in Title III activities and for which
the designated Lead chooses to accept its role and responsibilities for the consortium.
