WEST VIRGINIA BOARD OF EDUCATION

September 22, 2014

I. Call to Order

Following the welcome, Pledge of Allegiance and introductions, President Gayle C.

Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at

10:05 a.m. on September 22, 2014, in Room 203 at Emmanuel Baptist Church, 1401 Washington

Street, West, Charleston, West Virginia.

The following members were present: President Manchin, Vice President Michael I.

Green, Secretary Tina H. Combs, Thomas W. Campbell, Robert W. Dunlevy, Lloyd G.

Jackson II, L. Wade Linger Jr., and William M. White, and ex officios Michael J. Martirano,

State Superintendent of Schools, and James L. Skidmore, Chancellor, West Virginia Council for

Community and Technical College Education. Member absent was ex officio Paul L. Hill,

Chancellor, West Virginia Higher Education Policy Commission.

II. Delegations

Michelle Norweck (distributed information), Director, Fair Shake Network, addressed the

Board regarding inclusive education. (Copy appended to Official Minutes, Attachment A.)

III. Approval of Agenda

President Manchin called for a motion to approve the agenda. Mr. Dunlevy moved that the agenda be approved. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously.

IV. Introduction of the State Superintendent's Entry Plan including

Communication, Goals, Priorities, and Proposed Actions

Superintendent Martirano introduced his entry plan including communication, goals, priorities and proposed actions. Discussion ensued regarding communication norms and protocols; views expressed during discussion will assist in the development of vision and strategic plans.

V. Break

President Manchin called for a break for lunch at 12:06 p.m.

VI. Call to Order

President Manchin called the meeting back to order at 1:05 p.m.

VII. Introduction of the State Superintendent's Entry Plan including

Communication, Goals, Priorities, and Proposed Actions (Continued)

Discussion resumed regarding Superintendent Martirano's entry plan including communication, goals, priorities and proposed actions. Mr. Dunlevy and Chancellor Skidmore departed the meeting prior to the executive session.

VIII. WVBE Personnel Matters inclusive of the Appointment of an

Interim Director for the Office of Education Performance Audits,

Retirement of the Executive Director of RESA 8, and

Possible Appointment of an Interim Executive Director for RESA 8

Executive Session

Superintendent Martirano requested an executive session for personnel matters.

President Manchin called for a motion to enter into executive session. Mr. Linger moved, as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or W. Va. Code §6-9A-4

[matters involving attorney-client privilege per Peters vs. County Commission , 205 W. Va. 481

(1999]) that the Board enter into executive session. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 2:16 p.m. Mr. Jackson departed the meeting prior to the Board's return from executive session.

IX. Return from Executive Session

Upon motion by Mr. Campbell seconded by Mr. Linger and unanimously carried, the

Board returned from Executive session at 3:51 p.m. President Manchin announced that no action was taken or decisions were made during executive session.

President Manchin called for a motion to contract with Dr. Gus Penix as Interim Director of the Office of Education Performance Audits until the end of October.

Mr. Linger moved that Dr. Gus Penix be appointed as Interim Director of the Office of

Education Performance Audits, at the current salary, until October 31, 2014. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously.

President Manchin called for a motion to acknowledge receipt of the notification of retirement of the Executive Director of RESA 8 effective at the close of business on

September 30, 2014.

Mr. Linger moved that the Board acknowledge receipt of the notification of retirement of the Executive Director of RESA 8 effective at the close of business on September 30, 2014.

Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously.

President Manchin called for a motion to appoint an Interim Executive Director for

RESA 8.

Mr. Linger moved that Frank Aliveto, Sr., be appointed as consultant to RESA 8 effective immediately, and as Interim Executive Director of RESA 8 effective at the close of business on

September 30, 2014, at the uniform salary of RESA Directors. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously.

X. Future Meetings

The next regular meeting of the WVBE will be held October 8, 2014, in Charleston, West

Virginia. The meeting will continue on October 9, 2014, if the agenda is not completed on

October 8, 2014. It was the consensus of the Board that the November meeting be moved to

November 12-13, 2014, and that the meeting take place in Mingo County.

XI. Adjournment

President Manchin declared the meeting adjourned at 4:03 p.m.
