MINUTES WEST VIRGINIA BOARD OF EDUCATION Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia July 8, 2015 I. Call to Order Following the welcome, Pledge of Allegiance and introductions, President Gayle C. Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:00 a.m. on July 8, 2015, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Manchin, Vice President Michael I. Green, Secretary Tine H. Combs, Thomas W. Campbell (via telephone), Lloyd G. Jackson II, L. Wade Linger Jr., William M. White, and James S. Wilson, and ex officios Michael J. Martirano, State Superintendent of Schools, and Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission. Members absent were: Beverly E. Kingery and ex officio Sarah Armstrong Tucker, Interim Chancellor, West Virginia Council for Community and Technical College Education. II. Approval of Agenda President Manchin called for a motion to approve the agenda. Mr. Green moved that the agenda be approved. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. III. Recognitions The Board recognized: 1) Ms. Janet Allio, Kanawha County (school nurse at Mary C. Snow/Westside and Piedmont Elementary Schools), recipient of the Highmark Foundation's Excellence in School Nursing Award; 2) Dr. K. Lynn Boyer, former Superintendent of the West Virginia Schools for the Deaf and the Blind, who was recognized by Governor Earl Ray Tomblin as Distinguished Mountaineer; Mr. Larry Malone, Governor's Office, presented the award; and, 3) Mr. Garland Christian, custodian at Ceredo-Kenova Middle School, Wayne County, recipient of the 2015 WVBE School Service Personnel Employee of the Year award. IV. Delegations Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, announced that delegations would be provided two minutes. Ms. Courtney Vargo, Ms. Amanda Skaggs, Mr. Jason Crouch, Ms. Tonya Hall, Ms. Danielle Crouch, Ms. Autumn Crouch, Mr. Braxton Hall, Ms. Breya Blake, Ms. Teri Harlan, Ms. Sandra Harkin, Mr. Randall Patterson, Mr. Ethan Thomas, Ms. Carolyn Arritt (distributed information), Mr. Joe Rozell, Mr. Kobe Rozell, and Mr. Lawrence Richmond, citizens of Fayette County, regarding Fayette County Schools; Mr. Trent Sherman, principal of Martinsburg High School, Berkeley County, regarding out of season coaching; and, Mr. Kenneth Hale, NAACP/Tuesday Morning Group, Kanawha County, regarding comprehensive education. Special Community Development School Pilot Program Superintendent Martirano, assisted by Ms. Michele Blatt (distributed information), Chief Officer, Division of School Effectiveness, Dr. Ronald E. Duerring, Superintendent, and Ms. Kareena Garner, Principal, Kanawha County Schools, Reverend Matthew J. Watts, Grace Bible Church, provided an update and overview of the Special Community Development School Pilot Program project. (Copy appended to Official Minutes, Attachment U.) President Manchin noted, as posted on the agenda, that the Board would now take up the item scheduled for 11:30 a.m. VI. Office of Education Performance Audits (OEPA) Consideration of Gilmer County School District's Intervention Status Ms. O' Brien requested that Board members move into executive session to take up item IX. B. Consideration of Gilmer County School District's Intervention Status. Mr. Green moved that the Board enter into executive session as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)]. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. President Manchin stated that the Board would take lunch during the executive session and would return at 1:00 p.m. The Board moved into executive session at 11:42 a.m. Chancellor Hill departed the meeting. VII. Return from Executive Session President Manchin called for a motion to return from executive session. Mr. Green moved that the Board return from executive session. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 1:02 p.m. President Manchin called upon Ms. O'Brien for a recommendation regarding the Gilmer County School District's intervention status. Ms. O'Brien recommended that the Board: 1) amend Gilmer County's Memorandum of Understanding to resume control of Gilmer County's finance; 2) require Superintendent Devono to provide a status report in six months, and 3) delay OEPA's scheduled review of Gilmer County until after Superintendent Devono's six month report. President Manchin called for a motion regarding Ms. O'Brien's recommendations. Dr. Wilson moved that the recommendations be adopted. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. VIII. Consent Agenda President Manchin requested a motion to approve the Consent Agenda. Mr. Green moved that the Consent Agenda be approved. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. Approved a dual credit policy for Doddridge County (https://sites.google.com/a/wvde.k12.wv.us/county-dual-and-embedded-credit-policies/) Received a report on waiver of Policy 2510 regarding high school mathematics sequences (https://sites.google.com/a/wvde.k12.wv.us/county-high-school-math-sequence/) Approved Office of Institutional Education Programs' school calendars and granted authority to approve minor amendments to the school calendars, as needed, for good cause, to the Chief Officer, Division of Career Technical Education (Attachment E) Approved Step 7 Plans (Attachment F) Received a report of 2014-2015 waivers of WVBE policies and regulations, Superintendent's Interpretations and state statutes and legislative rules (Attachment G) Received a report diplomas awarded in compliance with Policy 4355, High School Diplomas for Veterans (Attachment H) Approved the EPPRB's recommendation of the following programs and agreements: Revised Driver's Education Program (Shepherd University); Revised Master's of Educational Leadership and revised Educational Leadership Certificate and new Biology Education (Salem International University); New Earth and Space Science Education (Ohio Valley University); New Multicategorical Undergraduate (Fairmont State University); Revised Wellness Education (West Virginia State University); Additional County Teacher-in-Residence Agreements - Putnam and Mason (Marshall University) (Attachment I). Consideration of Executing New Agreement to Provide Education Services to Board of Child Care at Falling Waters Mr. Jacob Green (distributed information), Special Assistant to Chief Officer, WVDE Office of Institutional Education Programs, and Ms. Laurie Anne Spagnola, President, Board of -4Child Care, presented progress to date regarding the possible execution of a new agreement between the WVBE and the Board of Child Care at Falling Waters to provide education services. Following discussion, Mr. Green moved that the Board enter into an Agreement with Board of Child Care to establish and provide educational services as designed by the Office of Institutional Education Programs and the Board of Child Care and to authorize the Board President to sign an agreement authorizing such program. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment V.) X. 2015-2016 Statewide Professional Development Goals President Manchin (distributed amended goals), assisted by Mr. Clayton Burch, Chief Officer, and Dr. Raymond Lowther, Coordinator, Division of Teaching and Learning, presented 2015-2016 statewide professional development goals for the Board's consideration. W. Va. Code §18-2I-3 requires the WVBE to establish goals for professional development in the public schools of the state. Upon adoption, these goals will be communicated to professional development providers who shall submit their offerings for inclusion in the Master Plan for Statewide Professional Development. Mr. Jackson moved that the 2015-2016 statewide professional development goals, as distributed during the meeting, be approved. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment W.) XI. Policy 2520.15, Early Learning Standards Framework Content Standards and Learning Criteria for West Virginia Pre-Kindergarten Mr. Burch presented Policy 2520.15 for the Board's consideration. WVBE Policy 2520.15 was revised last in 2010, and since that time the establishment of West Virginia Universal Pre-K and Kindergarten as a programmatic unit (Early Learning Readiness Grades) per WVBE Policy 2510 has necessitated a stronger alignment between the pre-k and k grade levels across all content areas. Since the previous revision, federal Head Start child outcomes were also revised. This revision includes this consideration as well. The revised policy provides a stronger alignment to the language and format of kindergarten content standards and objectives across content areas, resulting in continuity of services for all children who transition from pre-k to kindergarten. Dr. White moved that Policy 2520.15 be approved. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes Attachment K). XII. Policy 5100, Approval of Educational Personnel Preparation Programs Ms. Blatt presented Policy 5100 for the Board's consideration. Policy 5100 has been revised to propose newly available Praxis assessments and changes to existing WVBE-required assessments. Proposed revisions also clarify language regarding clinical experience; add a general integrated mathematics endorsement; and clarify the alternative educator preparation program review process based upon new legislative changes in W. Va. Code §18A-3-1, guided -5by WVBE Policy 5901. Policy 5100 establishes collaborative program review processes to ensure the educator programs are designed to produce educators with the knowledge, skills and dispositions necessary to be effective in the P-12 classroom. Dr. White moved that the proposed revisions to Policy 5100 be placed on public comment for 30 days. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes Attachment L). XIII. Policy 5202, Minimum Requirements for the Licensure of Professional/Paraprofessional Personnel and Advanced Salary Classification Ms. Blatt presented Policy 5202 for the Board's consideration. Policy 5202 establishes the requirements regarding the licensure of educators to work in the public schools of West Virginia. As changes occur in education, certification, and licensure, Policy 5202 must be revised to meet the needs of the 21st century education system. The revisions to Policy 5202 assure appropriate certification of educators for licensure to work in the public schools of West Virginia in order to meet the needs of all students in the 21st century as part of the cycle of continuous improvement. Mr. Linger moved that the proposed revisions to Policy 5202 be placed on public comment for 30 days. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes Attachment M). XIV. Policy 5901, Alternative Programs for the Education of Teacher Ms. Blatt presented Policy 5202 for the Board's consideration. Policy 5901 establishes the requirements and guidelines for developing alternative certification programs for the education of teachers. The policy creates alternative means for a qualified person to earn a professional teaching certificate by authorizing a school or school district to offer a rigorous program for teacher certification in partnership with a regionally accredited IHE, an entity affiliated with a regionally accredited IHE, the WVDE or a RESA. Policy 5901 is being repealed and replaced with an update version more conducive to the current needs of West Virginia schools and school districts. The revised Policy 5901 will impact public education by filing the need for certified teachers in West Virginia classrooms. Policy 5901 provides a means for skilled individuals to earn professional teacher licensure while teaching in a classroom in an area of critical need and shortage. Students will benefit in having a teacher who is qualified and certified to teach the subject matter being taught. Mr. Green moved that Policy 5901 be placed on public comment for 30 days. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes Attachment Mc). XV. Policy 5310, Performance Evaluation of School Personnel Ms. Blatt presented Policy 5310 for the Board's consideration. The educator evaluation system promotes professional growth and development that advances student learning in West Virginia schools; defines and promotes high standards for performance of professional personnel; provides data that indicate the effectiveness of professional personnel; provides data for educator preparation programs to assist in identifying areas of need and in guiding program -6improvement; and, establishes county and school evaluation data that serve as a basis for professional development that specifically targets the area(s) identified for professional growth. Language has been revised to support the change in the use of student growth data; beginning in 2015-2016, 15 percent of the evaluation for RLA and Math teachers shall be based upon student growth determined by the results of the state summative assessment. The educator evaluation system promotes professional growth and development that advances student learning in West Virginia schools. By utilizing the West Virginia Educator Evaluation System, West Virginia students will have greater access to highly effective teachers and leaders. Dr. Wilson moved that the proposed revisions to Policy 5310 be placed on public comment for 30 days. Office of Institutional Education Programs - Initiation of Education Services at Pressley Ridge Laurel Park, Clarksburg, West Virginia Mr. Jacob Green presented the initiation of education services at Pressley Ridge Laurel Park for the Board's consideration. Pressley Ridge Laurel Park is a 40 bed facility serving Level II male and female youth in West Virginia. The Office of Institutional Education Programs (OIEP) operates an on-grounds school at two other Pressley Ridge facilities in West Virginia, both of which are 40 beds or more. The addition of this school would allow for a WVBE/WVDE on-grounds school at all Pressley Ridge facilities in West Virginia with 40 beds or more and allow the OIEP to better serve these students by applying our methods and processes to serve institutionalized youth in West Virginia. Approval is requested to hire a school principal, school counselor, school secretary, four classroom teachers, and a transition specialist to serve the students in this facility. Positions for this project are as a result of reductions in force at the Salem Correctional Center and Kenneth "Honey" Rubenstein Center. No additional positions have been created for this project; the school will operate within the existing OIEP budget. Mr. Green moved that the initiation of educational services beginning July 15, 2015, at Pressley Ridge Laurel Park in Clarksburg, West Virginia, be approved. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. Dr. White moved that the school calendar for Pressley Ridge Laurel Park be approved, and that authority to approve minor amendments to the school calendar, as needed, for good cause, be granted to the Chief Officer, Division of Career Technical Education. Capacity Building for Priority Schools, Intervention Counties, and West Virginia Schools for the Deaf and the Blind The update for Wayne County Schools is found in the attachment. (Copy appended to Official Minutes, Attachment P.) President Manchin announced to the audience that the meeting would recess following the conclusion of the Superintendent Reports and would resume on July 9 in the same location. -7XVIII. Superintendent Reports 2014-2015 Personnel Data Report. Ms. Blatt (distributed information) presented the Educational Personnel Data Report (http://wvde.state.wv.us/forms/personnel-report/reports/public/), published annually and presents statistics about the educator workforce in West Virginia, for the Board's information. Included in the 2014-2015 report also is data about recent college graduates who completed educator preparation programs in West Virginia. The purpose of the Educational Personnel Data Report is to provide descriptive data about West Virginia's professional educators and educator preparation programs. Data will be utilized to inform the development of educational policies and programs, as well as to respond to personnel demands at the local level in order to meet the needs of students. West Virginia Universal Pre-K Update. Mr. Burch (distributed information) presented an update regarding West Virginia universal pre-k for the Board's information. The annual report for the West Virginia Universal Pre-K Program will be shared with the Board. Three-year trend data, as well as the most recent national quality rankings, will be provided in this report. High-quality Pre-K services as part of a comprehensive approach to early learning help ensure children are well-equipped with strong dispositions to learning for kindergarten and beyond. General Summative Assessment Update. Mr. Burch, assisted by Dr. Vaughn Rhudy, (distributed information), Executive Director, WVDE Office of Assessment and Research, presented an update regarding the general summative assessment. Standards Evaluation Online Demonstration. Superintendent Martirano (distributed information) provided information regarding the standards review. (Copies appended to Official Minutes, Attachment X.) XIX. Recess President Manchin recessed the meeting at 2:50 p.m. and announced that the meeting would reconvene on July 9 at 9:00 a.m. in the same location. XX. Reconvene President Manchin reconvened the meeting of July 8, 2015, at 9:01 a.m. on July 9, 2015, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. Amundson, Executive Director of the National Association of State Boards of Education (NASBE) who announced that President Manchin has been named NASBE's 2015 Distinguished Service Award winner. -8XXI. West Virginia Secondary School Activities Commission (WVSSAC) Series 2, 3 and 4 President Manchin called upon Ms. Peduto to read a letter (copy appended to minutes) on the behalf of Ms. Kingery. Mr. Gary Ray, Executive Director of the WVSSAC, presented Series 2, 3, and 4 for the Board's consideration. Seven proposals were submitted to the WVBE by the WVSSAC for consideration: 1) to allow schools to maintain a freshman team, but play a junior varsity football team without losing eligibility; 2) to limit participation to a bona fide move of at least one county away to help limit the number of transfers based solely upon athletic participation; 3) to clarify current rule; 4) to enhance the development of athletes within the State of West Virginia by allowing certified high school and middle school coaches work with them year round; 5) to align rule 127-3-9.6.c with current testing procedure; 6) to allow schools to maintain a freshman team, but play a junior varsity football team without losing eligibility; and, 7) to clarify current rules and bring rules in line with a West Virginia Supreme Court decision. Mr. Ray, per the direction of the WVSSAC Board of Control, recommended that the proposed amendment of that Series 2, 3, and 4 be approved. Discussion ensued regarding the proposed amendments. Following discussion, Mr. Green moved that proposals 1, 2, 3, 5, 6, and 7 be approved. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. Update - WVBE Actions for Improved Outcomes Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, with the assistance of Board members provided an update regarding actions taken by the Board to improve educational outcomes. (Copies appended to Official Minutes, Attachment Y.) WVBE Finance Committee. Mr. Campbell provided an update on behalf of the Finance Committee. XXIII. Chancellor Report Interim Chancellor Tucker provided information regarding the Student Success Summit scheduled for July 29-30. XXIV. WVBE Coordinator of Board Agencies Report/ WVBE Regional Education Service Agency (RESA) Liaison Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided an update regarding his work in conjunction with WVBE agencies inclusive of the West Virginia Schools for the Deaf and the Blind (assisted by Mr. Mark Gandolfi, Chief Financial Officer/Administrator, West Virginia Schools for the Deaf and the Blind), Office of Education Performance Audits (assisted by Ms. O'Brien), WVDE Office of Institutional Education Programs (assisted by Mr. Jacob Green), and RESAs. Ms. Kathy Hypes, Executive Director, RESA 7, provided a report on behalf of the RESAs. -9- XXV. WVBE Personnel Matters inclusive of the Personnel Attachment and Review and Consideration of Applications for the Position of Superintendent of the West Virginia Schools for the Deaf and the Blind President Manchin called for a motion to enter into executive session for personnel matters. Mr. Green moved, as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)], that the Board enter into executive session. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 10:20 a.m. Superintendent Martirano departed the meeting at 11:20 a.m. Mr. Campbell departed the meeting at the close of the executive session. XXVI. Return from Executive Session President Manchin called for a motion to return from executive session. Dr. White moved that the Board return from executive session. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 11:38 a.m. President Manchin announced that no decisions were made or action taken during executive session. President Manchin called for a motion to approve the Board's personnel matters found in the attachment inclusive of the addendum presented by Mr. Jacob Green. Mr. Green moved that the Board's personnel matters, inclusive of the addendum, be approved. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. Items for Future Consideration Mr. Linger requested an item be considered for placement on a future agenda regarding legal coverage/protection for teachers. Dr. White requested the Board consider streaming meetings. Ms. Kingery joined the meeting. (Copy appended to Official Minutes, Attachment R.) XXVIII. Election of Officers President Manchin called for nominations. Mr. Linger nominated Mr. Green to the office of President, Mr. Jackson to the office of Vice President, and Mrs. Combs to the office of Secretary. Ms. Kingery seconded the nominations. President Manchin called for additional nominations. Dr. White stated that he could not support the slate of officers. With no other nominations offered, President Manchin called for a motion to close nominations. Dr. Wilson moved, and Ms. Kingery seconded, that the nominations be closed. Upon the call for the question the motion was carried with seven members voting yes and one member voting no. The officers were elected by acclamation. Mrs. Manchin, thanked her husband (Senator Joe Manchin III) for appointing her to the Board, spoke to her experience while serving as a member of the Board and the dedication of its members, and thanked the Board's staff members for their support. Superintendent Martirano - 10 rejoined the meeting at 11:43 a.m. President Green thanked Mrs. Manchin for her service and provided a vision for his presidency with the following "A"s as his priorities: achievement, assessment and accountability. XXIX. Future Meetings The next regular meeting of the WVBE will be held August 12, 2015, in Charleston, West Virginia. The meeting will continue on August 13, 2015, if the agenda is not completed on August 12, 2015. XXX. Adjournment President Green called for a motion to adjourn.
