MINUTES WEST VIRGINIA BOARD OF EDUCATION Capitol Building 7, Capitol Room 1900 Kanawha Boulevard, East Charleston, West Virginia October 8, 2014 I. Call to Order Following the welcome, Pledge of Allegiance and introductions, President Gayle C. Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:09 a.m. on October 8, 2014, in the Capitol Room, Capitol Building 7, Charleston, West Virginia. The following members were present: President Manchin, Vice President Michael I. Green, Secretary Tina H. Combs, Thomas W. Campbell, Robert W. Dunlevy, Lloyd G. Jackson II, L. Wade Linger Jr., and William M. White, and ex officio Michael J. Martirano, State Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. II. Greetings from the Council of Chief State School Officers (CCSSO) Mr. Chris Minnich, Executive Director, CCSSO, addressed the Board regarding CCSSO priorities. III. Recognitions The Board recognized Tolsia High School's Carpentry Program (Wayne County) and carpentry teacher, Mr. Hugh Roberts, as recipients of the 2014 Achieving Excellence in Career Technical Education: The National Career Clusters Institute "Excellence in Action" Award; and Mr. Ed Rollins, Harrison County, recipient of the 2014 National School Transportation Association (NSTA) North American 44th Annual School Bus Driver Safety Competition Conventional Bus Category Award. IV. Delegations Dr. Amelia Courts (distributed information), President/CEO, The Education Alliance, addressed the Board and provided a brief overview of the upcoming Education Summit. V. 2014 West Virginia Teacher of the Year Erin Sponaugle Ms. Erin Sponaugle, teacher at Tomahawk Intermediate School, Berkeley County and the 2014 West Virginia Teacher of the Year, addressed the Board regarding her experiences and perspective gained while serving as the 2014 Teacher of the Year. -2VI. Approval of Agenda President Manchin called for a motion to approve the agenda noting that New Business item I. WVBE Personnel Matters inclusive of RESA 8 Request for Waiver of WVBE Policy 3233, Establishment and Operation of Regional Education Service Agencies (RESAs), and Review of Hearing Officer’s Recommendation for the Termination of Employment of a Professional Employee at the West Virginia Schools for the Deaf and Blind (WVSDB) would be taken up at 1:30 p.m.; item VIII. Update - WVBE Response to Governor's Education Agenda would be taken upon following lunch; and Consent Agenda item 4. Policy 2512, Transformative System of Support for Early Literacy would be taken up under item VIII. Update - WVBE Response to Governor's Education Agenda. Dr. White moved that the agenda, as modified, be approved. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. VII. National Farm to School Month Ms. Mollie Wood, Assistant Director, WVBE Office of Child Nutrition, addressed the Board regarding National Farm to School Month. National Farm to School Month is October. In recognition of this, the WVBE enjoyed locally sourced foods and encouraged all schools to serve locally grown foods in their cafeterias the week of October 13-17 and showcase their farm to school projects. Mr. Dale Hawkins, Fish Hawk Acres, addressed the Board regarding the Farm to School program and locally grown foods served during the meeting. Mr. Tom Grant, Carver Culinary Arts instructor, provided the Board information regarding the morning snack prepared by first year students from Capitol and Riverside High Schools. VIII. Break President Manchin called for a break at 11:06 a.m. IX. Call to Order President Manchin called the meeting back to order at 11:17 a.m. X. Outcomes of September 22, 2014, WVBE Meeting/Work Session with State Superintendent of Schools President Manchin introduced Superintendent Martirano who distributed and provided an overview his document entitled, "State Superintendent's Entry and Vision Plan One Voice, One Focus: All Students Achieving Creating a World-Class Educational System for the State of West Virginia." XI. Break President Manchin called for a break for lunch at 12:01 p.m. -3XII. Call to Order President Manchin called the meeting back to order at 12:53 p.m. XIII. Update - WVBE Response to Governor's Education Agenda Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, members of the Board, and WVDE staff, provided an update (PowerPoint presentation attached) regarding progress toward accomplishing the Governor's education agenda including the key provisions of the Governor's request of the WVBE; Commission on School District Governance and Administration (Mr. Campbell); Project 24 (Mr. Green); require every career center to add at least one career pathway to meet SREB requirements for Preparation for Tomorrow; use RESAs more efficiently for cooperative purchasing and local/regional professional development; teacher evaluation/teacher preparation (President Manchin); teacher certification/teacher preparation; professional development; leadership capacity development; and, early literacy to support reading on grade level by end of third grade (Mr. Clayton Burch - distributed information, Interim Associate State Superintendent, Division of Teaching and Learning, and Executive Director, WVDE Office of Early Learning). (Copies appended to Official Minutes, Attachment Q.) Report of the WVBE Commission on School District Governance and Administration. Mr. Campbell provided an update regarding commission meetings the status of the report. Imagine WV’s Recommendations for Transforming School Leadership in West Virginia. Mr. Jackson (distributed information) presented a resolution in support of Imagine WV's recommendations for the Board's consideration. (Copies appended to Official Minutes, Attachment R.) Mr. Jackson moved that the resolution be adopted. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment R.) Policy 2512, Transformative System of Support for Early Literacy. Mr. Burch provided detailed information regarding Policy 2512. The repeal and replacement of WVBE Policy 2512 lays the framework for the newly established Transformative System of Support for Early Literacy, a key component in West Virginia’s Campaign for Grade Level Reading. During the 2014 legislative session, House Bill 4618 amended and reenacted W. Va. Code §18-2E-10 Bill Title of the code of West Virginia, 1931, as amended, relating to establishing transformative system of support for early literacy; making legislative findings; requiring state board rule; minimum provisions of rule; eliminating critical skills instructional support programs for third and eighth graders; and modifying critical skills program framework to apply only to early literacy program. Implementing a framework to support children becoming proficient readers by 3rd grade provides the momentum to close the achievement gap and ensure more children are on track for graduation and college/career readiness. No comments were received during the comment period. -4Mrs. Combs moved that Policy 2512 be approved. WVBE Personnel Matters inclusive of RESA 8 Request for Waiver of WVBE Policy 3233, Establishment and Operation of Regional Education Service Agencies (RESAs), and Review of Hearing Officer’s Recommendation for the Termination of Employment of a Professional Employee at the West Virginia Schools for the Deaf and Blind (WVSDB) Executive Session President Manchin indicated that an executive session was required for the WVSDB employee matter and called for a motion to enter into executive session. Mr. Green moved, as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)], that the Board enter into executive session. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 1:29 p.m. XV. Return from Executive Session Mr. Green moved that the Board return from executive session. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 2:32 p.m. at which time President Manchin announced that no action was taken or decisions were made. President Manchin called for a motion to approve the Board's personnel attachment. Dr. White moved that the Board's personnel attachment be approved. President Manchin called for a motion regarding the hearing officer’s recommendation for the termination of employment of Michael J. Lippold, a professional employee at the WVSDB. Dr. White moved that Michael J. Lippold's employment at the WVSDB be terminated. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. XVI. Update - WVBE Response to Governor's Education Agenda (Continued) Ms. Peduto and members of the Board continued the update: accountability and accreditation/West Virginia school grading model; and, WVBE Re-imagining Instructional Time Committee (Dr. White and Mrs. Combs). -5Due to business that must be conducted today, President Manchin requested that the Superintendent's Reports be moved to Thursday and other adjustments be made as necessary to accommodate meeting participants and guests. XVII. WVBE Personnel Matters (Continued) President Manchin called for a motion to approve the RESA 8 regional council's request for a waiver of Policy 3233 at sections 3.2 through 3.5. Mrs. Combs moved that the RESA 8 regional council's request for a waiver of Policy 3233 at sections 3.2 through 3.5 be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. XVIII. Chancellor Report Chancellor Hill and Chancellor Skidmore were unable to attend the meeting. XIX. WVBE Coordinator of Board Agencies Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided a report regarding his work with WVBE agencies. XX. Capacity Building for Priority Schools and Intervention Counties Ms. Michele Blatt, Assistant State Superintendent, Division of Educator Quality and System Support, provided information regarding support services provided to a number of priority schools and county districts. Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent, provided a status report regarding the intervention counties. Dr. Robert Bobbera, Superintendent of Mingo County Schools, and Mr. Dave Farley, President of the Mingo County Board of Education, provided a status report regarding Mingo County's progress addressing OEPA audit findings. Also in attendance were Mingo County Board of Education members Ms. Jackie Branch, Mr. Robert Starr, and Ms. June Glover. (Copies appended to Official Minutes, Attachment B-1 and B-2.) XXI. Office of Education Performance Audits (OEPA) Director’s Information Dr. Gus Penix, Interim Director, Office of Education Performance Audits, provided brief remarks regarding school audit procedures. XXII. Grant County School System Education Performance Audit Report Dr. Penix (distributed information) reported that the OEPA conducted a Progress Review of the Grant County School District July 30 – August 1, 2014, to ascertain capacity of the Grant County Board of Education in exercising board leadership and the board’s understanding of personnel and finance decision making. The purpose of this audit was to assess if the Grant County Board of Education had fulfilled the conditions of the Exit Agreement between the WVBE and the Grant County Board of Education to regain full local control. -6The OEPA recommended that the WVBE return local control of the county school system to the Grant County Board of Education effective October 15, 2014, subject to the following conditions: That, 1. The current superintendent remain in the position through June 30, 2016, unless the superintendent and the Grant County Board of Education agree mutually to terminate the contract. 2. The Grant County Board of Education members exercise appropriate boardmanship. 3. The Grant County Board of Education be mindful that it is under the watchful eye of the WVBE as noted in W. Va. Code §18-2E-5(n)(2) which states the State Board of Education may intervene immediately in the operation of the county school system, “. . . if the state board finds the following: That the conditions precedent to intervention exist as provided in this section and that the state board had previously intervened in the same school system and had concluded the intervention within the preceding five years.” Dr. Penix noted that, according to the new Policy 2320 (effective July 1, 2014), school system approval status (Full, Temporary, or Conditional) is tied to grades of schools (A-F) within the school system. Since grades will not be issued until the fall of 2015, at which time all school systems will receive their first approval status under the new accreditation system, it is not necessary to issue an approval status in this report. Dr. DeEdra Bolton, Superintendent of Grant County Schools, introduced Grant County Board of Education members Mr. Scotty Miley, President, Ms. Debora Hedrick, Vice President, Mr. Jared Amtower, Mr. Hugh Harris and Ms. Janie Bird, and Ms. Deborah Mohr, Director of Student Services, Ms. Shelly Crites, Principal of Maysville Elementary, and Ms. Lisa Porter, Grant County Teacher of the year. Following introductions, Superintendent Bolton provided information highlighting Grant County achievements. President Miley addressed the Board regarding his pride in Grant County Schools and thanked everyone for their support. Upon the recommendation of the OEPA, Mr. Jackson moved that the return local control of the county school system to the Grant County Board of Education be granted effective October 15, 2014, subject to the conditions as listed by OEPA. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment G and addendum.) XXIII. Consent Agenda Mr. Dunlevy moved that the Consent Agenda, as previously amended, be approved. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. Approved minutes of September 10 and 22, 2014 (Attachment B) Received information regarding WVDE Personnel Matters (Attachment C) -7 Approved Local Board of Education Policies for Dual Credit for Calhoun, Grant, Marion, Monroe, Upshur, Webster, and Wyoming counties (Attachment D) Notification, per W. Va. Code §18A-4-7a(l)(3), Transfer of Person Employed in a Professional Position after the Twentieth Day Prior to the Beginning of the Instructional Term, from Boone, Cabell, Hancock, Logan, Marion, Mercer, Mineral, Monroe, Ohio, Raleigh, and Summers County Schools (Attachment E). XXIV. Gilmer County Sale of Real Property President Manchin requested a motion move into executive session. Mr. Green moved, in accordance with W. Va. Code §6-9A-4(b)(2)(B)(9), "To consider matters involving or affecting the purchase, sale or lease of property, advance construction planning, the investment of public funds or other matters involving commercial competition, which if made public, might adversely affect the financial or other interest of the state or any political subdivision, that the Board move into executive session. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. The Board entered into executive session at 3:34 p.m. XXV. Return from Executive Session Mr. Dunlevy moved that the Board return from executive session. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 3:58 p.m. at which time President Manchin announced that no action was taken or decisions were made. President Manchin called for a motion regarding Gilmer County's request for the sale of real property. Mrs. Combs moved that the Gilmer County Board of Education be permitted to sell the real property described in the attachment H. Mr. Green seconded the motion. Discussion ensued regarding the minimum bid. Mrs. Combs amended her motion to include a minimum bid at public auction of $400,000.00. Mr. Green agreed to the amendment and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment H.) XXVI. Recess President Manchin recessed the meeting at 4:05 p.m. and announced that the meeting would reconvene on October 9 at 9:00 a.m. in the same location. XXVII. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. XXVIII. Superintendent's Report Office of Adult Institutional Education Programs. Mr. Jacob Green (distributed information), Special Assistant to the Associate State Superintendent, Office of Institutional Education Programs, provided a PowerPoint presentation regarding institutional education programs and 2013-2014 school data. (Copy appended to Official Minutes, Attachment S.) The Association Between School Discipline and Academic Performance: A Case for Positive Discipline Approaches. Mr. Clayton Burch, Interim Associate State Superintendent, Division of Teaching and Learning, and Executive Director, WVDE Office of Early Learning, introduced Dr. Andy Whisman, Assistant Director, WVDE Office of Assessment and Accountability, who presented and provided an overview of a report entitled The Association Between School Discipline and Academic Performance: A Case for Positive Discipline Approaches for Board's information. (Copy appended to Official Minutes, Attachment A and addendum.) Student Data Privacy. Dr. Carla Howe (distributed information), Interim Executive Director, WVDE Office of Legal Services, provided information regarding the protection of privacy and confidentiality of student data. (Copy appended to Official Minutes, Attachment T.) Superintendent Martirano requested Mr. Burch (distributed information) address the Board regarding the receipt of a $9.7 million Substance Abuse and Mental Health Services Administration’s (SAMHSA) grant to focus on mental health needs of children, families and communities through the public school system over the next five years and recent gains in PSAT, SAT and AP results. Superintendent Martirano reported that a stakeholder group will be formed to assist in furthering student achievement efforts. (Copy appended to Official Minutes, Attachment U.) XXIX. Policy 1471, Education in West Virginia's Correctional Institutions: Mission and Goals Mr. Jacob Green presented Policy 1471 for the Board's consideration. Policy 1471 was placed on public comment in May 2014; one comment was received requesting that the language in section 5.2 be more descriptive in the scope of the reporting methods the WVDE will use to collect the data regarding children returning to county school districts from institutional placements. That comment was accepted, language was added, and the policy was again placed on public comment in July 2014. One comment was received during the second comment period regarding the policy’s compliance with Policy 2419. The comment was accepted, the old language has been removed, and new language has been added to comply with Policy 2419. It -9was discovered, during a thorough review of the most recent filing of Policy 1471, that many of the editorial changes made in the May filing were not present in the policy as placed comment in July; this oversight was due to a document version control issue. The policy found in the attachment encompasses all changes made as a result of both comment periods, contains all required language, and corrects minor editorial errors. Mr. Dunlevy moved that Policy 1471 be removed from public comment and that the new version be placed on public comment for a period of 30 days. Policy 5100, Approval of Educational Personnel Preparation Programs Dr. Monica Beane, Executive Director, WVBE Office of Professional Preparation, presented Policy 5100 for the Board's consideration. Policy 5100 has been revised to reflect the adoption and components of the Council for the Accreditation of Educator Preparation (CAEP) Standards. On August 13, 2014, the suggested revisions were approved by the WVBE for placement on public comment for a period of 30 days. During the 30 day comment period, ten comments were received. As a result of the comments received, Sections 6 and 12 were modified. Policy 5100 establishes collaborative program review processes to ensure that educator preparation programs are designed to produce educators with the knowledge, skills and dispositions necessary to be effective in the P-12 classroom. Mr. Jackson moved that Policy 5100, as amended, be approved. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. Policy 5202, Minimum Requirements for the Licensure of Professional/Paraprofessional Personnel and Advanced Salary Classifications Dr. Beane presented Policy 5202 for the Board's consideration. Policy 5202 has been revised to clarify language to ensure the intent of the policy. On August 13, 2014, the suggested revisions were approved by the WVBE for placement on public comment for a period of 30 days. During the 30 day comment period, 45 comments were received. As a result of the comments received, and through consultation with the West Virginia Commission for Professional Teaching Standards (WVCPTS), Section 8 an Appendix A were modified. The primary purpose of licensure is to assure the public that educators, paraprofessionals, and others licensed to work in West Virginia's public schools meet established levels of competence to deliver an appropriate and effective educational program to the state's public school students. Licensure requirements established in this policy provide a means of ensuring that persons employed in West Virginia public schools have the necessary knowledge and skills to meet the responsibilities of their processional assignments in instruction, student support, administration, and any other areas of responsibility for which licensure is required. - 10 Mr. Dunlevy moved that Policy 5202, as amended, be approved. Policy 2520.3C, Next Generation Content Standards and Objectives for Science in West Virginia Schools Mr. Burch (distributed information/PowerPoint presentation attached to official minutes), Ms. Robin Sizemore, Coordinator, WVDE Office of Secondary Learning, and Ms. Teresa Hammond, Coordinator, WVDE Office of Early Learning, presented Policy 2530.3C for the Board's consideration. Policy 2520.3C is proposed to replace Policy 2520.3, “21st Century Science K-8 Content Standards and Objectives for West Virginia Schools (2520.3)” and Policy 2520.35, “21st Century Science 9-12 Content Standards and Objectives for West Virginia Schools (2520.35)” effective July 1, 2016. The July 1, 2016, effective date will allow time for instructional materials adoption. The Next Generation Content Standards and Objectives for Science in West Virginia Schools are researched and relevant goals written for West Virginia students to understand, be scientifically literate, and meet the challenges of the 21st century. Mr. Jackson departed the meeting. Mr. Green moved that Policy 2520.3C be placed on public comment for a period of 30 days. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L and addenda.) XXXIII. Policy 3233, Establishment and Operation of Regional Education Service Agencies Ms. Mary Catherine Funk, WVBE Attorney, presented Policy 3233 for the Board's consideration. Revisions to Policy 3233 include clarification of composition of RESAs and responsibilities of each RESA. The role of the WVBE as a supervising entity is strengthened. Duties and responsibilities of regional councils are outlined, specifically as to personnel oversight and evaluation of executive directors. This strengthened policy will allow RESAs to effectuate both their original intent and increase economic sustainability to foster enhanced programming. Students will continue to benefit from RESA services, including increased programmatic offering and improved educator services supported by professional development initiatives. Mr. Linger moved that Policy 3233 be placed on public comment for a period of 30 days. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. Designation of Recommended Applicants as Education Innovation Zones per Policy 3236, Education Innovation Zones Ms. Blatt (distributed information) presented applicants for designation as Education Innovation Zones the Board's consideration. The Innovation Zone Selection Committee met - 11 October 7, 2014, to review applications for recommendation to the WVBE. Ms. Blatt will issue another round of calls for proposals to be brought before the Board in December. Dr. White moved that Philippi Middle (Barbour County), Southside K-8 (McDowell County), H.E. White Elementary (Clay County), and Madison Elementary (Ohio County) be designated as Education Innovation Zones. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment V.) XXXV. Appointments to WVBE Statutory Units/Liaisons/Presidential Committees 2014-2015 President Manchin requested a motion to appoint Mr. Campbell to the School Building Authority of West Virginia. Mr. Linger moved that Mr. Campbell be appointed to the School Building Authority of West Virginia. Mr. Green seconded the motion and upon the call for the question the motion was carried unanimously.
