INVITATION FOR BIDS

1.

The United States acting through the United States Agency of International Development

(hereinafter referred to as USAID) and Georgia, acting through the Ministry of Finance of

Georgia entered into an agreement for assistance to promote East-west power transmission rehabilitation, promote the Electricity transmission Upgrade, Reconstruction and Operation.

2.

As per above mentioned agreement, JSC Georgian State Electrosystem (hereinafter referred to as GSE), having received rights to conduct procurement from the USAID, invites all interested physical and/or legal persons to submit the Bids for the Procurement of

Maintenance Equipments(Broadside trucks with lifting cranes, Mobile truck mounted cranes,

Truck-type tractors and Wheeled Excavator)

3.

The full package of the Bidding documentation is available in the office (address is given in paragraph 24).

4.

Delivery Terms: a.

Preferable time for delivery of goods for each lot – 4 month; b.

Goods have to be supplied on DAP Tbilisi (Incoterms 2010) according to the technical specification, as indicated in the technical specifications of the bidding documents

(storage area). c.

GSE shall carry out customs clearance of materials in accordance with Georgian legislation under own obligation and expenses.

5.

Waranty terms: lot #1(Broadside trucks with lifting crane) and lot #2: The period of the warranty of the normal operation of the equipment must be at least 18 (Eighteen) months or 50000 km from the date of putting into operation of the equipment. lot #3 and lot #4: The period of the warranty of the normal operation of the equipment must be at least 18 (Eighteen) months or 3000 engine hours from the date of putting into operation of the equipment.

Bidding will be conducted through the procedures as specified in these Bidding Documents and in compliance with Procurement Rules, approved by the Government of Georgia.

7.

Any physical or legal entity which is according to the paragrapg 8 is eligible to participate in the bidding, is authorized to submit the bidexcept for the cases given below: a.

If a bidder represents a country with which the commercial relation is prohibited under Georgian legislation; b.

If a bidder represents a country on the export of whose goods embargo has been put by the Resolution of the UN; c.

If a Bidder is prohibited from bidding to the international donor agencies; d.

If a Bidder (including the firm, firms, or officers) is found to be listed on the United

States Department of the Treasury of companies or organization that are not to be

dealt with by United States persons and firms available at: http://www.treasury.gov/resource-center/sanctions/Pages/default.aspx e.

The Bidders shall have direct or indirect business or family relationship with physical or legal bodies or their affiliates that were invited by procuring entity for the purposes of preparing the design, technical specifications and other documents necessary to procure the definite goods; f.

Bidders and their managers shall have financial or family relations with the personsmembers of the Tender Commission;

Eligibility information for Physical and Legal persons should include the following data: a) The Bidder shall be a manufacturer of required Equipments. b) If the goods are not manufactured by the bidder, an Agreement of Cooperation or any other type of document shall be submitted confirming possibility of supply of goods with the quantity and within the timeframe requested; c) The bidder shall provide information on the existence of relevant production experience of the manufacturer within the last ten years; d) Proof from the appropriate entity stating that neither the Bidder nor the Producer(s) are under liquidation, court receivership or similar proceedings as per any form defined in their country; e) At least three reference letters from final employers. f) The bidders shall provide valid certificates of standards for production and quality control of the factory.

9.

Physical and/or legal persons should comply with the following requirement:

Except as may be specifically approved by the USAID Agreementing Officer, all commodities (e.g., equipment, materials, vehicles, supplies) and services (including commodity transportation services) which will be financed under this agreement with U.S. dollars shall be procured in accordance with the requirements of the United States Code of Federal Regulations, 22 CFR Part

228, "Rules on Source, Origin and Nationality for Commodities and Services Financed by USAID", available at: http://www.access.gpo.gov/nara/cfr/waisidx_09/22cfr228_09.html

The authorized geographic codes for the procurement of goods and services under this agreement are 110 and 937.

In the event that offers from unauthorized sources are significantly lower than the lowest offer from an authorized source, USAID may consider a waiver of this requirement, as specified in 22

CFR 228.

Guidance on eligibility of specific goods or services may be obtained from the USAID.

10.

As a bid security the bidders shall provide a bank guarantee in USD with the amount of 3% of the bid price that shall be valid for 120 days from the date of the opening of the bids. A bank issuing the guarantee shall be qualified no less than “B+” Fitch Ratings or equivalent rating of other international rating agency.

11.

The bidding documentation shall be considered unacceptable for evaluation if the Bidder does not comply with the requirements defined in the paragraphs 7, 8. 9 and 10 or if any of these documents are false. The documents listed in paragraph 8e must be issued from the date of bidding announcement to the date of submission of the bids specified in the paragraph 20.

12.

In the event of involvement in of the subagreementor in frames of the given bidding scope and relations concerning to the Bidding, the Subagreementor is obliged to comply with all requirements set for the Participants by the given announcement and has to submit all relevant qualification data and/or information.

13.

Interested persons are eligible to review the Bidding Documents in the office (address is given in paragraph 23).

14.

For the implementation of the Agreement a performance security Bank guarantee in USD shall be used in the amount of 10% of the Agreement Cost. A Bank issuing the guarantee shall be qualified no less than “B+” Fitch Ratings or equivalent rating by other international rating agency.

15.

To participate in the Bidding, interested persons are required to pay a bidding participation fee of 500 GEL (or the equivalent USD or Euro with official exchange rate of National Bank of Georgia www.nbg.ge established for the day the payment is made ) on the bank account of

GSE (indicating in the payment bill the purpose “Bidding Participation Fee: Procurement of

Maintenance Equipments). The receipt proving the payment has to be submitted to the

Bidding Committee Apparatus at the address indicated in paragraph 20 below or emailed as a scanned copy to the following address giorgi.tatilashvili@gse.com.ge

16.

After a Bidder pays the bidding participation fee, they are officially registered and are allowed to submit a Bid in accordance with paragraph 20.

17.

The bidder shall have the right to submit the bid for all or any of the lots .

18.

The Bidding may reveal one winner per lot.

19.

Additional information is provided in the Bidding Documents.

20.

The complete Bid, as hardcopy and electronic version on CD shall be provided in One (1) original, duly signed and initialed, and four (4) copies. All packages should be packed in envelopes and submitted to: 2, Baratashvili Str., Tbilisi 0105, Georgia, 4 th Floor, and Room No.

417. Head Office of Georgian State Electrosystem JSC till 16:30 16 th of December, 2013 (local time on). Late bids will be rejected. Bids will be accepted in hard copy according to the procedures described in the Instructions to Bidders. Open bidding procedure will be held on same address . Date, time and the amount of price discount of Open Bidding will be notified to the elligible bidders later.

21.

Bids will be opened at the address below at 17:00 local time on 16 th of December, 2013. Only authorized representatives of the bidders are allowed to attend the opening.

22.

Bids submitted by firms that have not registered will not be considered for evaluation and will be returned unopened to the submitters.

23.

Tender Commission may, at its discretion, ask any Bidder for a clarification of its Bid. Any request for the clarification as well as any response submitted by a Bidder shall be in written form. At the same time it is prohibited to provide such a request, proposal or authorization, which changes the price of the bid or goods.

24.
