Question one
Laws are classified based upon different methods. Among the common methods of
classifications are: domestic/ international laws; substantive/ procedural laws; public/ private
laws; and civil / criminal laws.
a) Clearly discuss the distinction between these categories of laws. Support your answers
by examples.
b) Where is the position of business law in each classification? Show the place of business
law in each of the classification. Discuss the reason why you put it (business law) in
specific category.
Question two
Following is a short hypothetical case. Carefully read the case and answer the question there
under. Try to support your answer by the legal provisions (at least by the provisions found
under your module)
Joseph had been the victim of a childhood disease and has grey hair and the general
appearance of an old man. But in fact he is only thirteen years old. One day he went to Auto
Company and asked to buy an automobile. Joseph agreed to pay one-half of the purchase price
of E$30000 and the rest of the price at the end of the month. He paid the agreed sum and the
Company delivered the car to him. Unfortunately, however, the first time Joseph himself drove
the car, the car was smashed into a building!
The problem was defect in the car. The
automobile was demolished and was only worth E$5000 as scrap.
a) Joseph wants to sue the company for return of the sum he paid. How can he proceed?
Can Joseph himself go to court and open the suit? What possible reason the plaintiff
could raise? Could the plaintiff succeed? Why? Or why not?

b) When the plaintiff claimed the sum from the company, the later (Auto Company) filed a
counter – claim for the payment of the remaining one –half of the price agreed ($
15000). Will the company succeed? Why? Or why not?
Question three
Person as we ordinarily know is a being having limbs, and is endowed with special
cognitive capacity. That definition does not, at least partly, work in legal sense of the
term.
a) How do you define person in the legal sense? How does the definition differ
from the meaning of the term as you ordinary know?
b) What category of persons you know under the law? How you differentiate these
types?
c) Discuss attributes of personality under the law
