ANTI-SOCIAL BEHAVIOUR
THE ANTI-SOCIAL BEHAVIOUR TEAM
The Anti-Social Behaviour Team is a partnership
between Thames Valley Police and the Royal
Borough Windsor & Maidenhead.
Individuals include:

OUR AIM
The aim of the Anti-Social Behaviour
Team is to provide a swift,
co-ordinated response to reports of
anti-social behaviour, by working
with other agencies, to help improve
the quality of life for residents.
WHAT IS ANTI-SOCIAL BEHAVIOUR?
ASB Act 2003:
“Harassment, Alarm or Distress”
Defined by ACPO:
“Behaviour by an individual or group that results or is likely to
result in: another party feeling personally threatened,
 creates a public nuisance, or
 has a detrimental impact upon the environment, or
 has a detrimental effect upon the quality of life of an individual
or the community as a whole.”

PARTNERSHIP WITH A NUMBER OF AGENCIES,
INCLUDING THE FOLLOWING:

ACCEPTABLE BEHAVIOUR CONTRACT
An Acceptable Behaviour Contract, known as
an ABC, is a voluntary contract between the
ASB Team and the individual concerned.
Conditions are written into the contract to try &
stop the person’s anti-social behaviour, and if
necessary relevant support is put in place.
The contract is usually for six months, and if
breached the evidence can be used towards
further enforcement action.
PERSISTENT OFFENDERS
ORDERS AND INJUNCTIONS




Anti-Social Behaviour Order (ASBO) has been replaced
by Criminal Behaviour Order (CBO).
Civil Injunctions (legislation pending).
The above allows us to restrict repeat offenders from
conducting certain activities for a set period of time.
Breach of an order will ultimately result in an arrest!
DISPERSAL POWERS – SECTION 35’S
Section 35 of the Anti-Social Behaviour, Crime and
Policing Act 2014 gives police officers the power to
direct a person to leave a locality for up to 48 hours if
their presence contributes, or is likely to contribute to,
members of the public in the locality being harassed,
alarmed or distressed.
The Anti-Social Behaviour Team monitor those who
receive Section 35’s take action against repeat
offenders. This can include warning letters...etc.
PREMISES CLOSURE POWERS
The Anti-Social Behaviour, Crime and Policing Act 2014 allows a
premises to be closed where the following
HAS occurred, or WILL occur:


Nuisance to the public; or
Disorder near those premises
(Up to a period of 48 hours – authorised by Police or Council)



Disorderly, Offensive or Criminal Behaviour;
Serious nuisance to the public; or
Disorder near the premises
(Up to 6 months – authorised by the Magistrates Court)
VEHICLES – SECTION 59’S
Section 59 of the Police Reform Act 2002
gives Police Officers the power to issue
drivers or vehicle owners with a warning
where the vehicle is being used in a
manner which causes harassment, alarm,
distress.
The vehicle may be seized upon a
second warning in a 12 month period.
COVERT SURVEILLANCE
The Anti-Social Behaviour Team can apply
for approval to install covert CCTV to
gather evidence of anti-social behaviour.
This needs to be necessary and
proportionate and will only be used as a
last resort!
WHAT WILL BE ASKED OF YOU IF YOU CONTACT
THE POLICE?
When you are connected to a call handler the minimum
information that you will be asked for will be:






Name, Address and Contact Number
Your DOB or Age
Do you feel you are specifically targeted and if so,
why?
How often has this happened?
Are you concerned it will re-occur?
Updates to any live, ongoing incident.
WHAT HAPPENS NEXT





You may be visited by officers from the police or local council
such as a PCSO, Community Warden, Police Officer or Member
of the ASB Team.
You will be asked to open an ASB case.
Requested to keep diary sheets.
May be asked to provide statement or, in a serious case;
Asked to attend Court
