LEGAL ISSUES IN HEALTH CARE FRAUD AND ABUSE: ENFORCEMENT AND COMPLIANCE

INTRODUCTION AND COURSE DESCRIPTION: This Course will cover the health care fraud and
abuse laws and regulations relating to the prosecution and defense of alleged wrongdoing by
health care providers and suppliers. The Course will provide a basic overview of the laws
governing healthcare providers and suppliers, such as hospitals, physicians and physician
practices, clinical laboratories, medical device and pharmaceutical manufacturers, and nursing
homes.
This Course explores the implications of the federal and state Anti-Kickback Laws, the federal
anti-referral (Stark) law, the federal civil monetary penalty and exclusion laws, the federal and
state false claims laws, as well as traditional federal white collar criminal laws as applied to
health care. Emphasis will be placed on the federal laws but state law issues will also be
considered.
In addition, this Course will consider voluntary and mandatory fraud and abuse compliance as
well as the complexities and challenges that arise in developing and maintaining an effective
compliance program.
This Course is designed to be interactive, with assigned reading and lectures to be supplemented
with hypotheticals and short presentations. Some of the class work may be assigned in teams.
Guest lecturers from both the government and private practice will share their perspectives on
compliance and enforcement.
COURSE REQUIREMENTS AND GRADING: Class attendance and active participation are expected.

Class participation/Written Memos/Presentations (30% of Grade) -- Students
are expected to attend all classes in their entirety, read the course materials in preparation for
class discussion, participate actively in group discussions and mock client exercises, and
complete written assignments and/or oral presentations as assigned.
b.
Final Exam (70% of Grade) – The final exam will consist of short answer
questions and hypotheticals. Students may use Course Reading Materials and class notes in
completing the exam.
COURSE READING MATERIALS: There is no mandatory textbook for this course. Required
reading materials primarily consist of statutes, regulations and case law, along with federal and
state agency guidance, and other publicly available materials. All such materials are available
on-line or will be distributed in class.
SHARING OF COURSE CONTENT: Students are not permitted to make visual or audio recordings,
including live streaming, of classroom lectures or any class related content, using any type of

recording devices (e.g., smart phone, computer, digital recorder, etc.) unless prior permission
from the instructor is obtained, and there are no objections from any of the students in the class.
If permission is granted, personal use and sharing of recordings and any electronic copies of
course materials (e.g., PowerPoints, formulas, lecture notes and any classroom discussions online
or otherwise) is limited to the personal use of students registered in the course and for
educational purposes only, even after the end of the course.

Faculty may record classroom lectures or discussions for pedagogical use, future student
reference, or to meet the accommodation needs of students with a documented disability. These
recordings are limited to personal use and may not be distributed (fileshare), sold, or posted on
social media outlets without the written permission of faculty.
Unauthorized downloading, file sharing, distribution of any part of a recorded lecture or course
materials, or using information for purposes other than the student’s own learning may be
deemed a violation of American University’s Student Conduct Code and subject to disciplinary
action (see Student Conduct Code VI. Prohibited Conduct). Sharing of class notes is not
prohibited.
