PURCHASE and SALES AGREEMENT
This is the agreement between the buyer and seller. It lists all the terms and conditions agreed upon. It is often called “The Contract”. We use
the same form to purchase and sell, it is just filled out with different conditions.
Below are suggestions of what to put into each blank.
Blank Number
Explanation
1.The name of the buyer goes in this blank. All parties that want to be on the title should be named here. Using the name (and/or initials), as they
want it to appear on the title.
2. The name of the seller goes in this blank. All parties that are on title should have their names here, the same way they appear on the title. You
can use the term Owner of Record and the Closing Agent should pick up and use the owner’s name that is recorded on the title.
3. The county that the property is located in goes in this blank.
4. If you have the Legal Description put it in this blank. If it is a lengthy description you can write in See Addendum “A” and attach a legal
description. If you do put one in here be sure it is exactly as it appears on public record. It is not mandatory that a description be put in here.
5. The address of the property goes here.
NOTE: If you are selling a property it is suggested that on paragraph 1A you cross out the word deposit (where it says binder deposit) and write
in the word “fee”. Also, you write the words non refundable in the column to the right of the letter “A”. (The line will read non- refundable
binder fee.) If you are purchasing a property do not make these changes.
