Dog Walking Contract The parties to this contract and agreement are: Full Legal Names:________________________________________________________ Identification (Specify)_______________________________ Physical Address: ________________________________________________________ (Hereinafter referred to as "the Owner") AND Director Name acting on behalf of On The LeashLTD:___________________________ Company Address: ________________________________________________________ The parties choose the above stated addresses as their physical addresses at which legal proceedings may be instituted. Whereas the Owner wishes to engage On The LeashLTD and the On The LeashLTD agrees to undertake the services under the terms and provisions defined in this Dog Walking Contract as well as the Owner's Information sheet, Pet Information sheet(s), Animal Care Plan, DAHR and the Veterinary Release Form which shall all become part of this Contract. Any reference to dogs or pets in this contract shall refer to those specified on the Pet Information sheet(s). 1. Relationship and Responsibilities 1.1. It is expressly understood that the Owner retains the services of On The LeashLTD as an Independent Contractor and not as an employee. On The LeashLTD shall be responsible for his/her insurance and all statutory declarations and payments with regard to income tax and VAT where applicable. 1.2. The On The LeashLTD Walker undertakes to perform the agreed-on services in an attentive, reliable and caring manner and the Owner undertakes to provide all necessary information to assist in this performance. 1.3. The On The LeashLTD Walker undertakes to notify the Owner of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog. 1.4. The On The LeashLTD Walker will supply and be equipped with a scooper and waste bags and will duly remove the dog's faeces from all public places. 1.5. The On The LeashLTD Walker reserves the right to walk other compatible dogs at the same time but undertakes to limit the number of dogs walked with one person to 2 (Two) (Households with more than 2 dogs, will be charged an additional £3 per dog per hour. No more than 3 dogs will be walked at any one time. 1 This is due to the health and safety of the dogs and the walker. Households with more than 3 dogs will be walked in sets of 2. In this scenario you will be charged the additional £3 per dog and the rate of the walk, per each walk. 1.6. The Owner will provide suitable harnesses, collars and leads as approved by the On The LeashLTD Walker as well as coats or muzzles if required. 1.7. The On The LeashLTD Walker shall not be obliged to perform any other duties except those specified on the Owner's Information sheet and Pet Information sheet. 2. Compensation 2.1. All services performed by On The LeashLTD shall be booked and paid for in advance, or paid for on the day of appointment. No services can be performed until the initial assessments have been completed. 2.2. We accept direct debit bank transfer, cheque, and cash payments can be paid on the day of appointment to the director of OTLLTD only, or must be paid every week on Friday of every week, cash can only be paid to the director or company coordinator, which will be receipted, and signed by the owner and director/company coordinator. If payment is not received by the company for our services, or is late, 2.5% of the total bill will be added every day the payment is overdue. To avoid this charge we highly recommend you pay online, through bank transfer, direct debit or pay pal, depending on the booking. All clients will receive an invoice of services received and payment. 3. Duration 3.1. This Dog Walking Contract shall come into effect on the ____ day of_____________ 20____ Termination of this contract shall require one month of 31 days written notice to terminate without charge, the 31 days written notice will be taken from the date of the letter. Failure to give sufficient notice of termination of contract, including moving away from our radius of work, will result in a charge of one months (31 days) calculated loss of earnings of the service we would have on average provided. (for example 1 dog walk a day per week was the average, that is what you will be charged.) 4. Cancellation or Early Termination 4.1. Either party may cancel an appointment with a minimum of 24 (twenty four) hours prior to the first scheduled visit without incurring penalties or damages. 4.2. Cancellation by the Owner of scheduled walks with less than 24 hrs notice may be charged at the full rate or rescheduled at the discretion of the On The LeashLTD. 2 4.3. Where On The LeashLTD needs to cancel a scheduled appointment due to unforeseen circumstances, On The LeashLTD may appoint a substitute Walker within the team of the area, if this is not able to be implemented On The LeashLTD will try to re-book the appointment, if this is not able to be implemented On The LeashLTD will issue a full refund for that appointment (and only that appointment). 4.4. Should any dog become aggressive or dangerous, On The LeashLTD may terminate this dog walking contract with immediate effect. 4.5. Any wrongful or misleading information in the Owner's Information or Pet Information sheets may constitute a breach of terms of this Dog Walking Contract and be grounds for instant termination thereof. 4.6. Termination under the circumstances described in 4.4 or 4.5 above shall not entitle the Owner to any refunds nor relief of any outstanding payments due. 5. Liability 5.1. The On The LeashLTD Walker will carry liability insurance relative to the services performed for the Owner. A copy of the insurance policy is held at On The LeashLTD, and can be made available to the Owner upon request and the Owner acknowledges that he/she is familiar with its content. 5.2. Neither On The LeashLTD nor the On The LeashLTD Walker will accept no liability for any breach of security, loss of or damage to the Owner's property, if any other person has access to the property during the term of this agreement. 5.3. Neither On The LeashLTD nor the On The LeashLTD Walker shall be held liable for any mishap of whatsoever nature which may befall a dog or caused by a dog who has unsupervised access to the outdoors. 5.4. The Owner shall be liable for all medical expenses and damages resulting from an injury to the Walker caused by the dog as well as damage to the Owner's property, and/or the Walkers property. 5.5. On The LeashLTD and the On The LeashLTD Walker is released from all liability related to transporting dog(s) to and from any veterinary clinic, the medical treatment of the dog(s) and the expense thereof. 6. Indemnification The parties agree to indemnify and hold harmless each other as well as respective employees, successors and assigns from any and all claims arising from either party's willful or negligent conduct. 3 7. Emergencies In the event of an emergency, On The LeashLTD shall contact the Owner at the numbers provided to confirm the Owner's choice of action. If the Owner cannot be reached timeously, the Walker is authorised by On The LeashLTD to: 7.1. Transport the dog(s) to the listed veterinarian; 7.2. Request on-site treatment from a veterinarian; 7.3. Transport the dog(s) to an emergency clinic if the previous two options are not feasible. 8. Security The On The LeashLTD Walker warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return all keys to the key boxes (which are property of On The LeashLTD, which are attached to the owners property, and damage sustained to the clients property will be repaired at the expense of On The LeashLTD.) at the end of the appointment or immediately on demand. 9. Relaxation of Terms No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. 10. Whole Agreement This Dog Walking Contract and Owner's Information sheet, Pet Information sheet(s) Animal Care Plan, DAHR and the Veterinary Release Form attached constitute the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained therein. Any alteration to this agreement must be in writing and signed by both parties. 11. Assignment All clients of On The LeashLTD will be assigned a team of Animal Carers to perform the various services required by our clients. If in the event of an emergency and a member of your team in your are is unable to cover/attend to the service you have pre booked, On The LeashLTD can offer cover from a staff member from a different area, or administer a full refund if the owners is unhappy with this arrangement. All staff are CRB checked and receive the same high standard of training. 12. Binding Effect The terms of this Contract shall be binding upon and accrue to the benefit and be enforceable by either party's successors, legal representatives and assigns. 4 13. Governing Law This Contract and Agreement shall be construed, interpreted and governed in accordance with the laws of the United Kingdom and should any provision of this Contract be judged by an appropriate court as invalid, it shall not affect any of the remaining provisions whatsoever. 14. General The parties agree that any or all parts of this agreement may be submitted to the other party in legible and recordable electronic form and upon acknowledgement of receipt by the receiving party shall become valid parts of the agreement. Paragraph headings are for convenience of reference only and are not intended to have any effect in the interpretation or determining of rights or obligations under this agreement. Where appropriate words signifying one gender shall include the other and words signifying the singular shall include the plural and vice versa. 15. Death Clause In the event of a clients death (that is still under contract with On The LeashLTD), On The LeashLTD will assume no responsibility for the animal(s) that was under On The LeashLTD duty of care. On The LeashLTD’s duty of care will terminate to the animal(s) in question in the event of our clients death. On The LeashLTD cannot ‘inherited’ or be left an animal(s) (i.e. the duty of care of animal on a permanent basis, for the remainder of that’s animals life.) welfare and responsibility to On The LeashLTD. If our clients have nominated a person to assume responsibility for the animal(s) in question, and that person who was nominated wishes On The LeashLTD to temporarily continue required services while the deceased clients estate is being in probate, then the all On The LeashLTD service charges must be paid out of the deceased clients estate immediately. If once the deceased clients estate has been finalised, and the nominated person to assume responsibility for the animal wishes to continue using On The LeashLTD services, then that person will have to sign all necessary paper work, and of course all charges will then be taken from the nominated person. If the deceased client did not nominate a person to assume responsibility for the animal in question, and has not made arrangements for it to go back to a breeder (if relevant), or any other arrangements for the animal, then we highly recommend our clients to do so, as On The LeashLTD will not accept or assume responsibility for the animal(s) in question. If no arrangements have been made and there is no person or organisation to care for the animal, and On The LeashLTD believes the animal(s) to be in danger or subject to neglect then On The LeashLTD reserves the right to call the local authority and RSPCA to ensure the safety of the animal.
