What is the decision: “Safe Harbor” Agreement is declared invalid by the highest European Union Court. Data Privacy Expert: “Theoretically every organization that previously was in the Safe Harbor is out of compliance with European data protection law today and is subject to the enforcement risks of a data protection authority coming after them. …. The risk profile for organizations has increased exponentially.” Impact - Data Privacy – Data Sharing: Individual country privacy regulations will dictate, no common EU regulation. The existing “Self-Certification” for compliance with data privacy regulations is not valid any longer. “Big Data” collections models in general may attract much greater scrutiny and legal barriers. Examples “Safe Harbor List” What can we do? Insert standard data protection clauses into customer, vendor, employee contracts Review corporate rules for data transfers within a corporation and amend the intercompany contracts with binding data protection clauses, Identify the processes where data can legally be transferred on the basis of performance of a contract. Solicit the free and informed consent of the individual whose data are impacted. Key Impact Areas Single global instance: Do we need separate data repositories in each country and multiple country specific configurations? Cross-Country Shared service centers especially those outside of the European Union: How can we enforce European data privacy on Vendor and Employee processes for shared services in India, Philippines, etc. Cloud, Big Data, Business Intelligence modules Additional encryption options on personal data comparable to the banking encryptions What’s next ? The MN-SIG will stay in touch with Oracle Corp., Users, and the prominent audit agencies to provide updated information on available solutions.
