• Concept applied in product liability cases
• Manufacturer, distributor, or seller is liable
for any and all defective or hazardous
products which unduly threaten a
consumer’s health and safety
• Consumer only has to prove the defect
and damages

Absolute Liability
• Liability without regard to fault or
negligence
• Applies when known or unusual conditions
are allowed to exist
• Applies regardless of the care exercised
• Includes dynamite, gasoline, chemicals,
explosives, wild animals in captivity,
domestic animals known to be abnormally
dangerous, etc.

• Rule or law enacted by a legislative body
