THE CONSUMER PROTECTION (PRICE AND SUPPLIES CONTROL) ACT
Regulations made by the Minister under section 35 of the Consumer Protection
(Price and Supplies Control) Act
1.
These regulations may be cited as the Consumer Protection (Control of Price of
Petroleum Products) (Amendment No. 3) Regulations 2006.
2.
In these regulations -
"principal regulations" means the Consumer Protection (Control of Price of Petroleum
Products) Regulations 2004.
3.
The principal regulations are amended -
(a)
in regulation 7(7), by deleting the word "quarter" and replacing it by the word
(b)
in regulation 8A(2), by deleting the words "preceding quarter" and replacing them
"year";
by the words "preceding year";
(c)
by adding immediately after regulation 8A, the following new regulation 8B.
(1)
Notwithstanding the other provisions of these regulations, any
percentage of adjustment in the price of Liquefied Petroleum Gas
cylinders of 5,6 and 12 kg computable under those other
provisions of these regulations, in respect of the quarter beginning
1 October 2006 and every subsequent quarter of each year
ending 30 September, shall be computed but-
(a)
shall not be considered for the purposes of determining the
retail price of the said cylinders in respect of those
quarters; and
(b)
shall instead be carried forward and considered for the
purposes of determining the retail price of the said
cylinders for the whole of the year beginning on 2 October
2007 and for the whole of every subsequent year.
(2)
The retail price of Liquefied Petroleum Gas for the year beginning
on 3 October 2006 shall be 26.25 rupees per kilogram.
(3)
For the purposes of regulation 8A and this regulation, every year
shall be deemed to start on the second working day of the quarter
beginning 1 October.

followed by the word "and" accordingly -
(viii)
interest paid on lines of credit in foreign currency as well as losses in holding
those lines of credit, less interest received whether in Mauritius rupees or
foreign currency.

These regulations shall come into operation on 3rd October, 2006.

Regulations made by the Minister under section 35 of the Consumer Protection
(Price and Supplies Control) Act
1.
These regulations may be cited as the Consumer Protection (Control of Price of Petroleum
Products) (Amendment) Regulations 2006.
2.
In these regulations -
"principal regulations" means the Consumer Protection (Control of Price of Petroleum Products)
Regulations 2004.
3.
Regulation 2 of the principal regulations is revoked and replaced by the following regulation -

In these regulations –
(1)
"CIF" means -
(a)
the weighted average C.I.F, in foreign currency, of consignment of
petroleum product with Bill of Lading dates in the preceding quarter;
and
(b)
includes any consignment already loaded on board a vessel for
importation in Mauritius whose Bill of Lading date is issued not later
than 15 days of the end of the last month of the preceding quarter;
"Corporation" has the same meaning as in the State Trading Corporation Act;
"petroleum product" means the product specified in the First Schedule;
"Certification Committee" means the Committee established under regulation
9;
"windfall gain or loss" in respect of a quarter means any old stock of petroleum
product purchased by entities responsible for the storage and distribution of
petroleum products purchased at a lower or higher price, as the case may be, in
the preceding quarter being carried forward to the new quarter to be sold at
higher or lower new price, as the case may be, resulting in a gain or loss.
(2)
(a)
The meaning of "basic value" shall be the sum of –
(i)
the C.I.F price kilogram of Liquefied Petroleum Gas/or per litre
of any other petroleum product, as the case may be, calculated
in Mauritian rupees for the preceding quarter;
(ii)
the excise duty specified in Part I of the First Schedule of the
Excise Act;
(iii)
any surplus or deficit, as the case may be, of the preceding
quarter, calculated as being the difference between the C.I.F
price referred to in paragraph (i) and the revised C.I.F price of
the preceding quarter;
(iv)
any adjustment due to any difference between the estimated
quantity, the exchange rate, any windfall gain or loss, and
rounding of figures used to arrive at the C.I.F price of the
preceding quarter which requires revision of the figures;
(v)
any windfall gain or loss resulting from stockholding at the time
of any previous price change;
(vi)
any gain/loss carried forward from the preceding quarter; and
(vii)
any gain on hedging in the preceding quarter.
(b)
The basic value of the Liquefied Petroleum Gas shall, in addition to the
items specified in subparagraph (a), include the difference between the
retail price calculated in accordance with the Fourth Schedule and the
maximum allowable retail price referred to in regulation 8A(2).
4.
Regulation 3 of the principal regulations is amended by inserting immediately after the words
"Second Schedule" the words ",Third Schedule or Fourth Schedule, as the case may be".
5.
Regulation 7 of the principal regulations is amended -
(a)
by revoking paragraph (1) and replacing it by the following paragraph -
(1)
Subject to paragraphs (2) to (7), the Corporation shall consider any adjustment
in the retail price of -
(a)
a petroleum product, other than Liquefied Petroleum Gas, where the
percentage of such adjustment is within the range of 2.5 to 20 per cent;
(b)
Liquefied Petroleum Gas where the percentage of such adjustment is
within the range of 2.5 to 5.0 per cent.
(b)
by inserting immediately after paragraph (4) the following new paragraphs, the existing
paragraph (5) being renumbered as paragraph (8) accordingly -
(5)
Paragraphs (3) and (4) shall not apply to an adjustment in the retail price of
Liquefied Petroleum Gas.
(6)
For any price adjustment beyond 5 per cent in the case of Liquefied Petroleum
Gas, a maximum price increase or decrease of 5 per cent, as the case may be,
shall be considered.
(7)
Any excess of 5 per cent in the case of Liquefied Petroleum Gas shall be carried
forward as an additional charge in the determination of the basic value for the
succeeding quarter.
6.
The principal regulations is amended by inserting immediately after regulation 8 the following
new regulations -
8A
(1)
The retail price of Liquefied Petroleum Gas for the quarter beginning on 01 July
2006 shall be 25 rupees per kilogram.
(2)
The maximum allowable increase in the retail price of Liquefied Petroleum Gas
for any subsequent quarter shall not exceed 5 per cent of the retail price of the
preceding quarter.
7.
The First Schedule to the principal regulations is amended by adding the following new items -

Fuel Oil sold on the local market other than for sale to the Central Electricity Board.

Liquefied Petroleum Gas filled in cylinder of 5, 6 or 12 kilogram.
The Second Schedule to the principal regulations is amended in the heading by adding below the
words "Price Structure", the words "Mogas (Motor Gasoline) and Gas Oil sold on the local
market (Diesel)".
9.
The principal regulation is amended by adding, after the Second Schedule, the Schedules in the
Schedule to these regulations.
10.
Part I of the First Schedule to the Consumer Protection (Control of Price of Taxable and Non
Taxable Goods) Regulations 1998 is amended by deleting the following item -

These regulations may be cited as the Consumer Protection (Control of Imports)
(Amendment No. 3) Regulations 2006.

In these regulations -
"principal regulations" means the Consumer Protection (Control of Imports) Regulations
1999.
3.
The Second Schedule to the principal regulations is amended by adding immediately
after item 33, the following new items -

replacing them by the words, "BS EN 61009, IEC 61008 or IEC 61009".

Regulations made by the Minister under section 35 of the Consumer Protection

These regulations may be cited as the Consumer Protection (Trade Fair and Exhibition)
(Amendment) Regulations 2006.
2.
In these regulations -
"principal regulations" means the Consumer Protection (Trade Fair and Exhibition) Regulations
2003.
3.
Regulation 2 of the principal regulations is revoked and replaced by the following regulation -

In these regulations-
"applicant" means a person, company or association applying for authorisation to hold a
trade fair or exhibition;
"exhibition" means a commercial event of a period of not less than 3 days, nor more
than 10 days, at a specific place where participants are allowed to exhibit their products
and services;
"organiser" means an applicant who has obtained authorisation to hold a trade fair or
an exhibition under these regulations;
"participant" means a Mauritian or foreign person to whom, or a Mauritian or foreign
company or association to which, a stand in the trade fair or exhibition is , or is to be,
allocated by the applicant or organiser, as the case may be;
"trade fair" means a commercial event of a period of not less than 3 days, nor more
than 10 days, at a specific place where participants are allowed both to exhibit and to
sell their products and services.
4.
Regulation 3 of the principal regulations is amended by revoking paragraph (1) and replacing it
by the following paragraph -
(1)
Any person wishing to hold a trade fair or an exhibition shall apply to the Minister for
authorisation in the form set out in the First Schedule, not less than one month before
the proposed first day of the trade fair or exhibition.
5.
Regulation 5 of the principal regulations is revoked and replaced by the following regulation-
5.
(1)
The Minister may grant an application, subject to-
(a)
payment by the applicant to the Accountant General -
(i)
rupees;
where the applicant is the sole participant, of a fee of 5,000
(ii)
where there is more than one participant and-
(A)
the trade fair or exhibition is to be held in a rented
building or on rented premises, of a fee equivalent to
15% of the amount paid by the applicant as rental for
the building or premises;
(B)
the trade fair or exhibition is to be held in a temporary shed, marquee or other
temporary structure, on public grounds or on school premises, of a fee of 15,000 rupees;
(b)
compliance by the applicant with the conditions specified in the Second
Schedule; and
(c)
such other conditions as he may think fit to Impose,
or may reject the application.
(2)
The Minister may -
(a)
where the organiser fails to comply with any condition specified in the Second
Schedule or imposed under paragraph (1)(c), direct the organiser to comply with
the condition forthwith or within such time as the Minister may specify;
(b)
where the organiser fails to comply with a directive issued under paragraph (a),
revoke the authorisation.
6.
The principal regulations are amended by revoking the First Schedule and replacing it by the
Schedule to these regulations.
7.
These regulations shall apply to any trade fair or exhibition which is to be held after the coming
into operation of these regulations.

SECOND SCHEDULE
(regulation 5)
CONDITIONS
1.
Every organiser and participant shall comply strictly with the laws relating to consumer
protection and the Fair Trading Act.
2. The area of each stand shall not be less than 9 square metres, and walking space of not less than
2 metres shall be provided for the public between any 2 rows of stands.
3.
Every stand shall be occupied by not more than one participant and shall, in no circumstances,
be sublet to any person, company or association other than the participant named in the
application form.
4.
The organiser shall provide a desk on the premises where the trade fair or exhibition is held, for
the Consumer Protection Unit of the Ministry responsible for the subject of consumer
protection to receive and attend to any public enquiry or complaint.
5. The organiser shall provide an identification badge to each participant, a sample of which shall
be submitted to the Ministry responsible for the subject of commerce, not less than 2 weeks before
the proposed first day of the trade fair or exhibition.
