Full Terms and Conditions 1. Open to all UK residents except employees and their immediate families of Cadbury World, its affiliated companies, their agents or anyone professionally connected with this competition. Anyone under the age of 16 will need their parent’s/guardian’s permission before entering this competition. 2. By entering this competition, all entrants will be deemed to have: (i) Accepted and be bound by these terms and conditions; and (ii) Consented to their entry and the personal information collected from them in connection with this competition being held by the Promoter for the purposes of this competition and other marketing or promotional materials deemed suitable for the entrant. 3. No purchase necessary. To enter this competition each entrant must submit a completed entry form, with completed Pumpkin design on the given template to any of the following to arrive no later than the Closing Date: a. Posted in the entry box situated in the Entrance Area to Cadbury World; or b. Scanned and emailed to cadburyworldgeneralenquiries@mdlz.com; or c. Posted to Crazy Colouring Competition, Cadbury World, Linden Road, Bournville, B30 2LU. 4. Any entries submitted by those under the age of 16 must have a parent’s/guardian’s signature on their entry form. 5. The closing date for receipt of entries is the final day of each calendar month (“Closing Date”). One winner is chosen by Cadbury World chocolatiers who will determine based on the following criteria; Originality and creativity. Winner will be contacted by post. 6. The Promoter reserves the right to disqualify incomplete or illegible entries. No responsibility will be accepted for entries lost, damaged or delayed. 7. Entries are restricted to one per person. 8. Photocopied entries not accepted. No bulk, third party or consumer group entries will be accepted. 9. No bulk entries. 10. There is 1 grand prize to be won, consisting of: (i) colour pencils and a Chuckle bean key ring. No accommodation, travel costs or other expenses are included within the prize. 12. By submitting a design and in consideration of being awarded the associated prize, the grand prize winner and the parent/guardian who provided consent on the application form: a) Warrants and represents that he/she owns all rights to the design, and that the design: (i) Is original to him/her and has been legally obtained and created (ii) Does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, regulations, or network standards; and a). Has not been published previously in any medium; and b). Grants Promoter an exclusive, transferable, royalty free and perpetual right to re-produce the design, or an amended design; the final design approval is to be solely at the discretion of Promoter and all associated promotion materials and offer product using the design for sale; and (iii) agrees to indemnify and hold Promoter harmless from any and all claims, damages, expenses, costs and liabilities, brought or asserted by any third party against Promoter due to or arising out of Promoter use of his/her design pursuant to these competition terms and conditions, including but not limited to any such claims, damages, expenses, costs and liabilities relating to trade mark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. Promoter shall have sole discretion as to the production numbers and distribution of any product incorporating any winning design. 13. The grand prize winner may also be required, and by entering this competition all entrants agree, to take part in associated publicity which may include a photo-shoot to be carried out at an agreed date to be published within National or Local Press. 15. All prizes must be claimed by the following calendar month. All reasonable effort will be made to contact the grand prize winner, however, if the prizes are not claimed within 1 month, an alternative grand prize winner may be selected if there is sufficient time remaining. Winners are not required to visit Cadbury World within this claim period. 16. The prizes are non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. The decisions of the Promoter are final. 17. In the event of unforeseen circumstances the Promoter reserves the right to provide alternative prizes of equal or greater value. 18. Proof of postage is not proof of receipt. 19. The competition judges’ decision is final and no correspondence will be entered into. 20. The name and county of the grand prize winners and runners-up will be available from 11th October to 2nd November 2013 to those enclosing a stamped SAE to: Design a Pumpkin Competition, Cadbury World, Linden Road, Bournville, Birmingham B30 2LU 21. Any personal data relating to participants will be solely used in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent. 22. In this instance, personal details are used for the purposes of awarding the competition prize(s) only and will not be released to any third party for mailing or marketing purposes. 23. Anybody taking part in this promotion do so at their own risk. Cadbury are not liable for any damage caused to persons or properties whilst taking part in the promotion.
