Municipality of Bindoy Province of Negros Oriental GOVERNANCE AND ENFORCEMENT (GEM) ACTION PLAN September 2013 – August 2014 Richard Balauro Conservation Fellow Bindoy Pride Campaign I. Introduction (not more 500 words) • Provide a brief description of your site The municipality of Bindoy is a 4th class municipality located 70 kilometers north of the capital of Negros oriental. It is bounded on the north by the municipality of Ayungon, on the east by the Tañon Strait, west by the municipality of Mabinay and south by the municipality of Manjuyod. It has 22 barangays, 6 of which are coastal barangays and the rest are upland. The total area is 17,433 hectares, of which 70 % are classified as timberland and the rest alienable and disposable (A & D). The size of municipal water is 13,125 hectares. Population as of 2010 census is 39,873 but with a growth rate 2.26 %, the total count will reach to 39,000 more or less by 2006. The coastal population would represent 31.5 % or 12,285, of which 57 % are directly engaged in fishing. The recent slump in the economy makes it hard for fishermen to subsist in a meager income of P 11,193.65 (PRA Consolidated Data). Bindoy has five marine protected areas and a marine reserve which are in fair condition. The aggregate area of marine sanctuaries of Bindoy is 65 hectares and 46 hectares marine reserve. These are Domolog Marine Sanctuary (10 has.); Cabugan Marine Sanctuary (10 has.); Pangalaycayan Marine Sanctuary (10 has.); Malaga -Marine Sanctuary (10 has.); Tinaogan Marine Sanctuary (25 has); Tinaogan -Mantalip Marine Reserve (46 has.) These marine sanctuaries and a reserve are challenged with different issues and problems despite the initiatives poured out by that local government to protect the areas. The local fishers still intrude in the marine sanctuaries. Their intrusions seem to result a declining fish population and decreasing fish catch of the small fishers of the municipality of Bindoy. The local government of Bindoy is dedicated to increase the benefits of having marine protected areas to augment livelihood opportunities of its fishers. • History of how did you arrive and finalize the plan The Governance and Enforcement Action Plan is designed based on the critical results of the Management Effectiveness Assessment Tool (MEAT) conducted by the local government in cooperation with RARE. Such results are reinforced by the results of the qualitative and quantitative surveys. The quantitative and qualitative surveys determine the level of knowledge and attitude regarding their fishing practices and management. The MEAT provided the local government unit as to the level of effectivity in the management of the marine protected areas along the municipality. Moreover, these tools presented issues and problems, and its underlying causes. The identified issues and problems are among the bases in coming up with this action. The strategies and action points are well-chosen to properly respond the these issues and problems especially with the term of the Bindoy Pride Campaign. How The coastal communities of Bindoy, thru the facilitation of the Office of the Mayor, Office of the Municipal Agriculturist (OMA) and Municipal Planning and Development Coordinator Office conducted a participatory coastal resource assessment to determine the problems and issues in the coastal communities. It was found out that illegal fishing was the main cause of the degradation of marine our marine resources, resulting to low fish catch among fishermen of the municipality. However, in order to move beyond the campaign period, this action plan is finalized in consultation with the Bindoy Pride Campaign Team to fit it to the action agenda of the local government unit on MPA protection. • Describe how the plan should be implemented In pursuance to section 16 of R.A. No. 8550, or the Philippine Fishery Code of 1998, the municipal government of Bindoy, through the Local Chief Executive, is mandated to take steps in effecting appropriate conservation, protection, and development measures for the marine and coastal resources especially on marine protected areas under its jurisdiction. Knowing that MPA Plan implementation is so challenging, working together with our stakeholders especially the campaign team members and the management committee shall be an utmost priority. This is to engage them fully and to take their share in the actual management of the marine protected areas. Serves as the covenant document of Bindoy Pride Campaign, this plan ensure the integration of governance and social marketing activities. The full implementation of this action plan should be in accordance to existing local government regulations and to any agreement set forth by the management committee.Thus, coordination and cooperation among partners involved in Bindoy Pride Campaign is very much recognized, in order to attain an effective and efficient implementation of this action plan. This is the reason why LGU-Bindoy took bold steps to avail of the World bank funded Community-Based resource management Project (CBRMP), wherein one of the components is coastal natural resources management The component has two management strategies, the marine sanctuary establishment and the mangrove rehabilitation and reforestation. The fisher folk federation is optimistic that they will achieve the objective of sustainable productivity from implementing these strategies in the future. II. Objectives of the Plan (not more than 150 words) Narrative or bullets relative to the purpose and objectives of the plan relative to your campaign The Governance and Enforcement Monitoring Action Plan is improving the management of the Bindoy Marine Protected Areas. Specifically, this plan aims to the following: A. Respond the issues and problems, and its underlying causes to improve the management of the Bindoy Marine Protected Areas. B. Improve the capacity and creativity of the local government unit and the management committee to manage a marine protected area, thus, improve the management effectiveness of the MPAs; C. Establish sustainable livelihood and other income generating activities; D. Establish infrastructure support and proper enforcement system coupled with complete logistics for the protection of marine resources and more particularly Bindoy MPAs. E. Engage all concern agencies and NGOs to undertake trainings and symposium that involve marine resources conservation and livelihood so that our fishers and the coastal communities will acquire knowledge and experience on it. F. To implement effective reporting mechanism especially on infractions and illegal activities and to track other important milestones on MPA governance crucial to removing the barriers to behaviour change. III. Plan Implementation Mechanisms (not more than 500 words) • Describe how the plan will be implemented The Governance and Enforcement Monitoring Action Plan will be implemented following this implementation schemes: A. Guarding and Patrolling Schemes 1. Eight (8) municipal paid fish warden personnel supported by the PNP-PEDO will conduct seaborne patrol operations on all coastal barangays on board the LGU Patrol Boat at random basis. 2. Five (5) PO sea rangers per marine sanctuary, a total of thirty (30) personnel will be given honorarium from the barangays concerned. They will protect their respective barangay marine sanctuary, on guard 24 hours a day at 3 shifts/day or 8 hours/personnel. B. Reporting System 1. Fish wardens in-charge of protecting their respective MPAs will be equipped with handheld radio or cell phones for effective communication direct to PEDO; 2. A weekly reporting system on activities, legal or illegal, will be submitted to the ENRO; 3. Each marine sanctuary must have individual logbook or record book which will be used as entries of daily activities as well as turn-over of post during relieving time; 4. Utilize intelligence network to all coastal barangays for effective identification of illegal fisher and MPA intruders. • Describe who will be involved in the implementation The LGU-Bindoy is encountering new opportunities to improve our understanding of the marine resources, how it works, and how we can expand our use of the said resources while maintaining its health and resilience and understand the functional relationship of our existing three-in-one marine ecosystem and how they influence and are influenced by local fishers’ activities. Implementation of this knowledge will inform locally-driven management practices and will improve and maintain the health of the ecosystem, support economic opportunities and enhance the LGU’s food security, and help preserve the god’s perfect creation as a treasured resource. Provide regular report to ENRD on activities conducted •Describe how you will evaluate your progress Primarily, the progress of the implementation of this plan will be evaluated by the of Municipal Environment Natural Resources Office (MENRO) and other concern offices. The management committee as well, will evaluate the progress through proper monitoring and supervision of the MPA activities in their respective areas of concern if have been implemented effectively. The Conservation Fellow together with the Bindoy Campaign Team will be communicating the progress of this plan the office of the Municipal Mayor, RARE and other partners to best inform the partnership relationships.
