The Dublin Transport Authority Act 2008 (DTA Act) and the Public Transport Regulation Act 2009 (PTR Act) are the enabling legislation for the Authority. Major parts of both Acts were commenced on the 1st December 2009 and throughout 2010 and 2011 various Statutory Instruments were put in place extending the powers of the Authority. On 1st January 2011 the Commission for Taxi Regulation was assimilated and this significantly increased the remit and size of the Authority. The legislation governing this industry was updated in the Taxi Regulation Act 2013 and the Taxi Regulation Act (Small Public Service Vehicle) Regulations 2015. In addition to its statutory responsibilities, the Authority discharges many functions on behalf of the Department of Transport, Tourism and Sport to include: Regional cities traffic management; Public Bikes Schemes; Rural Transport Programme; Integration of local/rural transport; National Accessibility Programme (and reporting/delivery obligations under Department of Transport Tourism and Sport, Sectoral Plan ‘Transport Access for All’ 2012 Edition); Smarter Travel Workplaces and Campuses; Smarter Travel Schools Programme; Oversight of Irish Rail Infrastructure Manager Contract; and National Enforcement Body rail, bus and ferry passenger rights The statutory role of the Authority as an integrating body working across all modes of public transport and all forms of operation places it in a unique position to deliver major high- Compliance Officer National Transport Authority 3 profile customer focused projects such as real time passenger information, the national journey planner, the Leap card and the redesign of the public service obligation routes of Dublin Bus and Bus Éireann. In 2015, the Vehicle Clamping Act was passed by the Oireachtas which confers further regulatory functions on the Authority. About the Position Section 40 of the Taxi Regulation Act 2013 allows for the appointment by the Authority of an Authorised Person (Compliance Officer) for the purpose of ensuring compliance by operators with all small public service vehicle (SPSV) regulations. The Compliance Officer will form an integral part of the National Transport Authority’s team based at Harcourt Lane, Dublin. The role requires that a Compliance Officer must undertake proactive, on street compliance work to detect any breaches of statutory requirements and the individual must be prepared to work at any location throughout the country. The role will include road-side checks of SPSVs and their drivers, inspections of premises connected to the provision of SPSV services and also working alongside staff from other enforcement agencies to ensure compliance with all regulations. Compliance Officers will also be required to issue Fixed Payment Notices where a breach of regulations has been identified. Where necessary, the role of Compliance Officer requires the accurate recording and presentation of evidence required to bring prosecution proceedings to successful completion. This will include preparation for and attendance at court and the giving of detailed and accurate oral evidence before the judge. The Compliance Officer’s duties will include the investigation, and the bringing to a successful conclusion, of consumer complaints received by the Authority. In addition, officers will fulfil an educational role for drivers, operators, passengers and the general public to ensure maximum compliance. The post requires attendance for duty at irregular hours, including night time and week-ends, nationwide. However, the majority of the work will be based within the Greater Dublin Area. Key responsibilities of Compliance Officers will include: Undertaking regular and on-going compliance checks and audits of SPSV vehicles, drivers and dispatch operators; Identification and investigation of offences and potential offences under legislation relating to SPSVs and their drivers and passengers; The collection, recording and processing of evidence and evidential exhibits; The compilation and presentation of case files to prosecution level, together with regular court attendances nationwide; Compliance Officer National Transport Authority 4 Investigating, recording and resolving complaints from passengers, intending passengers, drivers and operators of SPSVs and the general public; Effective use of the Authority’s IT systems to record all compliance activity undertaken and assist in on-going compliance activity; The assessment of compliance information, including the most appropriate and effective response and the ability to report on such assessments to assist the Authority’s overall compliance strategy; Working with the Gardaí and other enforcement agencies to enforce small public service vehicle and driver legislation; Provision of advice and support to drivers and passengers of SPSVs and other agencies in relation to the Authority’s activities; Day-to-day management of routine administration and reporting functions relating to compliance and complaints; Adherence to all legal and administrative requirements relating to the post; Assisting with the administration and management of the Authority’s regulatory, licensing and administrative functions; Any other duties as may be assigned by the Authority. ESSENTIAL REQUIREMENTS: Character: Each candidate must be of good character. Health : Each candidate shall be in a state of health such as would indicate a reasonable prospect of ability to render regular and efficient service. Education, Experience etc.: Each candidate must satisfy the following: a) Have a minimum of a NFQ Level 4 Certificate (Leaving Certificate / equivalent or higher); b) Applicants must have a current and valid full driving licence for the driving of cars (Category B vehicles); c) Have investigatory and/or compliance experience; and d) Have experience of prosecutions. DESIRABLE ATTRIBUTES: A good knowledge of public service policies, services and activities, or the ability to quickly acquire such knowledge. Note: The functions and responsibilities assigned to this position are based on the current stated role and may be changed from time to time. The person appointed requires the flexibility to fulfil other roles and responsibilities at a similar level within the Authority. EMPLOYMENT CONDITIONS: Eligibility to Compete Candidates should note that eligibility to compete is open to citizens of the European Economic Area (EEA). The EEA consists of the Member States of the European Union along with Iceland, Liechtenstein and Norway. Incentivised Scheme for Early Retirement (ISER): It is a condition of the Incentivised Scheme for Early Retirement (ISER) as set out in Department of Finance Circular 12/09 that retirees, under that Scheme, are debarred from applying for another position in the same employment or the same sector. Therefore, such retirees may not apply for this position. Collective Agreement - Redundancy Payments to Public Servants: Compliance Officer National Transport Authority 6 The Department of Public Expenditure and Reform letter dated 28th June 2012 to Personnel Officers introduced, with effect from 1st June 2012, a Collective Agreement which had been reached between the Department of Public Expenditure and Reform and the Public Services Committee of the ICTU in relation to ex-gratia Redundancy Payments to Public Servants. It is a condition of the Collective Agreement that persons availing of the agreement will not be eligible for re-employment in the public service by any public service body (as defined by the Financial Emergency Measures in the Public Interest Acts 2009 – 2011) for a period of 2 years from termination of the employment. Thereafter the consent of the Minister for Public Expenditure and Reform will be required prior to re-employment. People who availed of this scheme and who may be successful in this competition will have to prove their eligibility (expiry of period of non-eligibility) and the Minister’s consent will have to be secured prior to employment by any public service body. Department of Health and Children Circular (7/2010): The Department of Health Circular 7/2010 dated 1 November 2010 introduced a Targeted Voluntary Early Retirement (VER) Scheme and Voluntary Redundancy Schemes (VRS). It is a condition of the VER scheme that persons availing of the scheme will not be eligible for reemployment in the public health sector or in the wider public service or in a body wholly or mainly funded from public moneys. The same prohibition on re-employment applies under the VRS, except that the prohibition is for a period of 7 years, after which time any reemployment will require the approval of the Minister for Public Expenditure and Reform. People who availed of either of these schemes are not eligible to compete in this competition. Department of Environment, Community & Local Government (Circular Letter LG(P) 06/2013) The Department of Environment, Community & Local Government Circular Letter LG(P) 06/2013 introduced a Voluntary Redundancy Scheme for Local Authorities. In accordance with the terms of the Collective Agreement: Redundancy Payments to Public Servants dated 28 June 2012 as detailed above, it is a specific condition of that VER Scheme that persons will not be eligible for re-employment in any Public Service body [as defined by the Financial Emergency Measures in the Public Interest Acts 2009 – 2011 and the Public Service Pensions (Single Scheme and Other Provisions) Act 2012] for a period of 2 years from their date of departure under this Scheme. Thereafter, the consent of the Minister for Public Expenditure and Reform will be required prior to re-employment. These conditions also apply in the case of engagement/employment on a contract for service basis (either as a contractor or as an employee of a contractor). Declaration: Applicants will be required to declare whether they have previously availed of a public service scheme of incentivised early retirement. Applicants will also be required to declare any entitlements to a Public Service pension benefit (in payment or preserved) from any other Public Service employment and/or where they have received a payment-in-lieu in respect of service in any Public Service employment. Compliance Officer National Transport Authority 7 Remuneration: Salary Grade : Executive officer Salary Scale : €27,464 - €47,975 Unsocial Hours Allowance: €8,175 per annum Annual Leave: 23 days per annum. This leave is on the basis of a five day week and is exclusive of the usual public holidays. Note: entry will be at the minimum point of the scale and will not be subject to negotiation the rate of remuneration may be adjusted from time to time in line with Government pay policy different pay and conditions may apply, if, immediately prior to appointment, the appointee is already a serving Civil Servant or Public Servant Contract: Permanent Contract Probation: There is a 6 month probationary period which may at the discretion of the CEO be extended to 12 months. Training: Specific training in the interpretation of relevant legislation and other skills will be provided. Note: Compliance Officers will be prohibited from having any personal or financial interest in the SPSV sector from the date of appointment with the Authority or engaging in any other profession or business. Superannuation: The successful appointee will be offered public service pension terms and retirement age conditions in accordance with pension arrangements in the NTA depending on the status of the successful appointee: In general, an individual who has no prior pensionable Public Service history in the 26 weeks prior to appointment will be a member of the Single Public Service Pension Scheme (Single Scheme) which commenced from 1 January 2013 (Section 10 of the Public Service Pensions Compliance Officer National Transport Authority 8 (Single Scheme and Other Provisions) Act 2012 refers.
