Public Notice
The Land & Estate Department of North DMC intends to invite sealed tenders
from general public i.e. individual person, firm, Pvt. Ltd. Co., Ltd. Co., Regd. Coop.
Society for allotment of built up flats/shops/office units on monthly license fee
basis, on the terms and conditions mentioned in the documents available accessed
through MCD’s website www.mcdonline.gov.in.
1. The allotment shall be made in favour of the highest bidder at the monthly license
fee mentioned in the tender form.
2. The allotment shall be initially for period of 5 years, extendable at the discretion of
the Commissioner, North DMC.
3. Interested person(s) are required to submit the earnest money equivalent to six
months’ license fee as mentioned in the column in the list of properties in the form
of Bank Draft in favour of Commissioner, North DMC along with the tender form.
4. Interested person(s) can obtain the tender documents from the office of Addl. Dy.
Commissioner, Land & Estate Department, North DMC, 7th Floor, SPM, Civic Centre,
Minto Road, New Delhi - 110002 on payment of Rs. 500/- as tender cost or may be
downloaded from the MCD’s website www.mcdonline.gov.in and to pay the cost of
tender document while submitting the tender form at the same address.

General Terms & Conditions for allotment of Shops/Stalls/Kiosks/Office Unit/Office-Cum-Show Room etc.
on monthly license fee basis under the control of North Delhi Municipal Corporation.
1.
The premises will normally be allotted to the tenderer/highest bidder who offers the highest amount of monthly
license fee but the Commissioner, NDMC, reserves the right to reject the highest offer or all the offers without
assigning any reason.
2.
The monthly license fee offered in the tender in appropriate column should be in round figures and also in words
duly covered by the transparent cello tape. If any such tender/bid is received and it is decided to accept his
tender/bid, the allotment will be made at the round figure by taking 0.50 paise and above as one rupee and
ignoring 0.50 paise and less.
3.
The North Delhi Municipal Corporation will be responsible for maintenance of services i.e. lifts, sweeping,
lighting, public conveniences, common passages etc. and repair and maintenance of the building wherever
available. No claim shall, however, be made against North Delhi Municipal Corporation in connection with
maintenance of services or the building in circumstances beyond their control. The services of lifts shall be
available according to the timings as finally decided by Commissioner, North Delhi Municipal Corporation
keeping in view the opening and closing hours under the Delhi Shop and Establishment Act.
4.
The successful tenderer/bidder will have to execute a license deed as per form attached and shall have to abide at
all times by the conditions imposed therein and he will have to deposit one month's license fee payable in
advance and a security deposit equivalent to six months license fee within seven days from the date of issue of
the acceptance letter. The security deposit is liable to be forfeited if any of the terms and conditions are violated.
This security amount is refundable or adjustable on request towards the license fee on the expiry of the license.
5.
The tenderer/bidder must not be a minor.
6.
A tenderer/bidder can apply for only one shop/kiosk/stall/office unit/office-cum-show room on one Tender
Form.
7.
The tender/bid will be considered valid :
(a) Only when the prescribed earnest money is a accompanied in the form of Bank Draft payable in favour of
Commissioner, North Delhi Municipal Corporation.
(b) In case the tender/bid is accepted the amount of the earnest money will be adjusted against the amount of the
security deposit, required as per clause 4 above. In other cases the Bank Draft will be returned.
(c) The earnest money of next three highest tenderers/bidders will be refunded only after the
shop/kiosks/stall/office unit/office-cum-show room allotted and accepted by the highest tenderer/bidder.
8.
Failure to accept allotment by complying with all the requirements of allotment letter within the stipulated period
mentioned in the clause 4 above, shall entail forfeiture of the aforesaid earnest money in full.
9.
The tenderers/bidders will not be allowed to withdraw their offers upto 45 days from the date of opening of
tenders/bids. In case they do so it shall entail forfeiture of the aforesaid earnest money in full.
10.
The allotment will be made for a period of five years in the first instance and the extension of allotment for
further period will be at absolute discretion of the Commissioner, North DMC.
11.
The licensee shall be bound to utilise the plots/shop/stall/kiosk only for the purpose of trade after obtaining
license which may be necessary under the provisions of the DMC Act or any Bye-laws made there under or any
other law in force for the time being. No offensive, dangerous, nuisance creating trades like repairing of auto car,
auto cycle-scooter, manufacturing, cooking etc. or any other trades not considered desirable by the
Commissioner shall be carried out. In case of office unit/office-cum-show room, the licensee shall not undertake
the retail sale of their products. He will only use it for the display of products.
12.
The successful bidder/tenderers shall submit the photo state copy of their proof of residence & office (if any),
copy of ID proof, copy of Pen Card, E-mail address and details of Bank Accounts.
13.
Any tenderer/ bidder who is already associated with the North Delhi Municipal Corporation in any manner and
found in default in respect of pending dues of North Delhi Municipal Corporation shall not be eligible to
participate in tenders. In case at later stage if any such information come to the notice the allotment will be
cancelled and the security amount shall be forfeited without any notice.

Indian Stamp Act to be borne by the Licensee.
WHEREAS the North Delhi Municipal Corporation is the exclusive owner of the land/building/shops/kiosks
situated at ____________________________________________________ free from all encumbrances and is
competent to hold/lease/license the said ______________________________________ in the manner as may be
specified from time to time.
AND WHEREAS The North Delhi Municipal Corporation vide its Resolution No. __________________
dated ___________ has decided to allot / extend on license fee basis the same premises through tenders / mutual
agreement and in performance thereof and in performance thereof inviting tenders / by mutual agreement

The licensee shall be deemed to be a bare licensee having only a personal right in the said premises and
nothing herein contained shall be deemed to be a demise at law of the said premises or any part thereof so
as to give the licensee any interest therein.
2.
The license is purely temporary and the North Delhi Municipal Corporation reserves the right to revoke it
at any time by giving three months notice in writing without assigning any reason to the licensee.
3.
That the allotment/license of the premises shall only permit the licensee to occupy and use the premises
till the expiry of the period of license or termination, whichever is earlier, without assigning any reason
whatsoever.
4.
The right of licensee shall be the right of the user only and not of possession and the North Delhi
Municipal Corporation reserves the right of re-entry as mentioned above and no possession will be
deemed to have been transferred to the licensee.
5.
The licensee has deposited Rs. ______________________ vide G-8 receipt No. ________________ dated
_________________ a sum equivalent to six months license fee as security amount and shall keep the
same deposited till the expiry of the license or termination whichever is earlier. This security is liable to be
forfeited if any of the terms and conditions herein contained is contravened or violated.
6.
In the default to pay the license fee of Rs. ______________________ per month as agreed before the 10th
day of the month to which it relates the licensee shall pay interest which will form part of license fee @
18% per annum on the arrears of the license fee from the 1st day of the month i.e. from the month in
respect of which the default in payment takes place till the date prior to the effective date of determination
of license. In case the license fee remains unpaid for 3 months, the license will be cancelled. The interest
@ 7.5 % per month over and above the existing license fee, maintenance charges and interest due before
the effective date of determination of license shall be payable by the licensee till the date of payment.
The Commissioner, North Delhi Municipal Corporation may, however, on receipt of request and
clearance of all the dues mentioned above, restore the license on the existing license fee or on such
conditions as may be fixed by the Commissioner at his absolute discretion.
7.
The licensee shall be liable to be rejected from the land/building/shop/kiosk/office/office-cum-show room
for default of payment of license fee or breach of any terms as provided hereinbefore.
8.
If the license fee hereby reserved or any part thereof shall at any time be in arrears or remain unpaid after
the due date or if the licensee at any time fails or neglects to perform or observe any of the terms and
conditions and covenants herein contained and on his part to be observed and performed and in any such
case the Corporation may without prejudice to their other rights by giving thirty days notice in writing to
the licensee, determine the license and re-enter upon the said premises or in part thereof. The licensee
shall upon such determination peacefully stop use of the said premises without any right to compensation
whatsoever and thereupon this license shall be absolutely determined without prejudice to any antecedent
breach of terms and conditions and covenants on the part of licensee. The license shall stand ipso-facto
terminated without any right to compensation whatsoever to the license in any of the following events that
is to say :(i)
If the licensee(s) being an individual or if a firm, any partner in the licensee firm shall die or at any
time be adjudged insolvent or shall have a receiving order or for administration of his estate made
against him or shall take any proceedings for liquidation or composition under any Insolvency Act,
for the time being inforce or make any conveyance or assignment of his effects or enter into any
arrangement or composition with his creditors or suspend payment or shall introduce a new partner
or shall change the constitution of the partnership or if the firm be dissolved under the Partnership
Act.
OR
(ii)
If the licensee(s) being a company shall pass resolution or the court shall make an order for the
liquidation of is affairs or a receiver or manager on behalf of the debenture holders shall be
appointed or circumstances shall have arisen which entitle the court of debenture holders to appoint
a receiver or manager.
Provided always that such determination shall not prejudice any right of action or remedy which
shall accrue or shall accrue thereafter to the North Delhi Municipal Corporation.
9.
The licensee shall with reference to the said premises in his/her use bear all charges for electricity and
water consumption.
10. The licensee shall not carry out any addition or alteration to the building and or any additional
construction on the land/back courtyard than what has been permitted as aforesaid or electrical or sanitary
installation in the said premises.
If any additions, alterations or constructions are required by the licensee a request to this effect may
be made in writing to the Commissioner, North Delhi Municipal Corporation who may either reject such a
request or consider the same on such terms and conditions as may be deemed appropriate. Where any such
addition, alteration, construction etc. are ultimately carried out on payment of extra license fee, the
licensee shall not be entitled to remove the same or claim any compensation whatsoever in respect of the
same at the time of vacation of the said premises.
11. The licensee shall make good any damage caused to the premises normal wear and tear being excepted.
The decision of the Commissioner, North Delhi Municipal Corporation on the question whether any
damage is caused to the premises and what amount of compensation would make good such damages be
final and binding on the parties hereto.
12. The licensee shall not permit the said premises or any part thereof being used by another person for any
purposes whatsoever without the previous consent in writing of the Commissioner, North Delhi Municipal
Corporation and in default thereof shall be liable for forfeiture. The licensee shall not introduce any
partner nor sell and transfer user of the premises or part thereof or otherwise carry on the business in the
premises with any other person or assign, transfer, change or otherwise alienate his use of the premises.
13. The licensee shall give at least (3) three months notice in writing of de-using the said premises or pay (3)
three months license fee in lieu of notice period in case immediate possession is handed over. The licensee
shall pay the arrears of the license fee if any before de-user and in default render himself liable to be used
for recovery of arrears and necessary legal expenses.
14. The licensee shall be bound to utilize the shop/stall/kiosk only for the purpose of trade after obtaining
license which may be necessary under the provisions of the DMC Act or any Bye-laws made thereunder
or any other law inforce for the time being. No offensive, dangerous, nuisance creating trades like
repairing of auto-cars, auto-cycle-scooter, manufacturing, cooking etc. or any other trades not considered
desirable by the Commissioner shall be carried out.
In case of office unit/office-cum-show-room, the licensee shall not undertake the retail sale of their
products. He will only use it for the display of products.
15. The licensee shall keep the verandah, compound, lane or by-lane, passage clear and free from obstruction
and encroachments at all time, failing which the North Delhi Municipal Corporation shall be entitled
forthwith to determine the license without assigning any reason and without service of the notice to the
licensee.
16. The sign board/name plates shall be put up in the form and design dimensions approved by the
Commissioner, North Delhi Municipal Corporation.
17. Any notice to be given to the licensee under terms of this license shall be considered to be duly served if
the same shall have been affixed on the outer door or any other conspicuous part of the said premises.
18. The licensee shall fulfill and abide by all the provisions of Delhi Municipal Corporation Act, bye-laws,
rules and regulations made thereunder and the provisions of the Delhi Shop and Establishment Act and
those of any other laws for the time being inforce.
19. The licensee shall fulfill and diligently comply with all the directions general or special issued by North
Delhi Municipal Corporation from time to time.
20. The North Delhi Municipal Corporation will be responsible for maintenance of services i.e. lifts,
sweeping, lighting, public conveniences, common passages etc. and repair and maintenance of the
building wherever available. No claim shall, however, be made against North Delhi Municipal
Corporation in connection with maintenance of services or the building in circumstances beyond their
control. The services of lifts shall be available according to the timings as finally decided by
Commissioner, North Delhi Municipal Corporation keeping in view the opening and closing hours under
the Delhi Shop and Establishment Act.
21. The over-all control and supervision of the premises licensed out shall remain vested in the North Delhi
Municipal Corporation whose officials shall at all reasonable hours be entitled to inspect the premises with
respect to its bonafide use and in connection with fulfillment of other terms and conditions of the license.
22. The period of license will be five years or on termination of the license whichever is earlier from the date
of the taking over the premises, and the extension of allotment for further period will be at the absolute
discretion of the Commissioner, North Delhi Municipal Corporation.
23. The stamp duty on this deed is borne by the licensee.
