CCGA Additional Terms and Conditions
1.
Bid responses containing a minimum order/ship quantity or dollar value, unless otherwise called for in the
request for quote, will be treated as non-responsive and will not be considered for award.
2.
Any cash discount offered to COLLEGE OF COASTAL GEORGIA must be clearly shown in the space
provided on the Request for Quote. Cash discounts offered from one (1) percent up to five (5) percent for
payment in thirty (30) days or more, will be considered for the purposes of evaluation.

Bidders are instructed to remove or strike through any
reference to this provision in or on vendor printed forms and to initial changes prior to submitting a bid

3.
All cash discounts offered will be taken if earned. In the event that COLLEGE OF COASTAL GEORGIA is
entitled to a cash discount, the period of computation will commence on the date of delivery, or receipt of a
correctly completed invoice indicating the discount, whichever occurs later.
If COLLEGE OF COASTAL
GEORGIA is entitled to a discount under the contract, but the invoice does not reflect the existence of a
cash discount, and COLLEGE OF COASTAL GEORGIA pays the invoice, it shall be entitled, upon demand,
to credit in the amount of such discount. Payment of invoices owed by COLLEGE OF COASTAL GEORGIA
shall be made whenever possible within 30 days of the receipt of a correct invoice or goods, whichever is
later, unless otherwise provided for in terms and conditions attached to this Request for Quote or in the
resulting contract.
Unless otherwise specified in terms and conditions attached to this Request for Quote,
prices quoted must be based upon payments within 30 days. Terms requiring payment in less than 30 days
will be considered as non-responsive and the bid will not be considered for award.
4.
All bid responses received will be F.O.B. destination.
Vendor may, however, charge back freight and
insurance. In such event, Vendor shall state the exact amount of freight and insurance charges or a "shall
not exceed" amount.
5.
Unless otherwise specified, any reference to brand names, model numbers or other descriptions peculiar to
specific brand products is made to establish a required level of quality and functional capabilities. It is not
intended to exclude other products of that level.
Comparable products of other manufacturers will be
considered if proof of comparability is contained in the bid.
It shall be the responsibility of the bidder(s),
including the bidder whose product is referenced, to indicate the brand name and model or series number
of the product offered and to furnish with their bid such specifications, catalog pages, brochures, or other
data that will provide an adequate basis for determining the quality and functional capabilities of the product
offered. COLLEGE OF COASTAL GEORGIA
reserves the right to request samples of any bidders prior to
bid award. Failure to provide this data may be considered valid justification for rejection of bid.

6.
COLLEGE OF COASTAL GEORGIA reserves the right to:
A.
Award bids received on the basis of individual items or groups of items; and reject any or all bids or
any part thereof; and waive any minor irregularity in the bid; and accept the bid that is in the best
interest of COLLEGE OF COASTAL GEORGIA.
B.
Request a Performance Bond.
C.
Request that bidder furnish proof that he/she is the manufacturer or one of the manufacturer's
authorized dealers or distributors and is capable of providing warranty services on all items delivered.
When a manufacturer's certificate or evidence of authorized distributorship is required, it shall be dated
not more than thirty (30) days prior to the date of the bid opening.
7.
Bidder makes this quote in accordance with the terms and conditions specified on this Request for Quote
and in accordance with the terms and conditions of the Georgia Vendor Manual, which is incorporated
herein by reference and made a part of this bid and any resulting contract with COLLEGE OF COASTAL
GEORGIA. In the event of conflict between the terms and conditions specified in this Request for Quote and
those contained in the Georgia Vendor Manual, the former shall govern.
Unless a specified exception is
noted by the bidder and accepted by COLLEGE OF COASTAL GEORGIA, all provisions of these terms and
conditions and all of the contract terms contained in the Georgia Vendor Manual will become a part of any
contract or order awarded.
All exceptions must be clearly noted in a separate section of Vendor's bid
entitled "Exceptions".
8.
By submission of this bid, the bidder offers and agrees, if this offer is accepted, to furnish and deliver any or
all of the goods and services indicated herein, at the price set opposite each item.
9.
Items on bid are exempt from federal excise tax and Georgia sales and use tax.
10.
Title shall pass to COLLEGE OF COASTAL GEORGIA
only upon actual receipt and acceptance of the
items by the User Agency.
11.
COLLEGE OF COASTAL GEORGIA shall not be bound to any terms and conditions included in any Vendor
packaging, invoice, catalog, brochure, technical data sheet, or other document which attempts to impose any
condition in variance with or in addition to the terms and conditions contained herein.
12.
In the event there is a discrepancy between the unit price and the extended price, the unit price shall

govern.
13.
Unless otherwise specified in terms and conditions attached to this Request for Quote, prepayment and/or
progress payment requirements contained in bid responses will be treated as non-responsive and the bid will
not be considered for award.
14.
Drug Free Workplace
A.
If Contractor is an individual, he or she hereby certifies that he or she will not engage in the
unlawful manufacture, sale, distribution, dispensation, possession, or use of a controlled substance
or marijuana during the performance of any contract resulting from this Request for Quote.
B.
If Contractor is an entity other than an individual, it hereby certifies that:
(1)
A drug-free workplace will be provided for the Contractor's employees during the
performance of any contract resulting from this Invitation to Bid; and
(2)
It will secure from any subcontractor hired to work in a drug-free workplace the following
written certification:
"As a part of the subcontracting agreement with (contractor's name)
_____________(subcontractor's name) _____________________certifies to the contractor
that a drug-free workplace will be provided for the subcontractor's employees during the
performance of this contract pursuant to paragraph 7 of subsection B of Code Section 5024-3."
C.
Contractor may be suspended, terminated, or debarred if it is determined that:
(1)
The Contractor has made false certification hereinabove; or
(2)
The Contractor has violated such certification by failure to carry out the requirements of
Official Code of Georgia Section 50-24-3.
15.
Reciprocal Preference Law - For the purposes of bid evaluation only, Vendors resident in the State of
Georgia will be granted the same preference over Vendors resident in another State in the same manner, on
the same basis, and to the same extent that preference is granted in awarding bids for the same goods and
services by such other State to Vendors resident therein over Vendors resident in the State of Georgia.
NOTE: For the purposes of this law, the definition of a resident vendor is one who maintains a place of
business with at least one employee inside the State of Georgia. A post office box address will not satisfy
this requirement.
It is the policy of the State of Georgia that minority business enterprises shall have the maximum opportunity to

participate In the State purchasing process. Therefore, the State of Georgia encourages all minority businesses to
compete for, win and receive contracts for goods, services, and construction.
Also, the State encourages all
companies to sub-contract portions of any State contract to minority business enterprises. For information, contact
the State Small and Minority Business Coordinator referenced below.
Minority Business: A business is defined as a minority business if a) it is owned by a member of a minority race or
b) is a partnership of which a majority of interest is owned by one or more members of a minority race or c) is a
public corporation of which a majority of the common stock is owned by one or more members of a minority race. A
member of a minority race is defined as an individual who is a member of a race which comprises less than 50
percent of the total population of the State of Georgia.
Bidders interested in taking advantage of the Georgia Income Tax incentives provided for by the Official Code of
Georgia Annotated 48-7-38, relative to the use of minority subcontractors in the performance of contracts awarded
