Article III of the US Constitution Overview of Article III Article III has to do with the Judicial Branch. Judicial Branch- studies and interprets laws. The Framers chose to write Article III in the Constitution because they agreed that neither the president nor Congress should control the national Court System. The Article caused the creation of the Supreme Court. Supreme Court-has the final decision in any cases concerning the constitution. “Good Behavior”- interpreted to mean that judges may serve for the remainder of of their lives, although they may resign or retire voluntarily. “Constitutional Courts”- Article III Courts. Article III Section I The Judicial Power of the United States, shall only be put in one Supreme Court and other courts established by Congress. The present number of justices in the Supreme Court is nine. Constitutional Courts were first established by the Judiciary Act of 1789. Article III courts are the only courts with Judicial Power. Judges of both Supreme and inferior Courts shall hold their offices during good behavior and receive for their services a compensation which shall not be diminished during their continuance in office. Article III Section II The Judicial Power shall extend to all Cases, in Law and Equity, arising under the Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority. In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. Trial of all crimes, except in Cases of Impeachment, shall be by Jury. Article III Section III Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.
