If the Borrower’s PITI is less than 20%, assistance will not be available from the City of Clearwater. SECTION 2 – MAXIMUM INCOME LIMITS (EFFECTIVE 4/10) The current combined gross annual household income from all sources cannot exceed the most current (adjusted annually) limits set by HUD for Pinellas County. City of Clearwater: The Borrower is not required to be a First-Time HomeBuyer to qualify for Assistance, but they cannot own another property at the time of application. In addition, they cannot have received Assistance from the City of Clearwater within the past 5 years. Unincorporated Pinellas County (which is defined as all areas outside of the city limits of Clearwater, Largo and St. Petersburg): The Borrower is not required to be a First-Time HomeBuyer. It is preferred that the Borrower not own property at the time of application. If the Buyer does own a property, CDC must verify that this property will be sold or rented (with a copy of either the Sales Contract or Lease), and that the new property being purchased will be the Buyer’s primary residence. If the Buyer will be leasing a property, the full amount of monthly rent must be included in the Buyer’s Annual Household Income. If the Borrower has ever received Assistance from Pinellas County, they are ineligible to receive assistance again. (B) RESIDENCY REQUIREMENTS: Must be a US Citizen or a Permanent Resident Alien. For purposes of this Program, the State of Florida defines a “Qualified” Alien as someone who is lawfully admitted for permanent residence under the Immigration and Naturalization Act (possessing a Resident Alien / Green Card). If any Adult Household Member is not a U.S. Citizen and has not yet received their Green Card, we cannot provide assistance. (C) BORROWER CONTRIBUTION REQUIREMENTS: City of Largo: The City will require the same contribution amount as the Lender, and it can come from any source that is acceptable to the Lender (i.e. from Assistance, from a gift, etc). If the Lender is not requiring the Borrower to contribute any funds, that will be acceptable to the City of Largo. City of Clearwater: The Borrower must contribute 2% of the Sales Price towards the transaction. This must be the Buyer’s own funds and cannot be from a gift or from costs paid by the Seller. Please note that payoff of debts, collections, POC items which have -3- been paid by another party, or items credited back at closing will not be applied towards the 2% requirement. In some cases the Lender’s contribution may be different than the City’s requirement. Unincorporated Pinellas County: A contribution totaling 2% of the Sales Price must be made. 1% of the required contribution can come from gift funds. If no gift is being used, then the full 2% must come from the Borrower’s own funds. PLEASE NOTE: The Gift Funds cannot come from the Seller or Realtors (as required by Pinellas County). (D) RECEIPT OF PRIOR ASSISTANCE: CITY OF CLEARWATER: Households that have been assisted with City funds within the past five (5) years are ineligible to receive funding again through any of the Housing Division’s Programs, unless there is some form of “hardship” as defined below. Hardship determination will be determined and approved on a case-by-case basis by the Assistant Director and/or Director of the Department. Examples of hardship: Divorce, Permanent layoff, physical or mental disability, fire, flood or natural disaster, death of a family member. UNINCORPORATED PINELLAS COUNTY: Households that have previously received downpayment assistance from the County are ineligible to receive assistance again. SECTION 4 - INCOME REQUIREMENTS AND CALCULATION OF ANNUAL HOUSEHOLD INCOME All Income and Assets must be verified, in writing. To be eligible for assistance, the Borrower’s total current combined gross annual household income from all sources cannot exceed the limits set by HUD for Pinellas County. What is included in household income? It means the total current annualized gross income (before taxes and withholding) of the purchaser and all adult members (over the age of 17) residing or intending to permanently reside in the residence (including spouse, fiancé, parent, relative, adult child, etc.). The income of all household residents will be considered regardless of: (a) (b) (c) (d) what type of income is being received, how long it has been received prior to application, whether or not the household member will take title to the property or be part of the mortgage transaction (i.e. non-purchasing spouse), whether or not the income is being used by the First Mortgage Lender. -4- Please be advised that the calculation of Annual Household Income by Tampa Bay CDC and its Pinellas County funding sources (i.e. City of Largo, City of Clearwater and Pinellas County) differs from the calculation of Qualifying Income by the First Mortgage Lender. Tampa Bay CDC is responsible for complying with all income requirements of Pinellas County, City of Largo and City of Clearwater as well as the requirements of the State of Florida funding sources (SHIP and HOME), while the Lender is responsible for complying with all income requirements associated with the first mortgage (as per the appropriate FNMA, FHLMC, HUD or VA guidelines). In calculating qualifying income, Secondary Market requirements will not consider certain types of income (i.e. Child Support that will stop in the near future, income from a part-time job recently begun, etc), and the Lender will average past earnings to determine income. In some cases, the Lender is also permitted to use “stated income”. In calculating Annual Household Income, Tampa Bay CDC does not look at prior earnings. Instead, the County, Cities and State require income to be based on current earning levels, and it must be annualized/projected forward for the next 12 months. Income must be verified, in writing, for all adults (over the age of 17) who will reside or intend to reside in the Property. Therefore, CDC cannot provide Assistance with First Mortgages that are based on “stated income”. If the income cannot be verified, the Borrower is not eligible for this program. Annual Household Income will be projected using the information contained on the written VOE form. (Please note that the State does not permit the use of Alternative Documentation - such as paystubs and W2s - to verify income). Annual Income will be calculated using current earnings unless the VOE shows that a raise will be received within the next 12 months. In these cases, annual income will be determined by calculating employment income at the current rate of pay until the estimated month of the raise and then calculating the income at the higher rate for the remainder of the 12-month period. For salaried employees or Borrowers earning other types of income (such as Social Security), the Annual Household Income should be calculated from the written Verification (i.e. VOE form, Pension Letter, etc) using one of the following methods: (a) (b) (c) (d) Multiply gross monthly income by 12 Multiply gross bi-weekly income by 26 Multiply gross weekly income by 52 Multiply gross hourly income by the number of hours worked per week, then multiply that result by 52 If the income cannot be calculated using one of the above-referenced formulas, or if the Borrower works varying hours, an monthly average of year-to-date earnings should be made, and that result should be multiplied by 12. For Borrowers who are self-employed, the Household Income will be based on the most recent quarterly income and expense statement from the Borrower. The net income on this report will be used to anticipate the amount the Borrower is expected to earn from their business in the next 12 months. -5- To calculate Household Income for a self-employed Borrower, multiply the net income from the past 3 months (as shown on the P&L statement) by 4. As noted earlier, Tampa Bay CDC and its Pinellas County Funding Sources are required to consider all sources of income, including but not limited to: (a) (b) (c) (d) (e) (f) (g) (h) The gross amount of wages from full and/or part-time employment Overtime pay, Bonuses, Commissions, tips, shift differential, etc. The full amount received from Social Security, Pensions, Disability Benefits, VA Benefits, Annuities, Retirement Income, Trust Income, Death Benefits, etc. (Please note that non-taxable income is not “grossedup”) Unemployment Compensation, Worker’s Compensation or Severance Pay Net Income from the Operation of a Business Child Support or Alimony Payments. (The only time child support or Alimony payments are not included in income is if the Borrower can provide proof that it has not been received (i.e. Court Printout) AND proof that they have taken action with the State’s Child Support Enforcement Department to collect the Support Any other type of income (i.e. dividend income, asset income, rental income, etc). Assets and Anticipated Interest and Dividend Income from Assets (If the Borrower has more than $5,000 in Assets, we must take 2% of that and add it to the Annual Income) SECTION 5 - DOCUMENTING HOUSEHOLD INCOME Income and Assets must be verified, in writing for all adults who will reside or intend to reside in the Property. Tampa Bay CDC is required to obtain written VOE and VOD forms, or other documentation necessary to verify income (i.e. Social Security letter, Pension Letter, etc). Please note that the use of Alternative Documentation - such as paystubs, W2s, bank statements - to verify income is not permitted in the Assistance Programs. While this is practice is acceptable to FNMA or FHA for first mortgage lending, it is not permitted by the State of Florida for Assistance Loans. All verifications must be date-stamped upon receipt, and they cannot be more than 90 days old at the time of Tampa Bay CDC’s Final Approval. (1) FULL-TIME OR PART-TIME EMPLOYMENT As required by the State, the primary method and form of verification for full-time or part-time income is through a WRITTEN VERIFICATION OF EMPLOYMENT (VOE) form. The Verification must pass directly between the Employer and Tampa Bay CDC. It may not be handled by the Borrower. The Verification is to be addressed to, -6- and completed by a specific department that normally verifies employment/personnel information (such as the Personnel Department, Payroll Department, etc). The verification cannot be more than 90 days old at the time of Tampa Bay CDC’s Final Approval. Adult Household Members who are not employed will be required to execute a notarized Declaration of No Income (2) SELF-EMPLOYMENT / BUSINESS INCOME In order to verify income from the operation of a business, Tampa Bay CDC is required to obtain the following documentation: (a) INDIVIDUAL TAX RETURNS/1040 FORMS, complete with all schedules, FOR THE PAST TWO YEARS. (Please note that Electronic Filing forms, W-2’s, or Telefile forms are not acceptable.) In lieu of the returns, CDC can accept IRS Form 1722 or an IRS Printout. You can contact the IRS at (800) 829-1040. (b) Corporation or Partnership Returns (if applicable), complete with all schedules, for the past two years. (c) A YEAR-TO-DATE FINANCIAL STATEMENT / PROFIT & LOSS STATEMENT (for the most recent quarterly period). A statement prepared by a Bookkeeper or Accountant is preferred. If the Borrower does not use an Accountant, then the Borrower must prepare the Income Statement and must also write a letter certifying that the P&L was self-prepared and no Accounting/ Bookkeeping services are used by their Business. (d) NOTARIZED STATEMENT FROM THE BORROWER ON THE NET AMOUNT THEY ANTICIPATE EARNING IN THE NEXT TWELVE MONTHS. (This amount should be consistent with earnings reported on the last 2 years’ tax returns. If the anticipated income is substantially higher or lower, a written explanation must be given for the difference). (3) SOCIAL SECURITY, PENSION INCOME, RETIREMENT BENEFITS, ETC. Social Security, Pension or Retirement Income/Benefits must be verified by an AWARD LETTER from the organization providing the income (i.e. Social Security Awards Letter). The letter must clearly state the amount of income, the frequency of receipt (i.e. monthly, quarterly), and how long it is expected to continue. The Award Letter/Verification cannot be more than 90 days old at the time of Tampa Bay CDC’s Final Approval. If over 90 days, the Borrower must obtain an updated letter from the organization providing the income. -7- (4) ALIMONY OR CHILD SUPPORT To evidence this income, the following documents must be obtained: (a) A complete copy of the DIVORCE DECREE (including Marital Settlement Agreement) AND/OR CHILD SUPPORT AGREEMENT (all pages) which shows the amount of support awarded, the frequency (i.e. weekly, monthly), and the period of time the Borrower is entitled to receive it. (b) Since all income documents must be dated within 90 days and it is likely that the Divorce Decree will be dated prior to 90 days, the Borrower must provide CURRENT PROOF OF RECEIPT OF THIS INCOME (i.e. a Court Printout dated within the last 90 days). NOTE: If the Child Support or Alimony is court-ordered, but the Borrower does not receive it regularly, it must still be included in Household Income unless the Borrower can show proof that they have begun proceedings with the State’s Child Support Enforcement Division against the Spouse who is not paying. If the Borrower has dependents but is not receiving any Support, they will be required to execute a notarized Child Support Affidavit. (5) OTHER INCOME Any other income that the Borrower receives (not mentioned above) must be included in the Annual Household Income, and it must be documented with a written verification showing the type of income, amount received, and frequency. The verification cannot be more than 90 days old at the time of Tampa Bay CDC’s Final Approval. (6) ANTICIPATED INCOME FROM ASSETS Assets to be verified when determining the eligibility of a Household shall include, but not be limited to the following: (a) Cash held in savings and checking accounts, safe deposit boxes, at home, etc. (b) Stocks, Bonds, Treasury Bills, Certificates of Deposit, Money Market Accounts, or any other investment accounts (c) Individual Retirement Accounts (IRAs), Keogh accounts, Trust Accounts, Retirement and Pension Funds, and other such accounts (d) Cash value of life insurance policies (e) Personal property held as an Investment / Equity in Real Estate Owned (f) Lump sum receipts or one-time receipts (g) Any other Assets not listed above As required by the State, the primary method and form of verification for Assets is through a WRITTEN VERIFICATION OF DEPOSIT (VOD) form. The Verification must pass directly between the Depository and Tampa Bay CDC. It may not be handled by the Borrower. The Verification is to be addressed to, and completed by a specific -8- department that normally verifies asset accounts, and it is to be completed and signed by an authorized representative of the Depository. The verification cannot be more than 90 days old at the time of Tampa Bay CDC’s Final Approval. If a third-party verification cannot be obtained after at least 3 attempts, the following documents may be used as a last resort: the most recent six (6) months’ complete bank statements. When Bank Statements are used as verification, the Borrower must submit the entire statement. It is not sufficient to provide only the first page which shows the beginning and ending balance. If the Borrower is receiving any gift funds, these must be documented with a copy of the Gift Letter and proof of receipt of the Gift (i.e. copy of the gift check, deposit slip, or bank statement). The Gift Letter must indicate the donor’s name, address, telephone number and relationship to the Borrower, specify the amount of the gift and when the funds were/ will be transferred to the Borrower, and a statement that no repayment is required. Tampa Bay CDC will provide the approved Gift Letter form for completion. PLEASE NOTE: Pinellas County will not accept a gift which comes from the Seller or Realtor(s), as this is not an arms-length gift. SECTION 6 - PROPERTY REQUIREMENTS (A) PROPERTY LOCATION: The property can be located anywhere in Pinellas County (except within the City limits of St. Petersburg). BEFORE FINALIZING WHICH ASSISTANCE PROGRAM TO USE, VERIFY THE JURISDICTION OF THE PROPERTY BY CALLING THE PROPERTY APPRAISER’S OFFICE AT 727-464-3207 OR BY VISITING THEIR WEBSITE AT WWW.PCPAO.ORG (B) SALES PRICE LIMITS: City of Clearwater: City of Largo: $ 145,000 $ 190,000 Unincorporated Pinellas County: $ 175,750 -9- (C) ELIGIBLE PROPERTY TYPES: Single-family residences, condominiums, or townhouses. INELIGIBLE PROPERTY TYPES: 2-4 family, rental properties, co-ops, manufactured and mobile homes, or properties built prior to 1978 that has peeling and/or chipping paint. If the property being purchased is occupied by a tenant who will be displaced so the loan can close, Tampa Bay CDC is unable to provide assistance. If the property is located in Largo, it cannot be in a Flood Zone. (D) INSPECTION REQUIREMENTS: EXISTING PROPERTIES: The property must meet the Section 8 Housing Quality Standards (HQS). An inspection is required to verify that the property meets applicable safety/code requirements. Tampa Bay CDC will order a Section 8 Safety/Code Inspection (from a City/County approved inspector). There is no charge to your Client for this inspection. If any of the Section 8 Standards are not met, these must be completed/corrected and re-inspected prior to closing. PLEASE NOTE: THIS CITY/COUNTY CODE INSPECTION DOES NOT REPLACE THE NEED FOR A HOME INSPECTION! Your Client is highly encouraged to hire their own inspector to perform a detailed home inspection. If they do choose to do so, this will be at their own expense. City of Clearwater properties only: If the property was built prior to 1978, the City will order a lead paint inspection. If lead paint is found, the property will be ineligible for assistance. NEWLY-BUILT PROPERTIES: Certificate of Occupancy must be provided in lieu of the Inspection Report. (E) The Property must be owner-occupied (no rental or second homes) (F) If the property being purchased is occupied by a tenant who will be displaced so the loan can close, Tampa Bay CDC will be unable to provide assistance. - 10 - (G) If the property was built prior to 1978 and there is evidence of peeling, chipping or chalking paint, the property will be ineligible for assistance. (H) Properties located within the City limits of Largo CANNOT BE IN A FLOOD ZONE. If they are located in a flood zone, they are ineligible for assistance. SECTION 7 - CREDIT GUIDELINES Tampa Bay CDC will require a copy of the Lender’s Credit Report. An in-file report or standard factual report from all three repositories is acceptable. (We typically will not pull another Credit Report if one has already been obtained by the Lender. We do not want to affect the Borrower’s Credit Score by having too many reports obtained). If the Credit is approved and accepted by the First Mortgage Lender, CDC will also accept the credit. The only exception to this is in the case of B/C Credit (since CDC cannot provide assistance to Borrowers obtaining above-market interest rates from B/C Lenders.) CDC will waive payoff of past due amounts and collections if it is waived by the First Mortgage Lender. CDC will only require payoff of those judgments or liens that could be attached to the property and take a superior position to the Assistance lien. SECTION 8 - MISCELLANEOUS REQUIREMENTS (A) The Programs and Security Instruments for the various Assistance Programs are HUDapproved, and CDC has a written Approval Letter from this agency. Should you need copies of these forms, please call our office. These forms can also be downloaded from the “Forms and Brochures” page of CDC’s website (www.tampabaycdc.org) (B) Assistance loans are secured by a subordinate mortgage placed on the subject property. (C) REPAYMENT TERMS: UNINCORPORATED PINELLAS COUNTY: These loans will allow for prepayment in full, or in part, at any time, without penalty. Pinellas County’s assistance is interest-free, and no payment is required for the first five years. Repayment will begin after five years and will be amortized over a period of five years (60 months). The maximum monthly payment is $83.33. - 11 - CITY OF LARGO: These loans will allow for prepayment in full, or in part, at any time, without penalty. Assistance Loans are interest-free, and payment will be deferred until the property is sold or rented, or until the first mortgage is paid or refinanced. CITY OF CLEARWATER: Assistance Loans are interest-free, and payment will be deferred until the property is sold or rented, or until the first mortgage is paid or refinanced. (E) The combined first and second mortgages should not exceed a combined LTV of 105% (F) RATIOS: Ratios will be based on total monthly household income (as calculated by CDC). CITY OF LARGO AND UNINCORPORATED PINELLAS COUNTY: The PITI / Housing Ratio should not exceed 33%. With compensating factors, this ratio can be slightly increased, but in no event can it exceed 39%. Tampa Bay CDC does not calculate a Debt Ratio. In most cases, CDC will accept the Debt Ratio that is acceptable to the First Mortgage Lender. Should the ratios be excessive or if payment shock will occur, the Borrower may be ineligible. CITY OF CLEARWATER RATIOS: The PITI/Housing Ratio must never be less than 25%, and it should not exceed 30%. If the PITI ratio is below 25%, the Borrower is not eligible to receive the maximum assistance. If the PITI ratio is below 20%, the Borrower is not eligible to receive any assistance from the City of Clearwater. The Debt Ratio should not exceed 42% (based on monthly income as determined by Tampa Bay CDC). With compensating factors, these ratios can be slightly increased, but all exceptions must be approved by the City of Clearwater Housing Manager prior to issuance of an Approval Letter by Tampa Bay CDC. - 12 - (G) The Borrower must obtain a fixed rate mortgage. CDC is prohibited from assisting Borrowers who are obtaining first mortgages which: (a) (b) (c) (d) (e) (f) (g) (h) (i) (H) are adjustable are interest-only contain prepayment penalties contain the potential for negative amortization are based on “stated / undocumented income” are financed by the Owner/Seller have high fees or above-market rates (i.e. B/C loans) do not have escrows being collected for taxes and insurance are not arm’s length. It is unacceptable for the same individual to be the Realtor, Seller and/or Landlord. In this case, Assistance funds will not be provided. Tampa Bay CDC cannot assist Borrowers who are being charged more than 2% discount and 1% origination fees. IF THE PROPERTY IS LOCATED IN THE CITY LIMITS OF CLEARWATER, THE COMBINED AMOUNT OF THE ORIGINATION, DISCOUNT FEES, BROKER AND YIELD-SPREAD FEES CANNOT EXCEED 2%. Lenders are permitted to charge reasonable and customary charges for out of pocket expenses and third-party costs. Lenders may also charge the usual and reasonable settlement costs, including title insurance, transfer costs, survey fees or other similar costs. Other allowable fees include notary fees, hazard, mortgage and flood insurance premiums, recording or registration charges, prepaid escrow deposits and other similar charges. “Junk” fees are not a defined term and may not be charged. Excessive fees are not permitted in the Program. To insure the Borrower is not paying excessive fees (over and above normal and customary industry closing costs), CDC will review the Good Faith Estimate and HUD-1 Settlement Statement to insure they are in accordance with normal and customary charges for our area. (I) The Borrower can use other sources of funds in conjunction with CDC assistance (provided the Borrower has made their minimum contribution from their own funds). If Gift funds are being used, the file must be documented with a gift letter and evidence of receipt of the gift. PLEASE NOTE: Pinellas County will not accept gifts which have been given by the Seller or Realtor(s). If the Seller will be contributing towards the Buyer’s Closing Costs, the file must be documented with a contract addendum showing what costs the seller will be paying. If the Buyer is using another assistance program, please be advised that other liens must - 13 - be subordinate to our assistance program. J) CO-SIGNER REQUIREMENTS: Co-Signers can be used in conjunction with Assistance loans. The income of the CoSigner is not included in the Annual Income. To be acceptable, the following conditions must be met: - The Co-Signer CANNOT RESIDE IN THE PROPERTY being purchased - The Co-Signer must sign a form certifying that they will not reside in the property and that they will not contribute any income to the Household. If they will be contributing any income to help with making the mortgage payments, this must be included in the Borrower’s annual income. - Per State Guidelines, the Co-Signer CANNOT TAKE TITLE to the property and they CANNOT BE LSITED ON THE WARRANTY DEED. (K) Cash back to the Borrower at closing is not permitted under any circumstances. This is not permitted by the Funding Jurisdictions. (L) The Borrower can be pre-approved for downpayment/closing cost assistance prior to locating a property. The minimum amount the Borrower can be pre-approved for is $5,000. A final approval will not be issued until CDC receives the FULLY-EXECUTED Sales Contract and Lender’s Good Faith Estimate. In the case of Short Sales, final approval cannot be issued until the Bank/Lender has approved the Contract. Pre-approval letters are valid for 90 days. If no property is found within that time, updated Income Verifications must be obtained. (M) Assistance loans are not assumable. The entire assistance is due and payable upon: (a) sale/transfer of the property (b) property being vacated by the Borrower (c) property being converted into a rental unit (d) payoff, refinancing or assumption of the first mortgage. (N) In the City limits of Clearwater, a separate Title Policy will be required. In Unincorporated Pinellas County and the City of Largo, a separate policy is not required. However, the City/County’s Mortgage must be listed as Second Mortgagee on Schedule B-1 of the Title Policy. In all cases, the Assistance Loan must be listed on the Hazard and/or Flood Insurance. SECTION 9 - HOMEBUYER EDUCATION PROVIDERS All Borrowers must attend an approved Homebuyer Education Workshop. The Workshop must be completed at least two weeks prior to closing. A copy of the Certificate must be provided to CDC. If the Certificate is over 12 months old or if it is from an Education Provider other than those listed below, the Borrower must attend another Workshop. PLEASE NOTE: The Certificate received at the Workshop is NOT an approval for Downpayment Assistance. All Borrowers must still complete an application and meet the County, City and State eligibility criteria. Pinellas County, the City of Clearwater and the City of Largo Program will accept the Certificates provided at the following Homebuyer Education Workshops: 1. Tampa Bay CDC (HUD-approved agency) (English & Spanish Workshops) - 15 - (727) 442-7075 or www.tampabaycdc.org 2. Community Service Foundation (English Workshops) (727) 461-0618 or www.csfhome.org CITY OF LARGO – BUDGETING CLASS REQUIRED: For Borrowers who are purchasing a property within the City limits of Largo a Budgeting Workshop is also required. The Buyer must register for the Budgeting Program prior to closing by calling (727) 461-0618 and this Budgeting Program must be completed as soon as possible, but no later than six months after closing. If not completed within that timeframe, the Assistance Loan will be immediately due and payable. SECTION 10 - APPLICATION/SUBMISSION REQUIREMENTS The Borrower(s) and all adult Household Members residing or intending to reside in the Property must complete the most current version of CDC’s “Preliminary DPA Assistance Application” and it must be submitted to our office. No documentation (such as paystubs, etc) needs to be submitted with the initial submission. After review of the application, the Borrower will receive a list of the required documents. Applications can be submitted when the Borrower has located a property, or they can be submitted for pre-approval so that CDC can determine the Borrower’s eligibility status prior to the selection of a property. APPLICATIONS CAN BE SUBMITTED IN ANY OF THE FOLLOWING METHODS: (A) Mail or hand-carry to Tampa Bay CDC’s Office, which is located at the following address: Tampa Bay CDC, 2139 N.E. Coachman Road, Ste. 1, Clearwater, Florida 33765 (B) Apply on-line by visiting the Tampa Bay CDC website: www.tampabaycdc.org (C) Fax Applications only to (727) 451-3323 (Do not fax supporting documentation such as paystubs, etc. This method is for submission of applications only!!). Tampa Bay CDC will not be responsible for applications sent or taken to any other person or location. - 16 - All applications will be reviewed in the order that they are submitted, with initial reviews being done within 3-4 business days. Based on the information contained on the application, Tampa Bay CDC will make an initial determination as to the Borrower’s eligibility to receive Assistance. The Borrower will be sent a letter requesting the documentation necessary to complete the file and issue a final decision. The letter will also be faxed to the First Mortgage Lender in case they have any of the requested items. If there is no response from the Borrower and/or Lender within 30 days of issuance of this letter, Tampa Bay CDC will cancel the Application and the Income Certification Fee will not be refunded. To complete the file in accordance with the local and the State’s guidelines, the Borrower and Lender will be asked for the following types of documents: DOCUMENTATION CHECKLIST© (10/10) VERIFICATION OF HOUSEHOLD SIZE (A) _____ _____ _____ (B) _____ _____ _____ _____ ADULT HOUSEHOLD MEMBERS (Currently 18 or over, or who will be 18 in the next 12 months) Drivers License or Government Issued Photo ID Social Security Card or receipt from Social Security showing the Borrower has applied for a duplicate card. Copy of Resident Alien / Green Card (if applicable). If any Adult Household Member is not a U.S. Citizen and has not yet received their Green Card, they will be ineligible for Assistance. DEPENDENTS / OTHER HOUSEHOLD MEMBERS (Under the age of 17) Birth Certificates on which the Parent/Applicant’s Name is listed Copy of Social Security Card or receipt from Social Security showing the Borrower has applied for a duplicate card. Letter(s) of adoption or Court-Ordered Letter(s) of Guardianship (if applicable). Joint Custody of Children (if applicable). In these cases, provide Evidence that Child’s Permanent Address is with the Applicant (i.e. Divorce Decree, Marital Settlement Agreement, Custody Agreement) and School Records, which provide the Applicant’s Name and Address as the primary residence of the dependent. - 17 - (C) _____ _____ _____ _____ _____ _____ SEPARATED APPLICANT(S) Letter from the primary Borrower stating how long they have been separated. (If it is a recent separation, file will be ineligible; should be at least one year) Proof the spouse has been residing elsewhere and maintaining a separate residence for at least the last 12 months (i.e. a copy of the lease). Also provide a copy of the Spouse’s driver’s license or utility bill to verify current address (NOTE: If recently separated or if separate residences cannot be documented, the Spouse’s income must be verified and included in the Household income). Proof the Applicant and Separated Spouse have filed separate tax returns The primary Borrower will be required to sign an Audit Affidavit (CDC to send) The Spouse will be required to sign a Residency Affidavit (CDC to send) The Spouse must also sign the Mortgage (at closing) to release rights to the Property. To obtain a copy of the Application, call the CDC Office or visit our website (www.tampabaycdc.org) and download it from the “Forms and Brochures” Page. The Borrower can also complete an online application Copy of Lender’s 1003 (handwritten or typed copy acceptable) Good Faith Estimate (to show loan type, rate, monthly payment). Please note: The Lender can initially provide a copy of their Closing Cost Worksheet, but prior to final approval, Tampa Bay CDC must receive a copy of the final Good Faith Estimate. Tri-merged Credit Report - all pages - dated within 90 days. (In-File or Standard Factual acceptable) Tax Return/1040 for the most recent year - all pages and schedules - signed by the Borrower(s). Please note that Electronic filing forms, W2s or Telefile forms are not acceptable. If the Borrower does not have a copy, CDC can accept a Printout from the IRS. (To obtain this form or printout, contact the IRS at 800-829-1040). If purchasing in the City limits of Largo/Sold on Largo Program, three (3) years’ tax returns are required. HomeBuyer Education Certificate (from a City/County-approved Instructor). This Inspection is ordered by Tampa Bay CDC and paid for by the City/County funding source. THE CODE INSPECTION DOES NOT REPLACE THE NEED FOR THE BORROWER TO OBTAIN A HOME INSPECTION, FROM AN INSPECTOR OF THEIR CHOOSING, AT THEIR OWN EXPENSE. Please include all pages and schedules. CDC can also accept IRS Form 1722 or an IRS Printout showing tax return information. Year-to-date Financial/Profit & Loss Statement (for the most recent quarterly period). A statement prepared by a Bookkeeper or Accountant is preferred. If the Borrower does not use an Accountant, then the Borrower must prepare the Income Statement and must also write a letter certifying that the P&L was selfprepared and no Accounting/Bookkeeping Services are used by their Business. Notarized Statement from Borrower on the net amount they anticipate earning in the next twelve months. (This amount should be consistent with the earnings reported on the last 2 years’ tax returns. If the anticipated income is substantially higher or lower, a written explanation letter must be given for the difference). DISABILITY, SOCIAL SECURITY, OR PENSION INCOME Social Security or Pension Awards Letter (from the most current year). If the letter is more than 90 days old, a current letter is required. CHILD SUPPORT OR ALIMONY INCOME Child Support Agreement or Divorce Decree – including Marital Settlement Agreement (all pages) Evidence of receipt/non-receipt of income (i.e. Court Printout dated within 90 days) - 20 - (NOTE: If the Child Support is Court-Ordered, but the Applicant does not receive it regularly, it must still be included in Household Income, unless the Applicant can show that they have begun proceedings with the State against the Spouse who is not paying) _____ (F) _____ If the Borrower has dependents but is not receiving any support, they must execute a Child Support Affidavit (CDC to send appropriate Affidavit form) OTHER INCOME Written Verification showing type of income, amount received and frequency. Most current bank statement on all accounts (including savings, checking, IRA, Pension, 401K, stocks, etc.). PLEASE PROVIDE COPIES OF ALL PAGES OF THE STATEMENT. If the Borrower has a checking account and Tampa Bay CDC is unable to obtain a VOD, 6 months’ of statements will be required. Asset Addendum (CDC to send appropriate form) If the Borrower is receiving Gift Funds, a Gift Letter must be provided, along with evidence of receipt of the gift (i.e. copy of the Gift Check, Deposit Slip, etc). The Gift cannot come from the Seller or Realtors. NON-OCCUPANT CO-BORROWER INFORMATION _____ _____ _____ _____ Copy of Lender’s 1003 (handwritten or typed copy is acceptable) Credit Report - all pages (In-File or Standard Factual is acceptable) Applicable Income Information (as noted above) Co-Signer Affidavit to be signed (CDC to send appropriate form). This form certifies that the Co-Signer will not reside in the Household and they will not contribute any Income to the Household.
