The Cumstie Family of Oban, Scotland According to the 1851 Oban census, our ancestor William Cumstie “spirit dealer, draper and grocer aged 71” was born at Dromore, County Down in Northern Ireland, Ulster as it was then known, about the year 1780. Everything else we know about him is in Scotland. He gave his occupation and address as “spinner, Anderston” when he and Jean Herriot married in Barony Presbyterian Church, Glasgow on 16th February 1803. William and Jean Cumstie lived in Barony then nearby Blantyre in Lanarkshire till moving across to Oban on the Scottish west coast in 1821. During this time, William progressed from being a spinner to a weaver to a merchant and, after moving to Oban, became senior Bailie and Provost (chief magistrate) of the Burgh of Oban 1833-36. Their son James followed his father’s steps in being Provost of Oban 1853-59. William and Jean quickly established a business in Oban and their family acquired a substantial amount of property there. Their main business, William Cumstie and Sons, was begun at 40-42 George St, Oban in 1823. The 1841 census lists them residing at 2 George St, Oban: William 60, Jean 61, with children James 30, Agnes 26, Arthur 25, Alex 23 and Janet 17 plus two maidservants, two teenage “shopman” and their three year old grandson Thomas Cassells. Other children William, Anne, Jane/Jeannie and Helen were mostly married and living elsewhere while youngest son Peter, 21 in 1841, was also away from the family home on census night. While the main Oban cemetery from about 1880 onwards is the Pennifuir cemetery outside town, the Church of Scotland originally had its own burial ground adjacent to its Chapel of Ease in Crombie St. Here, three adjacent grave stones are inscribed: (centre stone): “In memory of William Cumstie, Merchant Oban, who died 30th November 1852 aged 74 years. Jean Herriot his wife died 3rd December 1852 aged 74 years. Their daughter Agnes Cumstie died 13th June 1856. Arthur Cumstie died 29th September 1874. Alexander Cumstie died 3rd February 1878. Peter Cumstie died 1st December 1900 aged 80 years. Charlotte Wilson, the wife of Alexander Cumstie, died 9th June 1900.” (left stone facing Soroba road): “In memory of William Cumstie Junior who died at Glasgow 22nd November 1867 aged 63 years and Grace Young, his wife, who died at Glasgow 3rd January 1868.” (right hand stone): “In memory of James Cumstie, Merchant Oban, who died 31 st January 1861 aged 50 years and of his children who pre-deceased him: Elizabeth aged 15 months, Jane Agnes 9 weeks, William 10 months, Eleanor 13 months.” Cumstie Ancestry William and Jean Cumstie died in 1852 before Scottish civil registration of Births, Deaths and Marriages commenced in 1855 which might have otherwise provided more details about their origins and parents. Traditional Scots-Irish naming of oldest son and daughter after paternal grandparents suggests William Cumstie’s parents were William and Anne. While Jean’s father was also named William, their second daughter named Agnes fits this tradition by presumably named after Jean’s mother Agnes Girdwood. Pre-1855 parish and other records are brief and possibly incomplete. Glasgow old parish records show the burial on 22nd March 1804 of William Cumstie (or Comstie) aged 55 who died of asthma. Born around 1849, this William could logically be the father of our William. Also included in these Glasgow records is the burial on 30 th April 1815 of our William’s nephew Arthur Cumstie aged 6 of remitting fever. Cumstie Siblings William Cumstie’s Will includes among his beneficiaries “each of my surviving nieces by my sisters Helen and Jane also my niece Jeanie Cumstie daughter of my brother Hugh” who fit neatly with other Cumstie marriage and birth records in or near Glasgow in the early 1800’s. William Cumstie’s son William’s 14/12/1865 Will confirms these connections, leaving ten pound annuities for “my cousins Agnes McCutchin and Jean McCutchin both residing in Glasgow” and in a codicil added 12/1/1867, a twenty pound annuity to “my cousin Jeanie Cumstie residing at 30 Princes St, Rothesay” (referred to in a further 2/11/1867 codicil as “my cousin Jean Cumstie”). The 1851 Scottish census lists Agnes, 50 and Jean, 36 McCutchen living in Calton. William’s Will also mentions: “my esteemed brother in law William Herriot.” Hugh Cumstie m. (i) Jean Halladay/Halliday married at Barony, Glasgow on 8/6/1804 – Jackey 24/3/1805 – Jean 18/1/1807 – Arthur 18/6/1809 – buried 30/4/1815 – Cleland 1/7/1811 m. 1842 Charles Wallace Hugh Cumstie’s occupation and address is given as spinner of Bridgeton when he married Jean Halladay and their children’s details (above) are from Barony parish baptism register which describes his occupation as cotton spinner in Calton. Hugh Cumstie m. (ii) Isabella Brown – as per Scottish records showing the death on 10/9/1866 of Isabella Cumstie “aged 70, widow of handloom weaver Hugh Cumstie, daughter of John Brown, gingham manufacturer, and Jane (maiden surname unknown). Informant: James Cumstie, son.” The 1861 census shows Isabella, widow 59, living at 18 Struthers St, Calton with her son, James 24, born Glasgow, and brother, John Brown. If James was born about 1837, presumably Jean (Halladay) Cumstie died and Isabella and Hugh married sometime prior to then. Helen Cumstie & Gilbert McCutchin (also spelt McHutchinson/McHutchison/etc) – Agnes c. 1801 (if the Agnes aged 50 living with Jean 36 in the 1851 census) – William c. 22/4/1804 born Barony – Eleanor c. 22/6/1806 “ “ – Jean c. 27/8/1809 “ “ – Isabella 17/3/1811 (or 27/11/1812) born Barony – Margaret 14/1/1816 born Barony The 1841 Scottish census has a Gilbert McCutchen, aged 77, born Ireland, living Barony Jane/Jean Cumstie & Francis McCutchin/McHutchin (also spelt McHutchinson/McHutchison/etc) married at Barony, Glasgow on 28/2/1809 (Francis’ occupation listed as mariner) – Frances 17/12/1809 born Barony – Hugh 26/6/1812 “ “ Alexander Cumstie William & Jean Cumstie’s son Alexander married Jane Ross in Glasgow parish on 6/12/1848. Their ceremony was performed by Dr Robert Buchanan, a minister of the Free Church of Glasgow. Jane was about 21 and daughter of “blacking manager” Donald and Jane Ross. It seems she soon became ill as she died of “Ovarian Dropsy, 8 years” at Hunters Quay, parish of Dunoon & Kilmun, Argyle County on 18/10/1857 and was buried at Glasgow Necropolis. Perhaps her illness is the reason Alexander left Jane behind when he sailed to Australia from Liverpool aboard the 1211 ton “Cambridge” on 23/7/1852. Alexander arrived at Port Phillip in October 1852 and in 1856, still in Victoria, his new partner Charlotte Wilson gave birth to Charlotte Jane Cumstie. After presumably receiving the news of Jane’s death, Alexander, now with the Customs job of “tide waiter” married Charlotte in a Presbyterian ceremony at Charles St, Collingwood on 15/4/1858. Soon after their wedding, Alexander & Charlotte returned with their daughter to Scotland and were living in Glasgow when their daughter Agnes was born in 1859 then back at Oban when their three sons were born. Victorian shipping records, though not mentioning his wife and daughter, show Alexander Cumstie, aged 43, boarding the “Great Britain” in March 1859 bound for Liverpool. 1841, 1851, 1861 Census A census has taken in England and Scotland every 10 years from 1841. These provide invaluable information about families, where they lived, places of birth, occupations etc; even a rough guide for places and timeframe of when and where people died. In addition to above 1841 census details, the 1851 Oban census lists Jean Cumstie 72 with her husband William 71, spirit dealer, draper and grocer continuing to reside in George St along with children Agnes 40, unmarried, James 38, unmarried spirit dealer, and Arthur 36, unmarried spirit dealer, plus Agnes Campbell, visitor aged 5, scholar, born Glasgow and four servants. By 1861, James had married and died. We find residing at Argyle St, Oban his wife Eleanor Cumstie listed as head of house, widow 38, occupation house proprietress, born Muckairn. Also their two surviving children (the other four having died as infants), Isabella 3 and James George 5 months, plus two servants. In George St, presumably continuing to live in their parents’ home, were, in 1861, Arthur Cumstie 48, head of house, and Peter Cumstie 41, both listed as general merchants, plus two boarders and two servants. Next door at that time were Alexander Cumstie 46, merchant, his wife Charlotte 30, their daughter Charlotte Jane (born Australia) and Agnes 2 (born Glasgow), plus one servant. Cumstie Wills These give many details about the family and an indication of the substantial holdings they managed to acquire especially in Oban. Alexander Cumstie made his Will on 19/12/1874. In this he bequeathed all property in Oban left to him by his father William to his oldest son, also named William. His other two sons, Arthur Patrick and Alexander, were to receive a third part share of ground and houses in Oban originally left by John Bayne, merchant in Oban, to William Cumstie snr, then by William to Arthur and Arthur to Alexander in their respective Wills. Also the third part he received as Arthur’s heir in “the piece of building ground situated along Argyle St and Tweedale St in the Burgh of Oban specified and described in a Disposition thereof by the said deceased William Cumstie my father in favour of himself and the said deceased Jean Harriot or Cumstie and the longest liver of them two in liferent for their liferent use allenarly and after the death of the longest liver in favour of the said deceased James Cumstie and of Peter Cumstie, merchant in Oban, his the said deceased William Cumstie’s sons, equally betwixt them in liferent for their liferent use allenarly and their respective heirs … recorded in Register of Sasines at Dunbarton 30/1/1850.” This becomes rather complicated! Plus all other heritable property to go to Arthur Patrick and Alexander jnr and they to make provision for an annuity of 50 pounds sterling to their mother Charlotte, till she die or remarry, and a payment to their sister Charlotte Jane of 150 pounds sterling. “Household furniture and plenishing” to be left to his wife Charlotte, till she die or remarry, and his daughter Charlotte Jane “and the residue and remained of my moveable means and estate” left to his three sons. Alexander then added a recommendation that his son William pay his sister Charlotte Jane 150 pounds sterling when he reaches 21. When Charlotte Cumstie made her Will on 4/6/1898, she appointed …… (probably Arthur Patrick Cumstie but the name is indistinct) of 1 Argyll St, Oban to be her sole executor and “direct him to retain for his own use as special legacies (first) the interest of my late son William Cumstie under the Trust Disposition and Settlement of the late William Cumstie, Portioner, West Cumberland St, Glasgow, and (second) a share in the Oban Gas Company which interest and share I received under the Will of my said son William Cumstie.” Alexander and Charlotte’s son William Cumstie made his Will on 23/10/1894 just 11 days before he died. He assigned “all the interest I may have in the trust estate of my late uncle William Cumstie … and all my interest and share of me under the Will of my late father in the 5 shares in the Oban Gas Works … to my mother Charlotte Cumstie.” Then to convert into money “all my interest in my properties either held by me alone or conjointly with any other person in Argyle and George Streets, Oban aforesaid upon trust” and to pay legacies to his mother of 100 pounds, his sister Charlotte Jane McIntyre 150, his brother Alexander 50, and his brother Arthur 25 pounds. Finally, the money over from this plus all his Victorian estate (he was proprietor of the Queen’s Head Hotel in Kyneton, Australia), after payment of debts and funeral expenses, to be divided equally between his wife Mary and daughter Mary Agnes (his daughter’s to be held in trust till she turns 21 as she was not yet 3). Due to the various properties involved and the shares different people gained in these through such Wills as mentioned above, not all of this was able to be easily liquidated. Therefore Australian Cumstie and Macintyre descendants received periodic payments for many years as interest etc was paid for the use of the properties they held shares in. In August 1984 payment was received via Hosack and Sutherland, solicitors and estate agents of Oban, for the one-third share Mary Agnes Cumstie’s estate had in 11 Argyll St, Oban (cnr Argyll and Tweedale Sts) when this was acquired by the Argyll and Bute District Council. Peter Cumstie’s Will is particularly interesting for, with the possible exception of his sister Janet, he would have been the last surviving member of William Cumstie & Jean Herriot’s family. Peter’s “Trust Disposition and Settlement” of 28/9/1896 and “relative codicil” of 1/10/1900 reveal he was a butcher and directs that: 1. … “payment be made for “all my just and lawful debts and funeral expenses.” 2. “The three family pictures in my house (be made over to) James George Cumstie as representing the eldest son who left issue of my late father’s family.” 3. “Mmary McKechnie who has been in my service for many years past” … receive … “an annuity of six pounds sterling.” 4. “My present assistant Donald McCulloch … (be given the chance to) … acquire the business of flesher carried on by me in Oban.” 5. “the income produced by … (my) … heritable property in George St, Oban” after Mary McKechnie’s annuity is taken out, be split 5 equal ways between the children of his brothers and sisters James, Alexander, Jane Williamson, Helen Cassels and Janet Anderson other than Alexander’s eldest son William “who is excluded in respect that he succeeded to property of considerable value by my late father’s settlement.” Peter owned the properties Femiknowe, 60/68 George St, 56/76 Dalreach Rd, Ashgrove Cottage and Blantyre Villa Cottage in Oban. Plus three-sevenths of 2-7 Strathearn Terrace and one-third of property at Longsdale, Oban as well as the liferent of property in Stafford St and at 54, 56 and 58 George St. Also 25 ten pound shares in the local Railway Company, the goodwill, accounts owing, cash and stock of his butcher’s shop in George St, a smack “Isabella” and skiff “Surf,” livestock (presumably for his shop) plus furniture, personal effects, money in the bank etc. His disposable assets including one year’s rent from each property came to 1,736 pounds while his heritage or property interests were worth around 11,000 pounds at the time of his death. There is also mention in the inventory of Peter Cumstie’s estate of an amount of 23.6 pounds “due to deceased at date of death from the Trust estate of the late William Cumstie, sometime merchant of Tobermory” (presumably his brother William). Peter Cumstie bought the Oban distillery from John Stevenson jnr in 1866 and sold it to Walter Higgins in 1883. Peter died at 4.30pm on 1/12/1900 at his home “Viewbank” Oban from “carcinoma of rectum.” This is the property his brother Alexander’s great granddaughter Mary Rollason (daughter of Mary Agnes Cumstie) took a photo of and titled it “mother’s house in Oban” when she visited there in the early 1950’s. There was once a stained glass window in the old St Columba’s church, George St, Oban, gifted by the Cumstie family. However this has now gone and the chuch, minus its steeple, is now the hydroelectric board’s office and showroom. Cumstie Family in Australia A number of Cumstie descendants either migrated permanently to or spent some time in Australia. A family story is that at least two came out early on to seek their fortune on the goldfields. If they succeeded, they’ve managed to keep this a secret from the prying eyes of those of later generations! Already mentioned is William & Jean Cumstie’s son Alexander who arrived in Melbourne in 1852 and then returned to Scotland by the end of that decade where he took on the family trade of merchant and made his home at 23 George St, Oban. Alexander’s nephews Thomas, James and Alexander Cassels also came to Australia. Thomas and Alexander settled at Millicent in South Australia where they stayed there for the rest of their lives. Thomas’ wife and two children were in England when he died (had they come to Australia with him?) while Alexander Cassels’ family stayed in Australia. James’ movements were difficult to trace, even for his relatives at the time, so we cannot be certain whether he stayed on, returned to Scotland or ? Millicent is and was a small, rural town so Alexander (Sandy) Cassels, besides being the local chemist, was also on occasion called on to pull teeth. It appears that he also lived for a time in nearby Mt Gambier where he is listed as “Dispenser of Pharmacy Services” at its hospital in 1878 and 1879. Certainly Millicent was mainly where he lived, worked and became involved in community affairs; being one of the founders of the Racing Club and Hunt Club, keenly interested in all sporting activities, and also serving a term as Chairman of the Millicent District Council (as per his local paper obituary notice). His wife and daughters were very involved with the local Methodist (now Uniting) Church. Jean was their church organist and also played violin in the Millicent orchestra (who) “were mainly employed in playing at the Globe Pictures before the advent of talking films.” Three of the four children of Alexander Cumstie who reached adulthood also came to Australia. Daughter Charlotte married James Forbes Macintyre in the Royal Hotel, George Square, Glasgow on 25/7/1878 “according to the forms of the Church of Scotland.” Charlotte & James migrated to New Zealand within about a year of their marriage then, after 9 years in New Zealand, crossed the Tasman to make their home and spend the rest of their lives in Victoria from around 1888 onwards. William, Charlotte’s brother, arrived in Australia within a couple of years of her. He married Geelong born Mary McGee in the Presbyterian Manse at Footscray on 5/3/1891. William & Mary were back in Scotland for the birth of their daughter Mary Agnes at 9.15pm on 1/12/1891 at 2 Lilybank Buildings, Hillhead, Glasgow. They returned to Australia to run the Queen’s Head Hotel, Kyneton. Tragically, William died before Mary Agnes turned 3 and then her mother died when she was 14 after a subsequent marriage to another publican, James Kelly. Mary Agnes Cumstie was educated at Fentona’s Presbyterian Ladies College in Melbourne and then trained as a nurse at the hospital now known as Prince Henrys. Fortunately her aunty Charlotte was very kind and would often have her come and stay with her. The third child of Alexander Cumstie to die in Australia was Alexander Cumstie jnr who was an engineer, unmarried, and died in Brisbane on his 30th birthday. In addition, his nephew Alexander Cumstie (his brother Arthur’s son) fought and die for Australia in WWI. He is listed under the heading “Australians” on the 1914-18 Oban war memorial. A.I.F. records show him as Private Alexander Cumstie of the 23rd Battalion who enlisted 5/5/1915, DOW (died of wounds) at Fleurbaix on 27/4/1916 and is buried in Bailleul Communal Cemetery, France Plot II Row D Grave 145. There is a studio portrait photo of him at the Australian War Memorial. Alexander Cassels has his photo and entry on page 997 of “The Cyclopedia of South Australia.” He is described as: “Alexander Arthur Patrick Cassels, pharmaceutical chemist, Millicent, is the third son of the late Mr James Cassels M.D., F.R.C.S. of Glasgow, Scotland, where the subject of this notice was born in 1850. He was educated at the Glasgow Academy and at the close of his scholastic studies proceeded to London and was there engaged in the chemistry profession for a few years. In 1871 he sailed to Melbourne and followed the same calling in the city and country districts for a time till in 1873 coming to South Australia where he established himself in his present business at Millicent. Mr Cassels has prospered and has been satisfactory in building up a very satisfactory connection in the town and district. He erected the premises in which he now resides and has acquired a considerable amount of property in the neighbourhood which is leased by him to tenants for farming purposes. As a keen advocate of sport he established the first Racing Club in Millicent of which he acted as secretary for four years and was also a founder and secretary of the Hunt Club, at present in abeyance. He married in 1895 Clara Williams, youngest daughter of the late Mr Lindsay Cooper of The Register Office, Adelaide, and has two daughters.” Extracts from “The Kyneton Guardian” 6th November 1894: Death of Mr W Cumstie – The many friends of Mr William Cumstie, licensee of the Queen’s Head Hotel, High St, Kyneton, will have heard with sorrow of his death, which occurred at 5.20 o’clock on Saturday morning. A few months ago two operations were performed on Mr Cumstie for the removal of a diseased toe. Subsequently a number of internal complaints, including bronchitis, set in and wrecked his once robust constitution; and for several weeks prior to this death his sufferings were great. Mr Cumstie was a native of Oban, Argyleshire, Scotland. He migrated to the Colony about three years ago and for nearly two years has resided in Kyneton as licensee of the Queen’s Head Hotel. He was only 32 years old at the time of his death and leaves a widow and one child, his younger child having died about six months ago. Mr Cumstie’s sister is married to Mr Macintyre who is in business in Yarraville. The deceased took an active interest in the welfare of the town and was a consistent supporter of local clubs and institutions. He was a member of the Zetland Lodge of Freemasons. The funeral took place yesterday afternoon and was respectably attended, several Masons paying their last tribute of respect to the memory of their deceased Brother. The coffin bearers were Messrs J J McLeod, J Meehan, C Brown and Monteith (a relative of the deceased’s). The burial service was conducted by the Rev W H Scott and the mortuary arrangements were efficiently carried out by Mr Ross. Sympathy is expressed for the relatives of the deceased in their bereavement. 17th May 1906: Death of former Kyneton Resident – The death has been recorded of Mrs Mary Kelly, late of Brunswick, in the Melbourne Hospital on the 14th inst, aged 36. Mrs Kelly was formerly Mrs Cumstie and was licensee for several years of the Queen’s Head Hotel, High St, Kyneton. The Queen’s Head Hotel, 45 High Street, Kyneton was burned down 20/5/1915 then rebuilt and reopened on 30/10/1915. It is classified D by the National Trust and is now a private residence. Kyneton Cemetery: (through main entrance, straight ahead, 7th path to the right, 26 along) White cross shaped memorial inscribed “In loving memory of William Cumstie who died 3rd November 1894 aged 32 years. Edith, child of the above, died 28th March 1894 aged 7 months. At rest.” Nearby (about 13 rows from far fence and about 14 plots in from r.h. fence) is the grave of Mary Kelly/Cumstie’s son-in-law (husband of her daughter Alice from her second marriage).
