Definitions. For the purpose of this section:
Competitive foods means any foods sold in competition with the Program to children in food
service areas during lunch periods.
Foods of minimal nutritional value (FMNV) means: (i) In the case of artificially sweetened foods, a
food that provides less than 5 percent of the Reference Daily Intakes (RDI) for each of eight
specified nutrients per serving; and (ii) in the case of all other foods, a food that provides less
than 5 percent of the RDI for each of eight specified nutrients per 100 calories and less than 5
percent of the RDI for each of eight specified nutrients per serving. The eight nutrients to be
assessed for this purpose are – protein, vitamin A, vitamin C, niacin, riboflavin, thiamine, calcium
and iron.
General. State agencies and school food authorities shall establish such rules or regulations as are
necessary to control the sale of foods in competition with lunches served under the Program.
Such rules or regulations shall prohibit the sale of foods of minimal nutritional value, as listed in
Appendix B in the food service areas during the lunch periods. The sale of other competitive
foods may, at the discretion of the State agency and school food authority, be allowed in the food
service area during the lunch period only if all income from the sale of such foods accrues to the
benefit of the nonprofit school food service or the school or student organizations approved by
the school. State agencies and school food authorities may impose additional restrictions on the
sale of and income from all foods sold at any time throughout schools participating in the
Program.
Federal Regulation 7 CFR Section 220.12 Competitive Food Services

State agencies and School Food Authorities (SFA) shall establish such rules or regulations as are
necessary to control the sale of foods in competition with breakfasts served under the Program.
Such rules or regulations shall prohibit the sale of FMNV, as listed in Appendix B of this part, in
the food service areas during the breakfast periods. The sale of other competitive foods may, at
the discretion of the State agency and the SFA, be allowed in the food service are during the
breakfast period only if all income from the sale of such foods accrues to the benefit of the
nonprofit school food service or the school or student organizations approved by the school.
State agencies and SFA’s may impose additional restrictions on the sale of and income from all
foods sold at any time throughout schools participating in the SBP.
Any person may submit a petition to FNS requesting that an individual food be exempted from a
category of FMNV listed in Appendix B. In the case of artificially sweetened foods, the petition
must include a statement of the percent of RDI for the eight nutrients listed in the definition of
FMNV that the food provides per serving and the petitioner’s source of this information. IN the
case of all other foods, the petition must include a statement of the percent of RDI for the eight
nutrients listed in the definition of FMNV that the food provides per serving and per 100 calories
and the petitioner’s source of this information. The Department will determine whether or not
the individual food is a FMNV and will inform the petitioner in writing of such determination,
and the public by notice in the Federal Register. In determining whether an individual food is a
FMNV, discrete nutrients added to the food will not be taken into account.

Any person may submit a petition to FNS requesting that foods in a particular category of foods
be classified as meeting the definition of FMNV. The petition must identify and define the food
category in easily understood language, list examples of foods contained in the category and
include a list which the foods in that category usually contain. If, upon review of the petition, the
Department determines that the foods in that category should not be classified as FMNV, the
petitioner will be so notified in writing. If upon review of the petition, the Department
determines that there is a substantial likelihood that the foods in that category should be
classified as FMNV; the Department shall at that time inform the petitioner. In addition, the
Department shall publish a proposed rule restrict the sale of the foods in that category, setting
forth the reasons for this action, and soliciting public comments. On the basis of comments
received within 60 days of publication of the proposed rule and other available information, the
Department will determine whether the nutrients composition of the foods indicates that the
category should be classified of FMNV.
By May 1 and November 1 of each year, the Department shall amend Appendix B to exclude
those individual foods identified provided that there are necessary changes.
Colorado Competitive Foodservice Policy 2202-R-203.00
203.01 In those schools participating in the School Breakfast and/or National School Lunch program(s),
competitive food service is any food or beverage service available to students that is separate and
apart from the district’s nonprofit federally reimbursed food service program, and is operated by
school-approved organizations or by school-approved outside vendors.
203.02 Such competitive food service shall not operate in competition with the district’s food service
program, and shall be closed for a period beginning one half hour prior to and remain closed
until one half hour after the last regular scheduled school lunch and/or school breakfast period
on the campus where the school lunch and/or school breakfast is served.
203.03 In cooperation with, and upon the approval of, the district official responsible for the operation of
the district’s food service program participating in the School Breakfast and/or National School
Lunch program(s), the restriction in Section 203.02 may be waived for the service of competitive,
mechanically-vended beverages offered to students at the senior high level. To promote the
nutrition objectives of the School Breakfast and National School Lunch programs, and to preserve
the fiscal integrity of the district’s food service program, districts are encouraged to apply the
restriction of Section 203.02 to all grade levels at all schools.
203.04 All schools participating in the School Breakfast and/or National School Lunch program(s) must
also comply with any federal rules or regulations regarding competitive food service or service of
Foods of Minimal Nutritional Value, as defined by USDA.

Combining both Federal and Colorado competitive food sales regulations:
Competitive Food Sales
A “competitive food” is defined by 7 CFR 210.11 and Colorado 2202-R-203.00 as any food item that is sold
in competition to the reimbursable school meal
Grades Pk-12:
No school operated* food or beverage sales are allowed one half hour before the first meal period until
one half hour after the end of the last meal period anywhere on campus.
*defined as separate and apart from a district’s nonprofit federally reimbursed food service program
Any income from vending machines located on campus and operating ½ hour before the first meal
period until ½ hour after the end of the last meal period must accrue to the school district’s nonprofit
federally reimbursed food service program.
Grades 9-12 Option:
As long as the high school campus is not shared by any other grade levels; and in cooperation with, and
upon the approval of the district official responsible for the operation of the district’s food service
program(s), mechanically vended beverages that are not classified as FMNV may be sold inside and
outside the food service area(s) during meal times by a school or student organization.
Foods of Minimal Nutritional Value (FMNV)
FMNV are defined on page 16.5. This regulation, 7 CFR Parts 210.11, and 220.12, along with Appendix B
to Parts 210 and 220, requires that “State agencies and school food authorities prohibit the sale of foods of
minimal nutritional value in food service areas during meal periods.” The term “food service areas” is
anywhere school meals are being served or consumed, including classrooms and multipurpose rooms
that double as cafeterias during meal periods.
Grades Pk-12:
CN programs may not sell FMNV in the food service area(s) during meal times. Foods that have received
USDA exemption from the FMNV list may be sold a la carte in the food service area(s) by the CN
program.
CN programs may sell FMNV outside of the food service area(s). “If school food service account (SFSA)
funds are used to purchase FMNV for sale outside a meal period(s) or outside a food service area(s)
during meal periods, such purchases must be self-sustaining. This means that funds must be deposited in
the SFSS in an amount sufficient to cover all direct and indirect costs relating to the purchase and service
of FMNV with SFSA funds. Records documenting the recovery of these costs must be maintained and
available for review.” (January 16, 2001 memo to state directors from Stan Garnett)
Grades 9-12 Option:
As long as the high school campus is not shared by any other grade levels; and in cooperation with, and
upon the approval of the district official responsible for the operation of the district’s food service
program(s), mechanically vended beverages that are classified as FMNV may only be sold outside the
food service area(s) during meal times by a school or student organization.

Non-restricted Foods
Please note that ice cream, ice milk and water ices that include fruit or fruit juice are not restricted. Also,
certain beverages that do not contain soda water (carbonation) are not restricted. “Chips” are not
restricted; neither are flavored (chocolate, strawberry, vanilla, etc.) candies that may contain any of the
following: nuts, peanut butter, caramel, coconut, nougat centers, milk-based fillings or other similar
ingredients.
Further Clarification Regarding Soda Water
Numerous questions have been received from schools and industry regarding whether specific
carbonated water products are classified as a food of minimal nutritional value. The following will clarify
the soda water definition as it applies to the child nutrition programs to help answer these queries.
All beverages that are carbonated (produced from either natural or artificial means) with or without any
amount of natural or artificial flavoring(s), artificial sweetener(s), added nutrient(s), juice concentrate(s),
or single strength juice(s) are classified as a food of minimal nutritional value. CARBONATED
BEVERAGES include those products named SPARKLING WATER, SELTZER WATER, CLUB SODA or
NATURALLY CARBONATED WATER.
How does CDE assess compliance with the rules pertaining to Foods of Minimal Nutritional Value
(FMNV)?
1. Food Service Area/Meal Period
The first element to assess is whether the SFA is properly designating the food service area for the
purposes of restricting the service of FMNV. The term “food service area” refers to any area on school
premises where program meals are both served and eaten as well as any areas in which program meals
are either served or eaten. “Eating areas” that are completely separate from the “serving lines” are clearly
part of the food service area. Furthermore, schools may not design their food service area in such a way
as to encourage or facilitate the choice or purchase of FMNV as a ready substitute for, or addition to,
program meals.
Similarly, “during meal periods” includes both the time of serving and the time the student spends eating
the meal; and in Colorado, this includes an additional ½ hour before and ½ hour after the meal period(s).
2. Access to FMNV
It is not permissible for a school to serve FMNV during a meal service period in the area where
reimbursable meals are served and/or eaten. For example, if students are permitted to choose a FMNV
(i.e., carbonated beverage) with a reimbursable meal, that FMNV is being served in competition with the
reimbursable meal. Therefore, this practice is prohibited since it introduces access to FMNV in the food
service area during the meal service period.
CDE is required by regulations to assure that the meal is priced as a unit. As part of the agreements
between CDE and SFAs, the SFA agrees to price the reimbursable meal as a unit. Any FMNV provided
with a reimbursable meal “at no additional charge’ is in fact being “sold” as part of the unit if the FMNV
is only available when a reimbursable meal is taken. This violates the unit price provision in the
agreement.
3. Use of Funds in the Nonprofit School Food Service Account (SFSA)
Costs charged to the nonprofit SFSA must be both necessary and reasonable. The costs of FMNV
purchased for service in the food service area during meal periods are neither necessary nor reasonable,
so they are not allowable costs. In some circumstances, the cost of minor quantities of FMNV used to
decorate or enhance a food or menu item is allowable. Any other costs of FMNV for service in the food
service area during meal periods, including ½ hour before and ½ hour after, must be disallowed. When
restricted competitive foods are purchased from the school foodservice account, i.e., stadium,
concessions, a separate accounting must be maintained to provide a clear audit trail.

Federal regulations prohibit the sale of certain foods, determined to be of minimal nutritional
value, in the foodservice area during meal periods.
Foods of Minimal Nutritional Value (FMNV)
The foods that are restricted from sale to students are classified in these four categories:

Soda Water – any carbonated beverage. No product shall be excluded from this definition
because it contains discrete nutrients added to the food such as vitamins, minerals, and
protein.

Water Ices – any frozen, sweetened water such as “…sicles” and flavored ice with the
exception of products that contain fruit or fruit juice.

Chewing Gum – any flavored products from natural or synthetic gums and other
ingredients that form an insoluble mass for chewing.

Certain Candies – any processed foods made predominantly from sweeteners or artificial
sweeteners with a variety of minor ingredients that characterize the following types:
Hard Candy – A product made predominantly from sugar (sucrose) and corn syrup that may be
flavored and colored, is characterized by a hard, brittle texture and includes such items as sour
ball, lollipops, fruit balls, candy sticks, starlight mints, after dinner mints, jaw breakers, sugar
wafers, rock candy, cinnamon candies, breath mints and cough drops.
Jellies and Gums – A mixture of carbohydrates that are combined to form a stable gelatinous
system of jellylike character and are generally flavored and colored, and include gum drops, jelly
beans, jellied and fruit-flavored slices.
Marshmallow Candies – An aerated confection composed of sugar, corn syrup, invert sugar, 20
percent water and gelatin or egg white to which flavors and colors may be added.
Fondant – A product consisting of microscopic-sized sugar crystals that are separated by a thin
film of sugar and/or invert sugar in solution such as candy corn and soft mints.
Licorice – A product made predominantly from sugar and corn syrup that is flavored with an
extract made from the licorice root.
Spun Candy – A product that is made from sugar that has been boiled at high temperature and
spun at a high speed in a special machine.
Candy-Coated Popcorn – Popcorn that is coated with a mixture made predominantly from sugar
and corn syrup.

Exemptions
Several products have been exempted from the category of foods of minimal nutritional value. This
means these products can be sold during the meal period in a school foodservice area. It does not mean
these products are approved or endorsed by FCS or indicate they have significant nutritional value. In
addition, this exemption should not be perceived as encouragement to purchase these products.
The exemption of one product does not extend to similar products or a family of products. School
district personnel should check the ingredient statement of each exempted food on the list to differentiate
between exempted products and similar non-exempted products.

Chill Beverage Company has added Chill Soda in Guave, Kola, Limon and Pome to the list of products
exempted from the “soda water” category of “foods of minimal nutritional value” [7 CFR Part 210
A[[emdox B (a)(1) and Part 220 Appendix B (1)].
New Products
The Switch Beverage Company has added 100% Juice Carbonated Apple to the list of products exempted
from the “soda water” category FMNV and has added 8.0 fl. oz. servings sizes to all of their currently
exempted products. Sconza Candy Company has added Sconza Gummy Bears 2.25 oz. and Sconza Sour
Worms and Albanese Confectionary Group, Inc., has added A+ Juice Bears to the list of products
exempted from the “jellies and gums” section of the Certain Candies category of FMNV.
Companies and Products Removed
Ardea Beverage Company and its line of Airforce Nutrisodas have been removed. Knudson and Sons,
Inc. and its line of FJ FIZZ Sparkling Fruit Juice Beverages have also been removed. These companies are
no longer manufacturing these products and do not have any other products on the exemption list.
Labels bearing the below product names must have the corresponding ingredient statement and portion size.
Foreign made products on this list are not exempt from the Buy American Provision 7CFR Part 210.21 (3) d.
