When extending the Key Account Agreement to an indefinite term, the benefits listed above remain valid (with the exception of one-off
benefits). The individual services or tariffs to which the benefits apply and their corresponding values arise from the foregoing overview. The
provided benefits will always be listed in the service Billing for each billing period.
The benefits are calculated from the basic prices of tariffs and services, set out in the Operator’s currently valid Pricelist of Tariffs and Services.
The Operator will provide the Customer with a quantity discount from the prices paid (excluding VAT) for the individual services, which will be
provided based on the respective subscriber contracts (the “contract”) concluded under this KAA. These discounts will be provided at the latest
from the first whole billing period following the effective date of this provision, throughout the entire remaining agreed term of the KAA.
A quantity discount is applied automatically to all contracts under the KAA with an indication of the tariff or service, always after using up the
free units. Free units are always applied at the basic prices according to the Operator’s currently valid Pricelist of Tariffs and Services. The
contractual parties have also agreed that the quantity discount agreed above for fixed data services (ADSL, VDSL, Profi ADSL, Profi SHDSL) will
be applied only if the necessary technology is available at the required site. In the opposite case, the Operator is authorised unilaterally to
change the conditions of this KAC and replace the said discount with a discount on the closest possible tariff based on the technology available
at the site. After application of the discount, this new tariff will not be more expensive for the customer than the originally agreed tariff with
the discount agreed above. The Operator will report such unilateral change of Annex No. 1 to the KAC always at latest during ordering of the
respective data service.
Provided discounts on international calls, SMS and calls in roaming do not apply to services with added value (audio-text services, calls to
colour-coded lines etc.). The value set out for this benefit is the final price for 1 minute of a call. If a special tariff, add-on or benefit regulating
international calls and roaming simultaneously (e.g. EU Roaming Benefit) exists, this benefit defined in the KAA is applied with priority,
regardless of whether the price is really better for the Customer. The free units are always applied after offsetting these discounts for
international calls, SMS and calls in roaming. The contractual parties have agreed that the method of charging calls in the framework of ingoing
and outgoing roaming will be determined differently from the Pricelist of Tariffs and Services for the Operator’s tariff and Twist customers, i.e.,
in whole minutes. The discounted prices set out in this paragraph are always applied at the latest on the day after activation / change of the
tariff / transfer of the subscriber contract.
The free units, the quantity of which is defined in this Annex No. 1, always apply to one contract with the tariff or service defined above.
Utilisation of these units precedes the utilisation of units either transferred from the previous period or tariff-related, as the case may be.
Potential unused claims to free units are void without compensation and are not transferred to the next billing period, unless stipulated
otherwise for the individual benefits. If the free units cannot be used for the whole billing period (e.g. termination of the KAA, change of tariff,
etc.), their quantity will always be reduced, so that the allocated quantity corresponds proportionally to the number of days on which they
could be used within the given billing period, unless stipulated otherwise for the individual benefits. The free units are applied in the order in
which they are listed in the above overview of commercial benefits, provided the units are of the same type.
Changes in the CN (Corporate Network) billing priority allow the different use of free tariff units for calls made within the Customer’s CN. For
these calls, no benefits will be deducted and the calls will always be billed directly at the respective current rate for the CN. When using a
change in corporate network billing priority, the CN+ tariff benefit cannot be applied simultaneously.
The contractual parties have agreed that should the Operator cease to provide a service (tariff) that will, according to the business terms and
conditions, be replaced with a different service (tariff) under which the Operator will provide essentially the same or better conditions and the
same or lower price of the various components of the given service (as the Customer enjoyed with respect to the original service after taking

into account the discounts agreed in the KAA), the Operator shall be entitled to replace the original service with such new service. The
Contractual Parties have agreed that such change to the KAA need not be effected in the form of a written addendum. The Operator will inform
the Customer at least 30 days in advance about terminating the service and its replacement with a new service.
