Tendering Information for Procurement of Vital Medicaments for Medical
Institutions of the Ministry of Health of the Republic of Uzbekistan
1. Customer: the Ministry of Health of the Republic of Uzbekistan (hereinafter the
"Buyer").

2. The

Uzbektenderconsulting Agency at the Ministry of Foreign Economic Relations,
Investments and Trade of the Republic of Uzbekistan (hereinafter the "Agency").

3. Both foreign and domestic firms and organizations, including small businesses being
manufacturers and/or vendors of the procured products, which meet the conditions set
for participation in tendering, have experience of supply of relevant quantities of the
products procured by tendering procedure, are eligible for participation in the tendering.
4. At the stage of a qualifying selection, the following organizations and firms shall not
be allowed to participate in the tender:
- those, which are at the stage of reorganization, liquidation or bankruptcy;
- which failed to submit all necessary documents for qualifying selection within the
term set;
- those, which failed to execute duly their obligations taken under the contracts
previously concluded with the Buyer;
- founded less than 6 months prior to the announcement of the tender;
- being in the state of judicial or arbitration proceedings with the Buyer;
- not meeting the requirements of the tender commission in commercial and financial
terms;
- registered in offshore zones (the list is attached hereto).
5. The subject of the tender:
Tender No. UTC-14/36:
«Supply of Vitally Important Medicaments» of the following groups:
Group No.1. Antineoplastic Drugs;
Group No.2. Drugs for Emergency Medical Assistance;
The name, product form and dozes, the amount and maximum prices of medicaments
being purchased are indicated in the "Table of medical products being purchased"
(Appendix #1).
6. All medicaments offered for the bidding should correspond in the doze and amount to
those indicated in the "Table of medical products being purchased" (list approved by the
Ministry of Public Health of the Republic of Uzbekistan).
Recalculation is allowed only in a product form and amount.
7. The Tender Participant may submit a proposal both for the entire list of medicinal
preparations and for separate positions (items).
8. The source of purchase funding: state budget funds.
9. All medical products offered to the bidding should be registered in accordance with
the established order for medical utilization in the Republic of Uzbekistan.
10. The experience of clinical utilization of the drugs offered to the tender during the
post-registration period in medical institutions of the Ministry of Health of the Republic
of Uzbekistan should be no less than 2 (two) years.
11. The remaining expiration period of the supplied medicaments:
Actual expiration period of goods on the date of their delivery must be:
- not less than 80% of the expiration period provided for with technical specifications or
with a standard for medicaments with the expiration period of up to 1 year;
- not less than 70% of the expiration period provided for with technical specifications or
with a standard for medicaments with the expiration period of up to 2 years;
- not less than 60% of the expiration period provided for with technical specifications or
with a standard for medicaments with the expiration period of up to 3 years;
- not less than 50% of the expiration period provided for with technical specifications or
with a standard for medicaments with the expiration period from 3 to 5 years.
These conditions also apply to medicaments supplied as a commodity discount.
12. Terms of payment:
- For foreign suppliers: irrevocable, documentary letter of credit with validity of 180
days.
The costs associated with launching of the letter of credit, both in the country of the
Buyer and beyond it shall be covered by the Supplier.
Opening of the letter of credit is made within the 5 day after obtaining by bank of the
following set of documents from the Seller:
- Invoice or invoice-proforma: 2 copies (the original - 1, a copy-1);
- way-bill - 2 copies (the original - 1, a copy-1);
- packing list - 2 copies (the original - 1, a copy-1);
- Cargo customs declaration "MI 40" certified by a seal the Ministry of Health (a copy) 1 copy
The Parties can agree on changing a type of payment in regards to postponement of
payment (no less than 60 days from the date of customs clearance of the consignment in
the country of the Buyer). All bank costs outside the country of the Buyer shall be
covered by the Seller.
- For domestic suppliers: an advance payment in the amount of 15% from the sum of
delivery which shall be made within 10 days from the date of reception of money
resources from the Ministry of Health; payment of the remained sum in the amount of
85% shall be made within 60 days from the date of delivery of goods.
Payments with domestic manufacturers (suppliers) shall be carried out in the national
currency of the Republic of Uzbekistan, soums.
13. Delivery terms:
- For foreign suppliers: 120 days from the date of opening a letter of credit if payment is
done by letter of credit or 120 days from the time when the contract comes into legal
force (the contract becomes effective after carrying out expert examination and
registration at authorized bodies of the Republic of Uzbekistan), under condition of
deferred payment.
- For domestic suppliers: delivery of goods should be carried out within 120 days from
the date of making a 15% advance payment. The day of delivery shall be the date of
transfer of goods to the Buyer (the date stated in the proforma invoice).
14. Terms of delivery according to Incoterms-2010:
- For foreign suppliers: CIP Tashkent.
- For domestic suppliers: a warehouse of the Buyer in Tashkent.
15. The tenderers can be given a discount not later the declared date of closing of calls
for bids. The commodity discount shall be granted only to the medical products
which are subject to such a discount.
The issue of documentary discounts, including the amount of a discount, shall be settled
by a decision of the tender commission.
16. Deadline of submission of tender offers: till 15:00 o'clock Tashkent time on 18 of
August 2014.
17. The package of tender documentation can be acquired by the parties concerned at the
Agency following the payment of the transient sum in the amount of USD 600 and
submission of an application form for participation in the tender (Appendix #2).
Payment for cost of the tender documentation is made on the basis of the proforma
invoice given out by the Agency.
Domestic participants of the tender shall pay for tender documentation in the national
currency of the Republic of Uzbekistan (in equivalent) at the rate of the Central Bank of
the Republic of Uzbekistan at the date of payment.
18. To participate in the tender the Applicant shall submit the tender guarantee in form
of transfer of a monetary deposit to the Agency's account providing irrevocability of the
tender offer and fulfillment of tender conditions. The monetary deposit is made
according to the concluded agreement on the deposit (The form is given in the Tender
documentation). The size of the warranty of tender offer is established depending on the
settlement sum of the tender offer represented to the tender:

The deposit of domestic suppliers is granted in the national currency of the Republic of
Uzbekistan (in equivalent) at the rate of the Central Bank of the Republic of Uzbekistan
at the date of payment.

19. The warranty of tender offer shall not be paid back to a Tenderer (Winner of tender)
in the following cases:
- if a Tenderer (Applicant) becomes the winner of the tender but refuses or fails to sign
a relevant contract with the Buyer according to the tender conditions and a decision of
the tender commission:
- if a Tenderer /Applicant/Winner withdraws or makes changes to the tender offer after
the deadline for submission of tender offers;
- if a Tenderer is announced as the winner of the tender but refuses to provide the Buyer
with the performance bond of the contract according to conditions of bidding.
20. The offers sent by Tenderer without granting the warranty of tender offer and
payment of tender documentation shall not be considered.
21. The present documentation and all appendices thereof have been made in Russian
and English languages. The official language of the Documentation shall be Russian
language. If discrepancies occur between English and Russian wordings, the wording in
Russian language shall prevail.
22. Any additional information and explanations related with the bidding held can be
obtained at the Agency using the details mentioned above.
