Procurement of Three STM-1 International Internet Bandwidth of “IPLC
nature to USA through Trans-Atlantic route (including IP termination in
USA in designated Tier-1 ISP router” for a period of six months for
Bharat Sanchar Nigam Limited’s Internet Operations at BSNL Mumbai.
The supplier shall provide the IP port termination in at least two different
designated Tier-1 ISP in USA to provide diversity to BSNL network.
Supplier shall provide all three STM-1 IPLC at its premises in Mumbai
and BSNL shall carry these STM-1 bandwidth links over its transmission
network to terminate on BSNL Mumbai.

month per STM-1 (inclusive of all levies, charges and taxes but
excluding Service tax)
The supplier shall commission all these STM-1 Bandwidths over Optical
Fibre at BSNL Mumbai within eight weeks from the date of issue of this
letter.
Supplier shall explore the possibility of providing maximum number
of STM-1 links on gigabit Ethernet interface(s) for bandwidth
termination at BSNL Mumbai.

Late deliveries

All required tests shall be carried out to the satisfaction of BSNL before
declaring the connectivity as commissioned. Circuit will be declared
commissioned in accordance with the provisions as defined in clause 6.4
of EOI.
Acceptance testing prior to the commissioning of the link will be carried
out by the designated officer of the Data Networks Circle, New Delhi. A
commissioning report would be sent by Data Networks circle to the
paying authority for payment purposes etc.
All technical observations and the monitoring of the links will be done by
the Teams or person nominated by CGM WTR, Mumbai for bandwidths
getting terminated at BSNL Mumbai.
Any delay in commissioning of the capacity shall attract liquidated
damages (LD) @0.5% of the six monthly charge for a delay of every
week or part thereof for the first three weeks and @ 0.7% per week
thereafter, subject to a maximum LD of 12%. Quantum of liquidated
damages assessed and levied by the Purchaser shall be final and not
challengeable by the supplier
BSNL reserves the right to cancel the Purchase Order if STM-1
Bandwidth links with Internet connectivity is not extended within eight
week from the date of issue of PO unless the commissioning period is
extended in writing by BSNL in which case also, LD shall be applicable
and Bank Guarantee may be encashed.

Performance
Bank Guarantee
The extension of delivery/commissioning period may be granted subject
to the condition that BSNL shall have the absolute right to revise the
prices and also levy penalty/liquidated damages for delayed supplies.
The supplier has to submit three separate Performance Bank Guarantee of
Rs 3,59,600/- (Rupees Three Lakhs Fifty Nine Thousand Six
Hundred Only) within 15 days of the date of this Purchase Order to
Chief Account Officer, Data Networks, New Delhi. This PBG should

remain valid up to nine months.
The Price (service charges) for each STM-1 Bandwidth will be paid in
accordance with clause 18 of EOI. Payment (In Indian Rupees) will be
made on a monthly basis and after the expiry of the month by CGM,
WTR, Mumbai bandwidths getting terminated at BSNL Mumbai.
The payment of the first month shall be made only after successful
testing / commissioning of the service.
Payment will be made after submission of bill and deduction of IncomeTax, Penalties etc, if any.

Specification
Any amount due to BSNL for any reason whatsoever (In reference to
above tender) can be enchased from the PBG, The PBG shall be returned
after successful completion of contract period.
The performance of STM-1 Bandwidth should confirm to the SLA
conditions indicated below:
1. The Bandwidth will be 1:1, 155 Mbps Full Duplex (Both Ways)
internet traffic per STM-1 link on 24 X 7 basis.
2. Fully restorable
3. packet drop less than 1%
4. Web based monitoring tools and reports would be provided.
5. Latency to:
USA(Trans Atlantic) : 270ms
The latency /packet loss would be measured from BSNL gateway router
to Tier-1 ISP in USA, where BSNL link will be terminated.

Service Availability:BSNL shall impose penalty as per clause no 6.2.5.1 of referenced EOI
and its subsequent clarifications and addendum.

Inspection
Final testing and commissioning shall be done in accordance with clause
6.4 of EOI along with other terms and condition of EOI and this PO.

Supplier will demonstrate the following at the time of acceptance testing:
i. Functioning of tools for measurement of SLA on STM-1 link
ii. Demonstrate online, the latency and packet drop statistics in
accordance with terms and condition of EOI and this PO.
iii. Demonstrate the utilization of web-based tools as specified in the
tender document under reference.
The commitment period for above mentioned bandwidths will be six
month.
Supplier shall commission all STM-1 links within eight weeks from the
date of issue of this letter.
All necessary equipment/infrastructures required for extending the
optical connectivity, to BSNL premises, at the landing Station shall be
made available by M/s Reliance without any extra cost. BSNL shall on
its own arrange, for the extension of fiber connectivity between the

distribution point of Indian Cable Landing Station to BSNL premises any
where in India as per BSNL’s requirement and convenience.
DGM (BM), Data Networks, BSNL Sec-62, Telephone Exchange
Building, Noida will be the overall coordinator for the project.
1. Supplier shall reduce the price of the bandwidth(s) being
procured on implementation of TRAI directive from the date of
issue of such directive or effective date declared in this regard.
Supplier has to give the acceptance for this effect, failing which
this P.O. shall not be valid. BSNL reserves the right to terminate
the contract if such benefits are not passed on to BSNL as per
TRAI/GOI instructions.
2. M/s Reliance will be responsible for all obligations of the IP gateway
as required by the ISP license conditions.
3. If at any stage, it is felt necessary that M/s Reliance should supply
the copy of the IP Gateway license/clearance, then it will be
mandatory for M/s Reliance to supply the same in the timeframe
prescribed by BSNL.
4. All terms and conditions given under purchase reference in of this
PO shall be applicable and binding on M/s Reliance
NOTE:
1. The present rates may be treated as tentative rates and the final rates would be the
present rate or the new finalized rates (effective from 01-07-2008) whichever is
less as on the date of commissioning of respective STM-1 links.
2. All other terms and conditions of reference [1] of serial no 3(a) shall be
applicable. Also, in case of any discrepancy/mistake, the terms and conditions of
EOI-2007 and its subsequent clarifications and addendum will prevail.
3. Acceptance of all terms and conditions of this P.O. have to be submitted to this
office within 15 days from the date of issue of this letter by returning one copy of
P.O. duly signed along with a letter indicating that all terms and conditions are
acceptable.
4. Unless acceptance of P.O. is communicated, this P.O. shall not be valid.
5. Three PBG’s each of Rs 3,59,600/- valid up to 14-11-2008 shall be submitted
within 15 days of the date of this P.O. to Chief Account Officer, Data Networks,
New Delhi along with its copies to this office.
6. Receipt of P.O. may be acknowledged.

Final testing and commissioning shall be done in accordance with clause
6.4 of EOI along with other terms and condition of EOI and this PO.

9. Supplier shall reduce the price of the bandwidth(s) being
procured on implementation of TRAI directive from the date of
issue of such directive or effective date declared in this regard.
Supplier has to give the acceptance for this effect, failing which
this P.O. shall not be valid. BSNL reserves the right to terminate
the contract if such benefits are not passed on to BSNL as per
TRAI/GOI instructions.
10. M/s Bharti will be responsible for all obligations of the IP gateway
as required by the ISP license conditions.
11. If at any stage, it is felt necessary that M/s Bharti should supply the
copy of the IP Gateway license/clearance, then it will be mandatory
for M/s Bharti to supply the same in the timeframe prescribed by
BSNL.
12. All terms and conditions given under purchase reference in of this
PO shall be applicable and binding on M/s Bharti
NOTE:
11. The present rates may be treated as tentative rates and the final rates would be the
present rate or the new finalized rates (effective from 01-07-2008) whichever is
less as on the date of commissioning of respective STM-1 links.
12. All other terms and conditions of reference [1] of serial no 3(a) shall be
applicable. Also, in case of any discrepancy/mistake, the terms and conditions of
EOI-2007 and its subsequent clarifications and addendum will prevail.
13. Acceptance of all terms and conditions of this P.O. have to be submitted to this
office within 15 days from the date of issue of this letter by returning one copy of
P.O. duly signed along with a letter indicating that all terms and conditions are
acceptable.
14. Unless acceptance of P.O. is communicated, this P.O. shall not be valid.
15. Four PBG’s each of Rs Rs 3,59,600/- valid up to nine months shall be submitted
within 15 days of the date of this P.O. to Chief Account Officer, Data Networks,

one Lakhs ninety two thousands only) per six month per STM-1
(inclusive of all levies, charges and taxes but excluding Service tax)
The supplier shall commission all these STM-1 Bandwidths over Optical
Fibre at BSNL Chennai within eight weeks from the date of issue of this
letter.
Supplier shall explore the possibility of providing maximum number of
STM-1 links on gigabit Ethernet interface(s) for bandwidth termination at
BSNL Chennai.
All required tests shall be carried out to the satisfaction of BSNL before
declaring the connectivity as commissioned. Circuit will be declared
commissioned in accordance with the provisions as defined in clause 6.4
of EOI.
Acceptance testing prior to the commissioning of the link will be carried
out by the designated officer of the Data Networks Circle, New Delhi. A
commissioning report would be sent by Data Networks circle to the
paying authority for payment purposes etc.

Technical

the monitoring
of the links
All technical observations and the monitoring of the links will be done by
the Teams or person nominated by CGM, Chennai Telephones for
bandwidths getting terminated at BSNL, Chennai for bandwidths getting
terminated at BSNL Chennai.

Late deliveries
Any delay in commissioning of the capacity shall attract liquidated
damages (LD) @0.5% of the six monthly charge for a delay of every
week or part thereof for the first three weeks and @ 0.7% per week
thereafter, subject to a maximum LD of 12%. Quantum of liquidated
damages assessed and levied by the Purchaser shall be final and not
challengeable by the supplier
BSNL reserves the right to cancel the Purchase Order if STM-1
Bandwidth links with Internet connectivity is not extended within two
week from the date of issue of PO unless the commissioning period is
extended in writing by BSNL in which case also, LD shall be applicable
and Bank Guarantee may be encashed.

Performance
Bank Guarantee
The extension of delivery/commissioning period may be granted subject
to the condition that BSNL shall have the absolute right to revise the
prices and also levy penalty/liquidated damages for delayed supplies.
The supplier has to submit Two separate Performance Bank Guarantee of
Rs 3,59,600/- (Rupees Three Lakhs Fifty Nine Thousand Six
Hundred Only) within 15 days of the date of this Purchase Order to
Chief Account Officer, Data Networks, New Delhi. This PBG should

remain valid up to nine months.
The Price (service charges) for each STM-1 Bandwidth will be paid in
accordance with clause 18 of EOI. Payment (In Indian Rupees) will be
made on a monthly basis and after the expiry of the month by CGM,
Chennai Telephones, Chennai bandwidths getting terminated at BSNL
Chennai.
The payment of the first month shall be made only after successful
testing / commissioning of the service.
Payment will be made after submission of bill and deduction of IncomeTax, Penalties etc, if any.

Specification
Any amount due to BSNL for any reason whatsoever (In reference to
above tender) can be enchased from the PBG, The PBG shall be returned
after successful completion of contract period.
The performance of STM-1 Bandwidth should confirm to the SLA
conditions indicated below:

internet traffic per STM-1 link on 24 X 7 basis.

All required tests shall be carried out to the satisfaction of BSNL before
declaring the connectivity as commissioned. Circuit will be declared
commissioned in accordance with the provisions as defined in clause 6.4
of EOI.
Acceptance testing prior to the commissioning of the link will be carried
out by the designated officer of the Data Networks Circle, New Delhi. A
commissioning report would be sent by Data Networks circle to the
paying authority for payment purposes etc.
All technical observations and the monitoring of the links will be done by
the Teams or person nominated by CGM, WTR, Mumbai for bandwidths
getting terminated at BSNL, Mumbai.
Any delay in commissioning of the capacity shall attract liquidated
damages (LD) @0.5% of the six monthly charge for a delay of every
week or part thereof for the first three weeks and @ 0.7% per week
thereafter, subject to a maximum LD of 12%. Quantum of liquidated
damages assessed and levied by the Purchaser shall be final and not
challengeable by the supplier
BSNL reserves the right to cancel the Purchase Order if STM-1
Bandwidth links with Internet connectivity is not extended within eight
week from the date of issue of PO unless the commissioning period is
extended in writing by BSNL in which case also, LD shall be applicable
and Bank Guarantee may be encashed.

Performance
Bank Guarantee
The extension of delivery/commissioning period may be granted subject
to the condition that BSNL shall have the absolute right to revise the
prices and also levy penalty/liquidated damages for delayed supplies.
The supplier has to submit One separate Performance Bank Guarantee of
Rs 3,35,600/- (Rupees Three Lakhs thirty Five Thousand Six
Hundred Only) within 15 days of the date of this Purchase Order to
Chief Account Officer, Data Networks, New Delhi. This PBG should

remain valid up to nine months.
The Price (service charges) for each STM-1 Bandwidth will be paid in
accordance with clause 18 of EOI. Payment (In Indian Rupees) will be
made on a monthly basis and after the expiry of the month by CGM,
WTR, Mumbai bandwidths getting terminated at BSNL Mumbai.
The payment of the first month shall be made only after successful
testing / commissioning of the service.
Payment will be made after submission of bill and deduction of IncomeTax, Penalties etc, if any.

Specification
Any amount due to BSNL for any reason whatsoever (In reference to
above tender) can be enchased from the PBG, The PBG shall be returned
after successful completion of contract period.
The performance of STM-1 Bandwidth should confirm to the SLA
conditions indicated below:

internet traffic per STM-1 link on 24 X 7 basis.

Service Availability:BSNL shall impose penalty as per clause no 6.2.5.1 of referenced EOI
and its subsequent clarifications and addendum.

Final testing and
Inspection
Final testing and commissioning shall be done in accordance with clause
6.4 of EOI along with other terms and condition of EOI and this PO.

Supplier will demonstrate the following at the time of acceptance testing:
xvi. Functioning of tools for measurement of SLA on STM-1 link
xvii. Demonstrate online, the latency and packet drop statistics in
accordance with terms and condition of EOI and this PO.
xviii. Demonstrate the utilization of web-based tools as specified in the
tender document under reference.
Commitment
The commitment period for above mentioned bandwidths will be six

Installation and
Supplier shall commission all STM-1 links within eight weeks from the
Commissioning date of issue of this letter.
All necessary equipment/infrastructures required for extending the
optical connectivity, to BSNL premises, at the landing Station shall be
made available by M/s TCL without any extra cost. BSNL shall on its
own arrange, for the extension of fiber connectivity between the

distribution point of Indian Cable Landing Station to BSNL premises any
where in India as per BSNL’s requirement and convenience.
DGM (BM), Data Networks, BSNL Sec-62, Telephone Exchange
Building, Noida will be the overall coordinator for the project.
21. Supplier shall reduce the price of the bandwidth(s) being
procured on implementation of TRAI directive from the date of
issue of such directive or effective date declared in this regard.
Supplier has to give the acceptance for this effect, failing which
this P.O. shall not be valid. BSNL reserves the right to terminate
the contract if such benefits are not passed on to BSNL as per
TRAI/GOI instructions.
22. M/s TCL will be responsible for all obligations of the IP gateway as
required by the ISP license conditions.
23. If at any stage, it is felt necessary that M/s TCL should supply the
copy of the IP Gateway license/clearance, then it will be mandatory
for M/s TCL to supply the same in the timeframe prescribed by
BSNL.
24. All terms and conditions given under purchase reference in of this
PO shall be applicable and binding on M/s TCL
NOTE:
26. The present rates may be treated as tentative rates and the final rates would be the
present rate or the new finalized rates (effective from 01-07-2008) whichever is
less as on the date of commissioning of respective STM-1 links.
27. All other terms and conditions of reference [1] of serial no 3(a) shall be
applicable. Also, in case of any discrepancy/mistake, the terms and conditions of
EOI-2007 and its subsequent clarifications and addendum will prevail.
28. Acceptance of all terms and conditions of this P.O. have to be submitted to this
office within 15 days from the date of issue of this letter by returning one copy of
P.O. duly signed along with a letter indicating that all terms and conditions are
acceptable.
29. Unless acceptance of P.O. is communicated, this P.O. shall not be valid.
30. One PBG’s each of Rs 3,35,600/- valid up to nine months shall be submitted
within 15 days of the date of this P.O. to Chief Account Officer, Data Networks,
New Delhi along with its copies to this office.
6. Receipt of P.O. may be acknowledged.
