Board of Education to order at 6:01 p.m. and opened with the Pledge

Dr. Lax moved, seconded by Mr. Strange that the Board move into

current litigation, the medical history of a particular person or
corporation and privileged consultation with legal counsel; also
included for motion Dr. Lax moved, seconded by Mr. Strange that the

VISITORS WISHING TO
ADDRESS THE BOARD
Andrew Marshall, community member, wanted to know what the
conditions were with regards to Visitors Wishing To Address the
Board.
Ted Hurtel, community member, spoke to the Board with the recent
newspaper articles pertaining to security at Board meetings. He
suggested that perhaps the Board should have security cameras
installed.

Anthony Cornish, parent, spoke about the issue of racism that has
been the current subject of debate in the newspaper. He stated that
the Board was smug, petulant, unprofessional and arrogant in its
treatment of Mrs. Jackson.
CELEBRATIONS
Vietnam Veteran-Operation
Recognition
Superintendent Hochreiter presented on behalf of the Elmira City
School District, Mr. Joseph Patrick Pronti, Vietnam Veteran, his high
school diploma.
NYSSBA Proclamation
School Board Recognition
Week-October 19-23, 2009
Mr. Hochreiter read the NYSSBA proclamation declaring the week of
October 19th-23, 2009 School Board Recognition Week. He also
invited the Board to a breakfast on Friday morning at 9:00 a.m. He
continued by saying that the Board will also be recognized at the Erie
Bell football game on Saturday, October 24th.
Mr. Hochreiter asked the School Board Representatives to lead an art
contest to design a logo for Board members for the rest of this year.
This contest will be opened for all high school art students. This was
one of the subjects discussed at the recent New York State School
Board Association Convention in New York City.

Representatives
There was no report from ESSAC.
Michael Lepak, Vice President of ETA, thanked the Board for
recognizing tenured teachers at the last board meeting. He spoke
about EDMS recycling over 30,000 lbs. of paper last year. He
reported that 67 students from EDMS attended a celebration at
Syracuse University dedicating a hall to Ernie Davis. Every school
participated in march out for hunger in which thousands of pounds of
food was collected and delivered.
There was no report from CMCW.

Student Representatives
Elmira Free Academy Student Representative, Abbey Proudfoot,
reported that this week was Spirit Week at EFA with a pep rally on
Friday. Last week, all sophomore and some juniors took the PSAT
tests. She also stated that the construction at EFA is coming along
well; lighting in auditorium; floor in cafeteria and science rooms.
Abbey also thanked the Board members for visiting EFA.

Alternative High School Student Representative, Fred Beard, reported
that this was Spirit Week at Alternative High and the 5 week reports
were sent out.
Mary Tucker
Mrs. Tucker reported that she attended Parley Coburn’s Open House
where the students were involved in a scavenger hunt which was a
creative way for students to act as tour guides for their parents and
siblings. She attended the Health Advisory Committee meeting on
September 28th. They discussed upcoming events such as Mom’s
Night Out, a breast cancer awareness event to be held on October 26th,
walking club at EFA, and SHS health classes working on bullying
“Hands are not for Hitting”.
Equity Committee
Mrs. Jackson had a meeting on October 6th. The committee wanted to
thank the Board for participating in the diversity training. She stated
that starting in January the committee will set up meetings with other
Equity Committees. The committee also plans to look at statistics for
2006-2009/10. She also spoke about Honeoye, NY and how on the
ball they are with diversity training. The next meeting of the
committee will be on Monday, November 16th from 10:00-12:00 in
the small conference room in the EFA Community Room.
Mrs. Jackson reported that Mrs. McCall, herself and Mrs. Tucker
attended the 90th annual New York State School Board Association
Convention in New York City. She went on to report that at the
annual business meeting the first black president was unanimously
elected. They also passed a resolution in support of cultural diversity.
The overall theme of the workshop was centered on the student as a
global citizen. Our new Commissioner addressed the need for more
relevancies in the curriculum for students of the 21st Century.
Individually, the Board members attended over 18 workshop sessions
dealing with such areas of school budgeting during tough fiscal times,
developing individual learning plans, and diversity helping students
become culturally aware of their role in the 21st Century. After the
conference, the members agreed that our district is among the
trendsetters as these workshops were in alignment with the goals set
by our Board in July.

Mrs. McCall had no report with regards to the Art Committee. She
reported that she attended the PFO meeting at Riverside and she will
be attending their coffee hour tomorrow.

Learning & Teaching
Committee-Special
Education Subcommittee
Ms. Grottenthaler reported that the committee discussed the transition
from 5th grade to 6th grade involving special education groups. She
stated that Ernie Davis Middle School went above and beyond trying
to transition students from elementary to middle school. She also
stated that work needs to be done on the transition from middle school
to high school. The next meeting discussion will be a survey for the
parents on what we can do better to help them. The committee has
suspended the idea of a special education parent group at this time,
they would like to see more involvement within the school with the
special education population and more involvement by the parents.
Audit Committee
Mr. Strange reported that he attended Broadway Middle School’s
Open House where about 1,500 people attended. He stated that he
was very impressed with the turn out and looks forward to attending
more events at that school.
Mr. Strange stated that last year our contract with Lumsden and
McCormick expired and the Board approved the hiring of Buffamante
Whipple and Buttafaro (BWB) as new external auditors for the next
three years. The committee met with them in July and then again on
September 30th for the exit audit. Mr. Strange introduced Mr.Wayne
Richell from the BWB to give a report and power point presentation.
This report is on the agenda this evening for approval by the Board.

Mr. Richell presented a slideshow with the following topics:
 Internal Control over financial reporting.
Weaknesses that were found were adjusting journal entries
and purchase order system. The purchase order system was
found not to be in compliance.
 Report on compliance and internal controls in accordance with
OMB Circular A-133 (Singe Audit Act).
Title I compliance was noted as one matter involving
compliance with the requirements that are applicable to the
District’s major federal programs for the year ending June 20,
2009.

Mr. Richell concluded with general comments pertaining to financial
plan, receipt of goods, cash receipts, special aid fund, fund balance
reserves, internal revenue service audits, capital project fund
reconciliation and extra classroom activity funds.
Community Relations
Committee
Mrs. Lattin reported that she attended the Empty Bowls Luncheon put
on by Catholic Charities at Elmira College, PFO meeting and Open
House at Broadway Elementary School.
Policy Committee
Dr. Lax reported that the policies have been completed from last year
and the committee is prioritizing the things they have to go through.
Meeting this month will be going through individual regulations.
Dr. Lax attended the Ernie Davis SPFO meeting which was very well
attended. He also has been involved with dental exams in conjunction
with the Health Dept. and BOCES for the entire county. Tomorrow is
the last time they will hold this and the turn out has been very poor.
Larry McGovern
Mr. McGovern reported that he attended the Empty Bowls Luncheon
at Elmira College where 350 people attended. They raised a lot of
money and the guest speaker talked about the homeless and the
hungry in Chemung County.
SUPERINTENDENT’S
REPORT
Ms. Rhonda Baran, Principal of Pine City Elementary School, and
Kevin Vecellio, Vice Principal, along with Susan DiPetta, Rebekah
Lorden, Cathy Westlake, Kelley Bailey, and Tina Almy presented
their Leadership Week presentation. The presentation pertained to
personal and professional goal settings for students and staff. The
presenters showed examples of writings by 1st and 3rd grade classes
and showed many varieties of strategies that were used in the different
subject areas. The presenters also showed first grade authors and how
they wrote biographies. The group discussed qualities of the voice
trait.

Update on negotiations
training
Mr. Hocheiter informed the Board that all five of our union contracts
are set to expire on June 30, 2010. He recommended the Board go
through training and work with a consultant through NYSSBA or
BOCES for a day to reaccelerate the process of the role of the board
in negotiations and what goals we would like to achieve. Mr.
Hochreiter stated that this would be a closed meeting and feels it
would be a worthwhile effort. He is looking for a commitment from
the Board to engage in a day long training and maybe additional
training. A straw poll was taken to conduct a training and the results

were 9-0 in favor of the Board proceeding with the training. Mr.
Hochreiter said he would get back to the board with some proposed
dates for the training.
OLD BUSINESS
Update on EOP contractsConrad Wolan, Esq.
Attorney Conrad Wolan reported to the Board why the EOP contracts
have been put off. The school district has had a large partnership with
EOP. The New Day Program has 5 outstanding relationships currently
with Diven, Parley Coburn, Riverside, Beecher and Fassett. Four out
of the five contracts have written memorandums of understanding.
Attorney Wolan stated that his job is to match the paper work with
what is going on in the district. As of December four out of the five
will end. The Fassett program funds will end in February. The
question is to recreate new contracts. The only way these programs
will go forward if we pick up 100% of the cost. Mr. Hochreiter stated
that last winter when the state cut the STAR Program and the New
Day Program the Board agreed to fund the CRO Officers 100% and
fund $102,000 for the New Day Program. The Board agreed not to
fund the STAR program. When the budget was built in February it
included 100% support of CRO Officers and funds were reserved to
pay the district portion of 35% for the New Day Program as long as
the state picked up the balance. With the Governor’s proposal for next
year, the state will cut off funding to the county and the county will
cut off other agencies which includes us. We have money in the
budget for the CRO Officers for the rest of this year. There are no
funds for the New Day Program. He went on to say that our job is to
determine what will happen with those programs. Mr. McGovern
suggested looking into using grant funds. Mr. Hochreiter stated that
any after school program will need to be serviced by certified
teachers. Stimulus funds will have to be looked into. Dr. Lax said we
need to look at other programs that might be cut by the State. Mrs.
Jackson asked what is the worst case scenario? Mr. Hochreiters’
focus is on EOP to finding alternate funding sources for those 5
schools.

Dr. Lax began the discussion with reference to the newspaper articles
pertaining to security at Board meetings and sign-in sheets at Board
meetings. Mr. Hurley asked how this issue came about and wanted to
know what the security issue is? Has there been an issue of security?
He stated that if this is being done as an improvement he is all for
that. His concern is the safety of individuals leaving the building at
night in the dark. Ms. Grottenthaler stated that her issue is to direct
our dialogue to each other as board members regarding board
business. We welcome the public and the audience. The wider you
spread out the tables the less comfortable it is seeing and hearing each
other. The way the tables are now is more direct. Mr. Strange agreed
with Ms. Grottenthaler and Mr. Hurley. Mrs. McCall thought it was
rude to sit with people to your back. Mr. McGovern stated that he
changed the tables around so that no one would have their backs to
the public. There was an issue whether the presentation screens
would be visible to the Board. The Board continued discussion as to
where tables should be placed. Mr. McGovern asked Mrs. Jackson if
there was a security issue? She stated, “If you want the tables to be
moved, I already said “yes”. Mr. McGovern said that answers the
question.
Mr. Strange moved, seconded by Mrs. McCall that the Board approve
the minutes of the September 24, 2009, Special Meeting and the
October 6, 2009, Special Meeting of the Board of Education.
Mrs. McCall requested that the following sentence be added to the
October 6th meeting under Anne Caruana’s statement under Visitor’s
Wishing to Address the Board.
Mrs. Caruana went on to say they all share the same historical context
except for the movie, “The Boy in the Striped Pajamas” which is a
work of realistic fiction.”
Mr. Stange moved, seconded by Mrs. McCall to amend the motion to
approve the minutes of the September 24, 2009, Special Meeting and

add the sentence recommended by Mrs. McCall.

angle iron on the building and to demolish a wall and to take the
siding off the building.
