LABORATORY EQUIPMENT

On behalf of Governor, J&K State Pollution Control Board Invites sealed
Re-Tenders from the manufacturer for supplying of Laboratory equipment as
described in schedule A and specification given in schedule B.
2.
The bidder should have executed similar work during the last 5 Year.

J&K Pollution Control Board payable at Srinagar or by cash. All the bids must be
accompanied by Tenders EMD and delivered on or before 15.09.2012 upto 12.00
hrs& Bids will be opened by the state level purchase committee in the presence of
those tenders or their representatives who choose to attend 15.09.2012 at 2:00 hrs at

1.0 GENERAL TERMS & CONDITIONS:
1.02
The Tender Documents is not transferable by the Purchaser.
Each sheet of the bid be signed by the bidder. The price Bid must be in the
form provided herewith at Annexure-II and be submitted along with the
undertaking at Annexure-III.
The documentary evidence of the equipment conformity to the biding
documents may be in the form of literature, drawing and date and shall
furnish.
a) A detailed description of the equipment should include essential
technical and performance characteristics.
b)A list, giving full particulars, including available sources and
current prices, of all spare part, special tool etc.be given.
c) A
clause
–by-clause
demonstrating
the
commentary
equipment
on
the
specifications,
responsiveness
to
those
specification or a statement of deviation and exceptions of the
provision and specifications.
1.03
The bid will not be accepted from the firm to whom the documents are not
issued by the Board.
1.04
The Board undertakes no responsibility for delay or non-receipt of tender
document sent by post either way and also reserves the right to accept or
reject in part or full without assigning any reasons thereof....
1.05
No bid document will be sold after the last date of sale of bid document or
between the extended period of opening day, if any.
1.06
The bidder is expected to examine all instructions, forms, terms and
conditions and specification mentioned in the tender document. Failure to
furnish all information required by bidding document of submission of bid
on substantially responsive to the bidding document in every respect will

be at the bidder’s risk and may result in the rejection of Tender. The bidder
should have executed similar work during the last 5 years.
1.07
The call of the bids does not bind the J&K SPCB to place order. The bids
submitted in response to this invitation may be rejected without assigning
any reason.
1.08
The Board at its discretion may extend the last date of submission of
bids and opening of bids. The J&K State Pollution Control Board does
not bind himself to accept the lowest bid and is vested with authority to
reject any or all the bids received without assigning any reason.
1.09
Documents, sample etc enclosed in the bid shall become the property of
J&K State Pollution Control Board without any payment.
1.10
The warranty period is 12 months starting from the date of successful
commissioning/working of the equipment’s.
1.11
The Technology of the equipment shall be current and shall continue to be
operational for sufficient period to be mentioned in this offer. During this
period, supplier shall give firm guarantee to supply spares on continuing
basis. The bidder shall furnish an undertaking for interrupted period any
timely supply of spares on continuing basis. If spares are not
supplied/made available and required to be procured from the market the
difference in prices, if any on account of such risk purchase and loss of
revenue to the board on account of non-operation of instrument due to
delay in procuring spares shall have to be borne by the supplier. In case
demand of compensation and / or extra cost to the board is not made
within a period of one month, it will be recovered as given in clause 2.28 of
the bid document.
1.12
The items have to be supplied in standard packing.
1.13
In case of the date of opening of the tenders declared as public holiday, the
bid shall be opened on the next working days at the same time.
1.14
The bids shall contain no interlineations, erasures or overwriting of words
except as necessary to correct error made by the bidder, in which case
correction shall be initiated by the person or person signing the bid.

1.15
Late and delayed bids shall not be considered and may be returned
unopened to the bidder.
1.16
The bids may be dropped in the box kept in J&K SPCB..However bidder
may send the bids by registered A D at his risk as bids not received with
day and time fixed shall not be considered. In no case bid should be
handed over to any employee of the Board.
1.17
Canvassing in any form will disqualify the bidder.
1.18
Request for the bid document for bidder through Telex Telephone Money
order and tele fax shall not be entertained
1.19
The bid Notice LABORATORY EQUIPMENT must be invariably quoted in
the bid and further correspondence in this regard.
2.0
All the bids should be addressed to: -Chairman State level Purchase

2.0.
Submission of Bid.
2.01
The bid prepared by the bidder and all correspondence and documents
relating to the tender exchangeable by the bidder and the J&K SPCB, shall
be in English language.
2.02
The bid must accompany with Annexure-I as a Techno Commercial part of
the bid and with Annexure –II along with price part of the bidi.e Financial
bid duly filled in signed by the bidder along with the seal of the firm ,Date
and place. The Technical Bid should contain the following;a).
Compliance to the Technical Specification with supporting
document/papers etc.
2.03
b).
List of supplies made earlier.
c)
Calibration certificate as asked in the tender items .
The bidder are requested to quote the rates item wise and total price of
each item separately indicating the government taxes, levies transportation

(including Packing, forwarding, loading and unloading ) and other
Expenditure item wise as free delivery at place shown in Schedule A.
2.04
THE SEPARATE BID FOR EQUIPMENT BE SUBMITTED AND ENVELOP
BE SUPER SCRIBED ACCORDINGLY.
2.05
Bidder can quote the rate for all the items or some of the items. The J&K
State Pollution Control Board reserve the right to accept the bid in full or in
part.
2.06
The bid is to be submitted in single stage-2 envelopes system, i.e. the first
sealed envelope will contain full information required to judge prequalification, earnest money, complete details and specification of the
items offered including leaflets and catalogues, list of credentials with the
documentary evidence.i.e. Purchase /work order etc . Income Tax clearance
certificate ,sales tax Registration No ,affidavit for not being blacklisted ,
commercial terms and Conditions etc. it shall be
marked” PRE-
qualification “Technical and Commercial Bid Tender no Laboratory
equipment /2012. The second envelope will contain only price quoted by
the bidder in the form given as Annexure –II of this document and shall be
clearly marked ‘price Bid No laboratory Equipment. Both the above
envelopes must separately be sealed and shall be kept in one envelope
bearing the address of J&K State Pollution Control Board and scribed with
bold letter BID FOR SUPPLY OF LABORATORY EQUIPMENT (not to be
opened before)
Note:-If the vendors fail to submit any documents asked for or furnish incomplete
document, the Board may reserve the right to reject the quotation.
The selection of successful tenderer will be made on the basis of:a). Offers complying to the specification of all the items.
b) After Demonstration of the equipment/presentation of the respective
firm/vendors if require by the committee for appraisal of the same.
2.07
Technical Part of the bid be opened first on due date i.e. 15.09.2012. In the
office of J&K State Pollution Control Board Narwal transport Nagar Jammu
, in presence of representatives of bidder who choose to be present. Sealed
price part of the technical and commercial accepted bid will be opened on
the same day if possible or on a later date which will be communicated by
the SLPC of the Board on the same day or by post.

2.08
The bidder shall deposit the amount 1% of the value of the items quoted
towards the earnest Money along with bid in the form of bank draft only in
favour of J&K State Pollution Control Board payable at J&K bank (Canal
Road, Moving Secretariat, branch) Jammu. No earnest money shall be
accepted in any other form . The Earnest money shall be forfeited if the
bidder withdraw its bid before validity specified in the bid document or
fail to supply the equipment within specified in the bid document. Bid
shall not be entertained where bidder has not furnished adequate Earnest
money in the prescribed acceptable form. In case the equipment delivered
is found defective and not attended to by the supplier, the earnest money
deposited by the supplier will also be forfeited. If supplier fails to supply
the equipment with specified time EMD will be forfeited.
2.09
The firm who seek exemption from depositing earnest money being small
scale industry registered with DGS& D and other Government agencies
which entitles them for exemption must submit the valid Registered
Certificate covering the items offered by them along with the permissible
value. The copy of Government Notification granting Exemption from
deposit of EMD must be submitted along with the first part of the bid.
2.10
The earnest money of unsuccessful tenderer will be refunded without any
interest after the concerned purchase is finalized within three months
whichever is earlier and that of successful bidder will be refunded without
any
interest
after
3
month
of
the
successful
installation
and
commissioning/confirming performance as per specification of the items.
2.11
Successful bidder will have to pay Security Deposit of 10% of the Total
Cost of accepted bidder in the form of bank Guarantee valid for 12 months.
This bank Guarantee can be invoked in case of delay in supply beyond
period in the order or not conforming performance as per specification
given in the bid.
2.12
The validity of the bid would be for minimum period of 90 days from the
date of opening of bids. A bid valid for a shorter period may be rejected by
the SLPC, as nonresponsive. In case of extension of validity period of the
bid the Board may solicit the bidder’s consent for extension of the period
mutually agreed upon.
2.13
The rates should be quoted both in words and figures.

2.14
Arithmetical error will be rectified on the following basis: - If there is a
discrepancy between the unit’s price and the total price that is obtained by
multiplying the unit price, shall prevail and the total prices shall be
corrected .If there is discrepancy between words and figures, the amount in
words will prevail.
2.15
Bids not in proper sealed cover or received telegraphically will not be
entertained.
2.16
Conditional bids will be rejected without assigning any reason.
2.17
The bid shall be typed or written in indelible ink and shall be signed by the
bidder or a person with due authorization should bear the signatures of
only the authorized person of the firm. All Pages of the tender except for
unlamented printed literature shall be submitted duly initialed by the
person or persons signing the bid.
2.18
To assist in the Examination, evaluation and comparison of the bids the
SLPC of the Board may, at its discretion, ask the bidder for clarification of
its bid. However, no changes in the prices or the substances of the bid shall
be sought, offered re-permitted.
2.19
The Specification are clearly mentioned in the document and bidders are
requested to submit bid only if their offer strictly comply with their
specifications. The bidding for the equipment having different specification
will be at bidder risk as SLPC will not entertain such bid.
2.20
The placement of purchase order will be according to technical evaluation
of the bid and after consideration of its price worthiness.
2.21
The Price to be given in the bid is fixed prices, irrespective of rises in
material prices and increase in taxes or any statuary increase etc. till the
receipt of the consignment to the Board. No request in regard to increase in
the prices of the items or in the taxes etc or any statutory increase etc. will
be entertained after the submission of the bid.
2.22
The nomenclature of the equipment and spares will be invariably the same
in Performa invoice, packing list and in other relevant papers.
2.23
With the submission of the bid the bidder accepts the conditions of the bid.

2.24
If the item/s supplied is /are of the specification other than asked for and/or
substandard quality to that mentioned in the supply order it will have to
be replaced at their risk and cost. No freight and other charges for export
/import and reshipment etc will be borne by the Board. The installation of
the items is the entire responsibility of the supplier .It may be done either
by the principal /supplier or their authorized agent within one week of the
receipt of the items by the board. The supplier or the agent should be in
touch with the concerned authorities at the place of dispatch and in case of
difficulties bidder may contact I/C Scientist-C Regional Office, SPCB

2.25
The list of items, quantity and place of delivery is given in this document at
Schedule “A” along with detailed specification of the equipment at
schedule “B”. The quantity mentioned in the bid documents may be
reduced or increased at the discretion of the SLPC of the Board on advice
of Technical committee of the board without assigning any reason. The
board may place order for only one piece for testing by the committee of
group of officers appointed by the J&K pollution control board and place
order for remaining quantity depending on report of the committee.
Bidder/List representative can remain present at the time of inspection but
the decision taken by committee in this regard will be final.
2.26
Each folio of the bid must be signed by the bidder.
2.27
Bidder can quote the rates for all the items or some of the items. The bid
shall be considered only for those items for which the rates have been
specifically quoted. SLPC of the Board further reserve the right to accept
the bid for all the items or some of the items for which the bidder has
quoted the bid.
2.28
Items for which offers are made and accepted will have to be supplied
within 4 weeks from the date of issuance of supply order.In case of non –
observance of delivery period of supply not in accordance with the supply
order the supplier hasto pay default compensation at the rate of 0.5% of the
total value of order per concluded week and /or in part of the week of the
default, but not exceeding 5% of the total value of order. In addition for
delay in supply by weeks as calculated @5% beyond the stipulated periods

of 4 weeks from the date of placement of supply order, the board reserves
the right to cancel the order and /or purchase the balance quantity (item
not supplied) from the open market at the cost and risk of the supplier to
whom initial order was placed and the difference, if any, on account of
such purchase, shall have to be borne by the supplier. In case demand of
compensation and/or extra cost to the Board is not made within a period of
one month by the bidder, it will be recovered from the pending bills, EMD
and /or arrear of land revenue.
2.29
“After Sale Services” is most important aspect to be considered for
comparison of bid. The bidder should arrange for the installation, warranty
service, operational training, after sales service, etc.including free training
to the staff of the board through the authorized agents. The cost of this
training shall be included in the price quoted and no separate
consideration is offered. The bidders are also advised to separately
mention the cost of training to JKSPCB personnel. The confirmation of the
above may be provided with the technical part of the bid failing which bid
will not be considered. The details of after sales service after the warrant
period shall be given as mentioned in Annexure –II.
2.30
At any time prior to the dead line for submission of the bid the board may
for any reason whether at its own initiative or in response to a clarification
requested by the prospective bidder, modify the bid document by
amendment.
2.31
The amendment if any will be brought to the notice in writing or by telex
or cable to all concerned BIDDER that have received the bidding
documents and will be binding on them.
2.32
In order to afford prospective bidder reasonable time in which to take the
amendment into account in preparing their bids, the Board may at its
desertion, extend the date for submission of bids.
2.33
The price must be quoted item wise i.e. basic price, taxes, packing,
forwarding, handling and transportation charges, insurance ,installation
charges etc. the charges must be quoted clearly and not in vague terms like
“As actual”, “Approx” etc.
2.34
If according to the bidder, the tendered document contain transport charge
must be quoted according to the place of delivery as mentioned in

Schedule “A”. The supplier will be held liable for any damage, theft or loss
during the transit .The equipment are to be delivered and installed at the
location given in Schedule A under intimation to the Member secretary
J&K State Pollution Control Board Central Office/ Laboratory In-charge
Scientist C Regional Officer Kashmir shiek-ul-Alam Srinagar and Scientist
B Regional Office, Jammu Parivesh Bhawan, Gladni, and Narwal Jammu
respectively.
2.35
Please note that Annexure –I of this document must be enclosed with first
part of the bid i.e. technical and commercial Bid and Annexure II and V
will be kept in the second part of the bid i.e. price Bid.
2.36
Please note that there is no need to enclose the entire bid document
(supplied by the board) with your bid only Annexure –I, II, III need to be
enclosed as per instruction stipulated.
2.37
3.0
Manufacturer authorization in the form of Annexure –IV is must.
Payment Condition.
a)
The payment will be made only after the receipts of the report of
competent authority about satisfactory performance, testingof the
equipment(s) the material in good condition and its satisfactory installation
and performance, if the material is found defective or of sub standard not
to the satisfaction of the Competent authority, the same shall be replaced
by the bidder at his own cost.
b)
In case of import of equipment, letter of Credit will be opened in bank for
100% of cost of the equipment. The 90% payment will be released after the
receipt of the consignment and remaing 10% will be released after
installation and satisfactory performance certificate by the concerned
intending officer.
4.0
FORCE MAJEURE: -Vendor shall not be considered in default if delay occurs due
to causes beyond his control such as act of God, natural calamities, civil
wars, fire, flood, riots etc. In the event of delay due to such causes delivery
scheduled will be extended for a length of time equal to the period of force
majeure or at the option of the SLPC of the Board, the order may be
cancelled .Such cancellation would be without any liability whatsoever on
the part of the board.

5.0
WARRANTY:-The equipment supplied under this contract shall be of the best
quality and workmanship and shall be strictly in accordance with the
specification and particulars mentioned in the clause of the bid. The
contractors/ supplier will have to guarantee that the said material would
continue to conform to the specification and perform satisfactory for a
period of 12 months from date of installation/commissioning of the
material and notwithstanding the fact the board may have inspected and
/or approved the said equipment, discovered not to conform to the
description and quality mentioned in the bid or have deteriorated (decision
of Chairman SLPC shall be final and conclusive), the SLPC of the Board
will be entitled to reject the said equipment or such portion of the
equipment which may be discovered not to confirming to the specifications
and quality mentioned in the bid .On such rejection the equipmentshall be
at contractors/suppliers risk and of the provision herein contained relating
to rejection of goods etc shall apply. The contractor’s /suppliers if so called
upon to do so, replace the material etc.or such portion thereof as is rejected
by the Chairman, SLPC of the Board /officer authorized by him free of cost
at the ultimate destination ,otherwise contractor/supplier shall pay to the
Board such damages as may arise by reason of breach of condition herein
contained. Nothing herein contained shall prejudice any other right of the
Board in that behalf under this contract or otherwise. On failure to make
the loss good to the board, within 15 days from date of demand, it will be
recovered as arrear of land revenue.
6.0.INSTALLATION:- All the Equipment shall be installed and brought into suitable
condition for operation by supplier at sites designated by the board . The
supplier shall make all the necessary and proper arrangement in order to
install the equipment in adequbeate condition for operation.
All matters omitted from this clause which may reasonably be incurred to
be obviously necessary for the proper installation and operation of the
euipment shall be deemed to be included in this insation work ,and
supplier shall
be held responsible for any error or defects which the
supplier may make due to such omissions thereof. All the installing
equipment ,tools, materials ,labour logistics and all the other equipments
for installation shall be provided by the supplier. Prior to the establishment
of equipment layout and installation plan ,the supplier shall verify,check
and inspect the design and specific site conditions of monitering stations

and laboratories where the equipment are to be installed so as to make
good arranging for installation and utility assembly in consultation with
the board.
7.0. TAKING OVER:-
Upon successful completion of delivery, installation and
commissioning of the equipment at the designated sites, the supplier shall
notify the board in writing that all the work under the contract except the
obligation of the warranty have been completed .within fifteen (15) days
after notice from the supplier the board will issue certificate of taking over
after successful commissioning of equipment.
6.0 JURISDICTION: - In case of any dispute, the Jammu court alone will have the
jurisdiction to try the suit on contract.
