Company Proposal #2 - Advancement to Operator in the Plants
Operator Cogen shall be required to complete the formal training requirements for the Head Operator
Cogen job and have demonstrated ability as a Head Operator Cogen within six months (180 days)
from date of permanent assignment to Operator Cogen.
Eliminate all references to Appendix D in contract.
Company Proposal #4 - Multi-tier Job Progression Classifications
The Company and the Union agree to meet and bargain Multi-tier Job Progression before the end of
2013.
Company Proposal #5 - Probationary Period
Article V, I, p. 23. Replace with the following language:
“It is the Company policy to have all new employees subject to a three (3) year probationary period.
If during the three year period, in the opinion of the Company, an employee does not demonstrate
adequate work performance or proper work behavior, he may be terminated. Such termination will
not be subject to Article XVI if it occurs within year one (1) of employment. If after one year of
probation the company terminates employee, such termination will be subject to Article XVI.
Company Proposal #14 – Holidays for New Hires
Modify wording on Page 27 Article Section G (2)
Paid holidays for new hires in first year of service
Change to “Employees who work their regularly scheduled workday immediately preceding or
following a recognized holiday or who are absent due to sickness on such days shall receive their
regular straight time pay for eight hours for such holiday whether or not they work on the holiday.
Eliminate second paragraph which states:
a. Employees with less than one year of continuous service shall, upon their completing one year of
service receive eight hours straight time pay for each of the recognized holidays that occurred during
the one year at their pay rates in effect when the holiday occurred.
Company Proposal #19 – Exchanging Shifts or Days
Article X, Section B will read:
Employees shall have the privilege of exchanging shifts or days by individual arrangement provided:
a. Must be approved by the Operations Supervisor.
b. The change must happen within the same work week.
c. The change can be accomplished without additional cost or penalty to the Company.
d. Request of a change in excess of one (1) work week will be submitted to the Operations
Supervisor in writing as to a valid reason for such change.
e. Such change not to exceed two (2) weeks, unless mutually agreed to by all parties concerned.
Company Proposal #21 – Arbitrator Language
Modify Grievance procedure and eliminate the use of AAA from Article XVI in the CBA and use
FMCS.

“either party may then request a panel of arbitrators from Federal Mediation and Conciliation
Services (FMCS). The parties shall strike names within 30 calendar days of receipt of the panel.”
Union Proposal #17 – Seniority List Delivery
The Union proposes adding the following language to Article V, G. Seniority List to read as follows:
The Company will semi-annually furnish the Union, to include a copy to the Staff Representative,
Local’s 219 Secretary Treasurer and 12-6 Secretary Treasurer, with lists reflecting Company and
department seniority, classification and work location of employees.
Company Counter to Union Proposal #1 – Bid Awards
The Company will award operator and craft helper jobs to successful bidders within a period
of fourteen (14) calendar days after the closing date of job bid. The company will award
Craftsman and Head Operator jobs within a period of thirty (30) calendar days after the
closing date of job bid to successful bidders on the basis of qualifications, demonstrated ability,
departmental seniority and completion of prescribed formal training. The Company will notify the
Union if the 14 or 30 day time limits will be exceeded.
Company Bundled Proposal - All proposals listed below are offered as a bundled package in
totality.
Revised Company Proposal #1: Job Posting and Bidding Process
Modify Article V, section H (page 19): “An employee must be in his permanent awarded position for
a minimum of twelve (12) months. If there are no bidders for a position the company may reassign
employees and that given employee must stay in position for twelve (12) months. The 12 month
requirement does not apply to employees when bidding on competitive jobs for advancement.
Unless for circumstances that, in the opinion of the Company and the local Chairman of the
Workmen’s Committee or his designated representative, are extraordinary.”

Company counter to Union Proposal #9: Layoff & Department Seniority
Change the language in Article V, F. Layoff and Rehire page 18 as follows:
Layoffs from the San Joaquin Valley Business Unit will be based on Department Seniority – that is,
the last employee……..
This language will apply only to those represented employees joining the bargaining unit on or
after February 1, 2012 (Existing employees on the company seniority list as of February 1st,
2012, will be grandfathered in).
Company counter to Union Proposal #15: Union Orientation
The Company and Union’s Local President or his designee will jointly participate in an informational
presentation not to exceed sixty (60) minutes. This presentation will be presented once employees are
assigned to their respective USW represented location. All material presented will be based on USW
Welcome Kit. Any changes to the material will need to be mutually agreed upon between the
company and the union.
