APRIL 2014 - Snohomish County Bar News 3 From the Desk of the President Jennifer Rancourt “The vote is the most powerful instrument ever devised by man for breaking down injustice and destroying the terrible walls which imprison men because they are different from other men”-Lyndon B. Johnson. In celebration of the 50th anniversaries of the Civil Rights Act of 1964 and the Voting Rights act of 1965, the American Bar Association has chosen, “American Democracy and the Rule of Law: Why Every Vote Matters” as this year’s Law Day Theme. As noted by the ABA, “the right to vote is the very foundation of government by the people. For this reason, striving to establish and protect every citizen’s right to vote has been a central theme of American legal and civic history. Much of the struggle on voting rights began decades ago, but the work is far from complete, and a citizen’s right to cast a ballot remains at risk today.” Law Day was established in 1958 by President Dwight D. Eisenhower as a national day dedicated to the principles of government under the law. In 1961, Congress, by joint resolution, established May 1 as the annual date to celebrate Law Day and to recognize the role of the courts in maintaining the integrity of our democratic society. It is a tribute to the ideals of justice and a reminder of the vital role that courts play in maintaining the freedoms we all hold dear. For several years, the Snohomish County Bar Association has teamed with local high schools to bring Law Day to students. This year we are again asking for your support to make this tradition a success. The Snohomish County Bar Association will be pairing up local attorneys with High Schools throughout the county. In an effort to reach as many students as possible, attorneys will be going out to the high schools and speaking with various civics, social studies, government and law classes. The manner in which you choose to address the topic is totally up to the individual attorneys, the American Bar Association has published a very thorough guide for the event which is located at americanbar.org and www.lawday.org. The websites are complete with historical data, a timeline of the right to vote in America, relevant case summaries, lesson plans and ideas for activities. The guide suggests looking at 4 Snohomish County Bar News - APRIL 2014 historical barriers to voting rights and current attempts at voter suppression in various states. For example, students could complete a 1964 voter registration card as a starting point for discussion and then review and critically discuss the implications of a state’s voter ID laws. This incredibly important topic is very timely for our audience as students are rapidly approaching the age of majority and are becoming eligible to vote. It should no doubt spark some lively discussions about how the courts have and continue to assist in breaking down barriers to this vital right. They said whoever challenged the Demon would die. Men came to the high desert to ride it. They were called “test pilots.” And no one knew their names. Except at Boeing. Local attorney Rebecca Wallick began research to write a biography of her father, Boeing test pilot Lew Wallick, by inquiring about the aircraft test program at the company. “Who are you?” she was asked. Rebecca gave her name. “Are you Lew Wallick’s daughter?” she was invariably asked. And doors magically opened. In late December I was given the opportunity to read an advanced copy of her memoir/biography, Growing Up Boeing (www.growingupboeing.com), which launched February 9th. We recently sat down for an interview at the Irishman. What compelled you to write this book? How did this all get started? My undergraduate degree is in history, so I’ve always had an interest in history. Around 2002, as Dad’s health began to fail, I got out a tape recorder and sat down many Sundays to record his memories, the stories I heard pieces of growing up and always knew were part of aviation history. There are a lot of other pilots mentioned in the book, how did you gain access to them? My father was not the sort to take credit or boast. Once it was clear I was moving forward with the work he tapped into that network of others who flew with him, taking the same risks. I knew them all as a child, and soon I become re-acquainted with them. Risks, yes, let’s talk about them. We get on commercial airliners today and don’t give it a second throught, but the truth is there were many times when Dad wasn’t sure they could bring the aircraft home. To cite one example, the leading edges of the new 767’s wing stuck in the open position, creating drag on one side of the airplane which if improperly handled by the pilot would cause the airplane to crash. The test pilots work out the bugs so the rest of us can fly safely. His worst experience, ironically, was flying with a poor FAA pilot while certifying the 727. You read of course about the deep stall? Yes, 17 seconds of falling backwards toward earth. I cannot imagine. I talked to the engineer who read the telemetry; there was no airspeed recorded for 17 seconds – an eternity. The objective was to demonstrate the handling characteristics of the 727 in a stall. There are set degrees of pitch for the test, but the FAA guy pulled back on the stick far, far too much and the airplane nosed up and stopped flying, then started falling backward. The F-86 Sabre chase plane passed right by! But for my Dad’s instincts and skill, the crew would not have come home that night. A very close call. Did you or your brothers have any idea of the risks your Dad ran? No. Dad could have been a banker just going to the office and coming home at night. He rarely talked about work, and never about the dangers. I didn’t hear about the deep stall until I began researching the book in 2002, and even then, it was a flight test engineer who first mentioned it, not my father. As kids, mostly we knew he was gone on trips to test airplanes out in the desert at Edwards Air Force Base, or traveling to other countries to prove and sell jets. Dad was very modest. So, there really was a Happy Bottom Riding Club out in the desert, like in the film The Right Stuff? Yes there was, and Dad went there, met Pancho Barnes. They all did. He flew with a lot of famous people, Neil Armstrong, Charles Lindbergh. How did you get the letter from Prince Phillip? This is the man who is married to Her Majesty, the Queen of England, right? Yes! He flew with my father in a 757 on a visit here in 1982. I thought ‘it never hurts to ask’ so in August of this year I wrote to the prince, asking if he remembered that flight. I quickly got a lovely letter back from him on Buckingham Palace letterhead! The list of the famous is long, but it sounded like the most dangerous celebrity flying was with Howard Hughes. The test pilots’ stories about Hughes’s skills as a pilot in 1959 are hair-raising. They figured out later that not only was he probably on pain meds due to his earlier crashes, but he also had some personality disorders. It is interesting that as a lawyer, you recognize the inherent conflict of interest that existed between the Boeing pilots and the FAA guys who were to certify the first jets; they socialized. That is gone now, isn’t it? Yes. I’m told that today, the camaraderie is just not there, the notion that everyone is on the same team trying to build safe aircraft and fly them safely is gone. It’s now all regimented with strict oversight. It’s always the lawyers fault. Yes! Truly, they say the fun has gone out of flight testing. So, how do you feel about flying? Commercially I fly all the time, but rarely in private airplanes anymore. There are just too many bad private pilots out there. I flew a lot with my Dad of course. Our floatplane trips to Canada were great. Yes, that really captures my imagination. When you are on a plane do you know when something has gone wrong? Sometimes. I felt a tire blow out on takeoff in a 767 at SeaTac once. From my talks with Dad, I knew this kind of thing happens all the time and is no big deal. The captain didn’t say anything until we were on approach to Amsterdam. We had to fly by the tower for visual inspection and then land far from the terminal, just in case. I was calm, but a guy seated behind me panicked. Where do you sit on a commercial airliner? Near the exits, or in the rear. Dad’s advice. One story in the book, about a deadly 707 training crash near Arlington in 1959, graphically explains the basis for his advice. This is a great story. I was sad to see the book end. The photo of your father reaching out of the P-12 biplane and cupping your chin in his hand is a compelling portrait of a great father-daughter relationship. Thank you. We had a wonderful bond. I really miss him. It is clear that an era has ended. Some say it was the merger of McDonnell Douglas with Boeing, others say it was the adoption of too many rules made necessary by concerns of collusion between the company and government. Whatever the cause, the seat-of-the-pants, talentcontinued from page 5 rises-to-the-top meritocracy that gave us Lew Wallick has been compromised. There will be no more legends built from sheer talent, risk taking, and character. We instead have a grinding bureaucracy, where the esprit de corps is discouraged and the individual soul lies crushed. What remains is just a job, made less thrilling by simulators and other machines that leave man hollow. He might have the right stuff, but we will never know, because we have legislated away his opportunities to show it. So long Lew. I am glad I learned your name. HOW TO VOTE If there are three or more candidates listed on the ballot, the member must vote for three candidates and rank each candidate in order of preference. In addition, regardless of the number of candidates, each member must rate each and every candidate in one of the following categories: Excellent, Good, Average, Unsatisfactory or Unknown. Any ballot, which fails to follow the outlined procedure, will not be counted as to the race for which the procedure was not followed. ENVELOPE PROCESS The ballot shall be filled out by the member but there shall not be any identification of the voting member on the ballot itself; the ballot shall then be placed in a sealed envelope marked “Ballot” that contains no identification from the voting member; the “Ballot” envelope shall be placed in another envelope on which the voting member must identify himself or herself by their printed name and their personal signature. The completed ballots shall be returned as specified in the ballot notice. The “Ballot” envelopes shall be removed from the outer envelopes by an impartial person selected by the Bar Association officers. Such person shall not forward or include any ballot for counting which has not been submitted in the prescribed manner. No two families are identical. No two sets of parents have the same skills, strengths or weaknesses. Each and every decision on the Family Law Motions calendar has a ripple effect into relationships beyond the scope or view of the courtroom. In 2008 I got my first taste of the task Commissioners face in putting Band-Aids on volatile situations with limited information when I was added to the pro tem list. I approached this opportunity with a large dose of humility and respect. Though voluminous at times (often), I committed to reading all of the pages submitted by the parties, in addition to court file history that provided further context. When faced with an issue that was new to me, I have not hesitated to stop and look up the law on point. I take the time to “do the math” and check calculations against records. From an attorney’s perspective, I understand the effort and import given to what is prepared for the court’s review. In applying the Golden Rule, I take the time to review and consider information in the way I’d like my own clients’ materials understood. His practice has been primarily in King and Snohomish Counties, where he focused on misdemeanor criminal law, family law, and consumer bankruptcy. In the past, he has served as part-time prosecutor for the City of Arlington, prosecuting cases in Cascade District court. I have held my current position for over three years and have worked for Mason County in several capacities for nearly 20 years. Prior to my work for Mason County I was in private practice primarily dealing with domestic, criminal and land use cases. In 1994 my employment with Mason County began. I worked initially for several years as a Deputy Prosecutor – primarily as a criminal deputy. My career took an interesting turn when I was given an opportunity to open Mason County’s first Juvenile Detention facility and I became a vigorous advocate for Juvenile Justice issues in Mason County and state-wide. I’m in my seventh year as pro tem Snohomish County Superior Court Commissioner. Since 2009, I’ve served as private evaluative mediator in over 500 family law cases. I also have been appointed to serve as mediator in about 70 Foreclosure Fairness Act foreclosure matters, which include a decision-making component regarding good faith of the parties.
