CREBA closed the books of last year with
a long list of notable accomplishments and
opened the present with an equally long
list of things-to-do, all in the pursuit of its
overarching philosophy of “business with
a social conscience” ever mindful that the
welfare of the greater majority shall always
remain to be its “paramount concern.”
Indeed, time has flown so fast. It was only
like yesterday that we were ushering into a
new year, yet, almost without us noticing in
the midst of the many milestones that have
dotted the CREBA activity calendar, we have
now reached the middle of a most promising year.
As the largest organization of real estate industry stakeholders, CREBA continues to
tirelessly and relentlessly push for the passage of the “Department of Housing” Bill
in the legislature.

to, time and again, defend the matter of
housing to become a government priority at
the highest level through the creation of a
Department of Housing and Urban Development (DHUD).
In his sponsorship speech, he highlighted
how the House have repeatedly sought to
solve the country’s housing quandary by
approving bills creating a DHUD. Unfortunately, though, efforts in the 9th, 12th, and
13th Congresses somehow “lost ground” at
the gates of the Senate.
With pressures from many fronts including
the housing sector and our allies in the legislature, the DHUD has deservedly landed as
among the top 10 priority measures. Earlier
this month, the latest version in the Senate
has been approved at second reading. Let us
await in anticipation developments on the
DHUD as Congress resumes session in late
July.
Should this measure be finally enacted into
law, the Philippines will join other countries
that have elevated the matter of housing or
urban development, to the level of a fullfledged Department.
The support and participation of our Chapters from all over the Philippines for the past
few months have been remarkable. As part

Department of Housing: A MUST
It is a great honour and privilege for me
to lead for another year the country’s largest umbrella organization of stakeholders
from the allied industries of housing, construction, and real estate development – the
Chamber of Real Estate and Builders’ Associations, Inc. or CREBA.
CREBA: Voice and Vanguard of
Philippine Real Estate
Over the last four decades, CREBA has
taken upon itself to regularly propose legislative and administrative approaches to
housing production, finance or regulation,
or submit well-researched commentaries or
critique of government-initiated legislation
or policies related to housing.
From time to time, however, CREBA has
also seen it fit to propose measures or take
a position on emerging concerns or issues
that, although not directly related to housing, nevertheless affect the socio-economic
or political environment that invariably impacts on housing and real estate.
Among the major issues that have continued
to plague the housing sector is the absence
of a government unit devoted to provide
solutions to the over-arching challenges of
providing decent homes for Filipinos. Thus,
CREBA has been pushing for the creation
of the Department of Housing and Urban
Development (DHUD) through legislation.
Housing is one of Man’s Basic Needs
CREBA perceives that since the abolition of
the Ministry of Human Settlements in the
wake of the Martial Law regime’s downfall,
the housing effort has suffered in terms of
prioritization at the highest levels of Government. Since shelter is one of the three
most basic needs of man, provision of the
same should enjoy a priority at least equal
to tourism and other government services,
and should be similarly addressed by a fullfledged Department rather than just a mere
Coordinating Council.
Toward this end, CREBA has been continually working for the creation of a DHUD
that will establish a permanent seed fund,
balance land use, enhance securitization measures, expand the powers of the
HLURB to cover summary ejectment functions and thus, protect the property rights
of legitimate landowners, among many other urgently needed reforms.
Constitutional Provision on Housing
Art. XIII, Sec. 9 of the 1987 Constitution
provides that the State shall, by law, and
for the common good, undertake, in cooperation with the private sector, a continuing
program of urban land reform and housing
which will make available at affordable cost,
decent housing and basic services to underprivileged and homeless citizens in urban
centers and resettlement areas. It shall also
promote adequate employment opportunities for such citizens. In the implementation
of such program, the state shall respect the
rights of small property owners.
This precept highlights the enormous and
widely-encompassing importance of housing and urban development in raising the
quality of life of societies and people, and
the inevitability of public-private partnership to attain social improvement goals. It
therefore mandates government to accord
housing policies and issues fundamental focus and, in the process, provide communities all the needed support services that will
help citizens thrive as members of functional social units.
Global Policies on Housing
This kind of focus is evident in some of
our closest Asian neighbors, who, in the last
three to four decades successfully pulled
themselves along as self-sufficient and stable centers of economic growth.
In Singapore, for instance, where population is 100% urban and total land area is
a miniscule 678 square kilometers, public
housing programs, particularly the planning
and development of new communities, allocation of rental units and resale of units
for ownership is managed by a statutory
Housing and Development Board, while
management of communities is delegated
to town councils. Yet, a larger Ministry of
National Development is responsible for
national land use and development planning
to implement a complex and diverse process
of developing world-class infrastructure
and creating a vibrant and sustainable living
environment.
In Malaysia, where 72% of the population
resides in urban areas, there exists a Ministry of Housing and Local Government. A
Housing and Urban Development bureau
provides low income housing and assists
in creating new housing in cities for low income families in Thailand. Cambodia maintains a Ministry of Land Management, Urban Planning and Construction, as well as a
Ministry of Rural Development.

and departments are likewise present in Brunei, Indonesia, Laos, Vietnam and Myanmar.
Our most ardent advocate in Congress, Hon.
Rodolfo G. Valencia, reveals that among other Asia countries, Bahrain and Oman have
each their respective Ministry of Housing,
while Fiji has its Ministry of Housing and
Urban Development. In Europe, he said,
Hungary has its Ministry o Building and Urban Development, The Netherlands created
its own Department of Shelter and Land Use
way back in the year 1900.
In Africa, the country of Guinea has its Ministry of Town Planning and Housing, Malawi has its Ministry of Housing and Physical Planning, and Uganda has its Ministry of
Housing and Urban Development.
In Latin America, Bolivia has its Ministry of
Urban Affairs, and both Costa Rica and Nicaragua have their respective Ministry of Housing and Human Settlements.
In the world’s larger economies, such as the
United States, the Department of Housing
and Urban Development carries a mission
to create strong, sustainable, inclusive communities and quality affordable homes for all.
The HUD works to “strengthen the housing
market to bolster the economy and protect
consumers, meet the need for quality affordable rental homes, utilize housing as a platform for improving quality of life and build
inclusive and sustainable communities free
from discrimination.”
Philippines: Housing Backlog of
4 Million
In the Philippines, the housing backlog currently stands at close to 4 million homeless
families, more than 75% of which are informal settlers living in urban centers. To eliminate this backlog and at the same time serve
the needs of the growing population within
at least 20 years would require a minimum
housing production rate of 500,000 units per
year.
Hence, the Chamber of Real Estate & Build-
ers’ Associations, Inc. (CREBA) strongly
believes that creating the Department of
Housing has been, still is, and always will be,
a pressing concern that the legislature must
finally address to ensure that the critical housing problem is accorded the attention it deserves at the highest level.
The proposed Department of Housing Bill
aims to address housing in its totality by
encompassing 4 major aspects of land and
housing development: finance, production,
regulation and administration.
CREBA views that any half-measures, focused only on one or two of these aspects,
would be largely ineffective in view of the
gravity of the current housing situation and
may only result in waste of government
funds and effort, if not failed expectations on
the part of the millions of homeless.
Lean and Mean Department
For those who worry, no new appropriation
is necessary. The existing appropriation for
HUDCC, including personnel and assets,
is transferred to the Department. A simply
structured, lean and mean Department would
be more appropriate in view of budgetary
constraints and in the interest of a higher degree of cost-efficiency and considering that
the bulk of operations will be undertaken by
the attached agencies already existing.
CREBA believes that the creation of a Housing Department is not only imperative, but
long overdue. The Chamber has long been an
advocate of the DHUD Bill and has unfailingly submitted its proposals to both Houses
of Congress over the years. Our position has
remained consistent for the past 2 decades:
that the DHUD need not be structured with
the usual full complement of bureaus and
service divisions.
This is because the administrative and operational structure is already in place – comprised of the existing housing agencies and
GOCCs. There is thus no compelling need to
disturb this existing infrastructure.
What is of utmost importance is to cloth
the policy-making and overseeing body with
powers sufficient to ensure (1) that the existing housing agencies, local governments and
the private sector operate in a concerted and
holistic fashion, and (2) that the housing and
urban development effort is accorded the priority it deserves at the highest rungs of government.
Thus, it should suffice to elevate the status
of the present Housing and Urban Development Coordinating Council (HUDCC) into
a Department, maintain its present complement of offices and personnel, attach thereto
the existing housing agencies and GOCCS,
and confer upon this Department adequate
administrative and supervisory powers over
the KSA’s and their respective governing
boards.
Perhaps the most radical, albeit necessary,
measure we would now like to introduce, in
view of our actual and recent experiences, is
the granting of veto powers upon the Housing Secretary over all actions taken by the
governing boards of the KSA’s with respect
to investments, allocation and disposition of
funds, issuance of credit instruments, and
such matters as may bear directly or indirectly
on policies, programs, rules and regulations
adopted by the Department.
The DHUD Bill should, therefore, grant the
Housing Secretary full authority and direct
control over the KSA’s, and in the process,
provide the mechanism for responsibility and
accountability for his actions.
Economic Pump-priming
The proposed Act, while specifically attuned
to the needs of the millions of homeless, will
nonetheless provide a tremendous boost to
the economy if enacted and implemented
fully and decisively due to the enormous economic pump-priming impact of housing activity in terms of providing employment and
income opportunities for millions, catalysing
business activity for at least 68 other industries and generating billions in government
revenues from taxes.

In the early 70’s, CREBA recommended the
creation of a housing fund system similar in
concept to the Social Security System (SSS)
and the Government Service Insurance System (GSIS) where members may borrow
solely for housing purposes. The Pag-IBIG
Fund was created in 1978 based on this idea,
with employers’ contributions as a requisite.
By virtue of Republic Act No. 9679 or the
new Pag-IBIG Charter signed into law in
2009, mandatory membership in the PagIBIG Fund extended its coverage from employees of public and private companies, to
Filipinos working overseas as well.
The new guidelines signed in June 6, 2012
shall apply to housing loans received beginning July 2, 2012. A qualified Pag-IBIG
member shall be allowed to borrow an
amount up to a maximum of P6 Million
with the member’s actual need, loan entitlement with respect to capacity-to-pay and the
loan-to-appraisal value ratio as bases. However, the availability of the loan package for
over P3 to P6 Million shall be limited by the
Fund’s annual funding allocation for the said
package.
Pag-IBIG is an acronym which stands for
Pagtutulungan sa Kinabukasan: Ikaw, Bangko, Industriya at Gobyerno. To this day, the
Pag-IBIG Fund continues to harness these
four sectors of the society to work together
towards providing Fund members with adequate housing through an effective savings
scheme. #
Palawan Chapter hosts local Convention Launching,
inducts 2012 directors, officers
CREBA Palawan Chapter hosted a local launching of the 21st Annual CREBA National Convention in Puerto Princesa City last last
June 14, 2012 which coincided with the inaugural ceremonies of its
new set of directors and officers.
Earlier in the same day, a tri-partite tree planting activity in cooperation among CREBA, the PSCD PALTREE and the provincial government was launched. Hon. Abraham Kahlil M. Mitra, governor of
Palawan graced the launching and the induction ceremonies with his
presence. CREBA’s participation in the tree planting activity is part of
its nationwide environmental conservation and greening initiatives.

According to Charlie A. V. Gorayeb, CREBA national president, the annual national
convention held in the month of October,
serves as CREBA’s major year-end activity.
The convention generates resolutions which
are presented to the legislative and executive
departments of government to assist in the
attainment of the national housing goals.

sustaining the property boom
The property sector is enjoying its most
prolific cycle in recent history. The Philippines’ diaspora of
Global Filipinos
continues to fuel a boom in the real estate market back home. Building means
growth; investments convey progress; good
business leads to an upsurge in economic activity; and domestic growth always
spells good news for the country.
This is the centerpiece of the upcoming
21st Annual National Convention of the
Chamber of Real Estate & Builders’ Associations, Inc. or CREBA – the largest Philippine umbrella organization of the real estate
and housing industry composed of property
developers, builders, contractors, suppliers
and manufacturers of construction materials, real estate service practitioners and other
professionals and entities engaged in 68 allied fields.

of 12 million or about a tenth of the total
Philippine population, the magnitude of the
economic contribution of overseas Filipinos
have long been a major force in terms of remittances, property acquisition and creating
businesses.
According to Noel M. Carino, executive
vice-president and chairman of the convention organizing committee, the spending
power of the middle class has significantly
increased, and the economy continues to
draw strength from a conservative banking
sector, a stable homebuyers market, plus billions in remittances from abroad. “We see
no end in sight for the property industry’s

Laguna Chapter holds 1st Teambuilding and Fun Run
CREBA Laguna Chapter held its first teambuilding activity and fun
run from May 19-20, 2012 at the Development Academy of the Philippines (DAP) Tagaytay City with the theme, “It’s More Fun with
CREBA.”
The 2-day activity opened with an interactive lecture on teambuilding, leadership and organizational development and culminated with
a fellowship night capped with a “Talentadong Pinoy” Contest in
during dinner.
The fun run, designed as a run-for-a-cause, opened in the early morning of May 20, 2012 which was followed by various activities that all
participants as well as their guests and families enjoyed.

Confident Philippine property market spurs

rising investment by overseas Filipino workers (OFWs), is creating competition between
the country’s major real estate players.
Ayala Land has already announced investment plans for 67 new projects, in what the
firm described as an “unprecedented” expansion into new market segments and new

completed in 2011, to total 57,979 units.
Ayala Land said it plans to develop 50 residential projects and three new large-scale retail spaces, which will add more than 140,000
square metres in leasable area.
“We are moving to a period of record expansion,” said Fernando Zobel de Ayala, the
chairman of Ayala Land.

World Bank to help Phl meet housing targets

(WB) is extending aid to the Philippine government to meet its target to eradicate the
country’s housing backlog, Vice President

agreed to provide technical and financial
assistance to the Philippine government to
achieve its goal for sustainable housing for

After his speaking engagement in Malaysia, Binay went to the US and attended the

Earlier, Binay secured the interest of the
Malaysian business community into exploring more investment opportunities in the
Philippines, specifically in agriculture and
agribusiness, housing, finance, tourism and
infrastructure.

New Tax Guideline on “involuntary” sale of properties
The Bureau of Internal Revenue (BIR) has
come out with a new guideline on the payment of taxes in case of auction or involuntary sales of real estate properties, it was
learned yesterday.
Under Revenue Regulations No. 9-2012, the
capital gains tax (CGT), creditable withholding tax (CWT) and documentary stamp
tax (DST) shall be paid by the winning bidder. The tax shall be based on the bid price,
the fair market value, or the zonal valuation
whichever is higher.
“If the property sold through involuntary
sale is under the circumstance which warrants the imposition of the value-added tax,
the said tax must be paid by the VAT regis-
tered owner or mortgagor one month after
the right of redemption expires,” the regula
tion said.
It was signed by Finance Secretary Cesar
Purisima on the recommendation of BIR
Commissioner Kim S. Jacinto-Henares last
May 31.

to undertake construction or energy projects with the government.
Revenue Regulations No. 10-2012 was issued to clarify that joint ventures formed
for other purposes are not exempt from
taxes.
“This is to further clarify the rules in the tax
code and put it in its correct phrase,” BIR
Commissioner Kim S. Jacinto-Henares said,
referring to Republic Act No. 8424 or the
Tax Reform Act of 1997.

“Absent any one of the aforesaid requirements, the joint venture or consortium
formed for the purpose of undertaking
construction projects shall be considered as
taxable corporations,” the regulation read.
Moreover, the joint venture or consortium
does not refer to suppliers of goods, services or capital to a construction project.
RR 10-2012, which takes effect 15 days after
publication, also stressed that licensed local
contractors are required to enroll with the
BIR’s Electronic Filing and Payment System.
The BIR, which is responsible for about
70% of state revenues, collected some
P345.065 billion as of April. The tax agency is tasked to collect about P1.066 trillion
this year.

module attended, while a Diploma in Real
