There was no correspondence
to review.
The Board reviewed and
approved the Monthly Fee
Reports for the month of July
for the
Clerk, Treasurer, Clerk of
the District Court and Highway
Superintendent.
Next, the Board reviewed the
annual Inventories for the following offices: Sheriff, County
Attorney, Cheyenne County
Emergency
Communications
Center, Weed Department and
Visitors Committee. The
remaining Inventories will be
reviewed at the September 2,
2014 meeting after additional
information is obtained.
The Interlocal Agreement
between Cheyenne County and
the City of Sidney regarding
the Sidney Public Library and
Bookmobile was discussed.
County Attorney Paul Schaub,
City Manager Gary Person and
Librarian Doris Jensen were
present. The new Interlocal
Agreement
addressed
the ownership of the 1995
International 3000 Series Bus
Bookmobile
VIN 1HVBBABM9SH669438.
This vehicle is covered by the
County’s insurance carrier,
Nebraska Intergovernmental
Risk Management Association
(NIRMA). Larry Pelan,
Underwriting
and
Risk
Manager for NIRMA, notified the
County that any loss associated
with this Bookmobile, which
is being used and operated by
someone other than a county
employee, would affect the
County’s insurance rates. To
remedy this situation, it was
suggested that ownership of
the Bookmobile be transferred
to the City of Sidney. Under the
terms of the current Interlocal
Agreement, the County is to
reimburse the costs of operating the Bookmobile service. In
lieu of paying the actual costs of
operation, the County is paying
the sum of $8,200.00 to the City
of Sidney for the Bookmobile
service. At this time, it is not
the intention of the Board to
discontinue the current monthly
payments being made under
the terms of the Interlocal
Agreement. The purpose of the
new Interlocal Agreement is
to relinquish ownership of the
Bookmobile as recommended by
NIRMA. A motion was made by
McMillen, seconded by Olson to
table the matter to allow County
Attorney Schaub to
discuss the matter with City
Attorney J. Leef. Roll Call: Aye:
McMillen, Winkelman, Olson.

County Treasurer Diane Scott
reported to the Board on the
pledged securities of Cheyenne
County. A motion was made
by McMillen, seconded by Olson
to accept the pledged
securities report as presented. Roll Call: Aye: Winkelman,

issuance of Health Care
Facilities bonds in the principal
amount of up to $32,000,000.00.
Present were Cheyenne County
Attorney Paul Schaub; Jason
Petik, CEO of Sidney Regional
Medical Center; Kelly Utley,
CFO of Sidney Regional Medical
Center; and Amber Presley from
Baird Holm, Bond Counsel for
Sidney Regional Medical Center.
Also present via telephone
was Lauren Wismer, Cheyenne
County Bond Counsel.
Notice of the meeting was
given in advance thereof by
publication in the Sidney-Sun
Telegraph on August 7, 2014,
and notice of the meeting was
given to all members of the
Board. Availability of the
agenda was communicated in
the advanced published notice
and
the notice given to the members of the Board. The matters
shown below were on the
agenda established for at
least twenty-four hours prior to
commencement of the meeting.
All proceedings hereafter
shown were taken while the
convened meeting was open to
the
attendance of the public. At
the beginning of the meeting
the Chairperson publicly stated
to
all in attendance that a current copy of the Nebraska Open
Meetings Act was available for
review and indicated the location of such copy posted in the
room where the meeting was
being
held.
Chairman
Winkelman then introduced
Resolution 2014-28, (a true,
accurate and complete copy of
which is attached hereto), pertaining to the financing of a
portion of the costs of acquiring, constructing, equipping and
furnishing an approximately
132,000 square foot replacement hospital and medical clinic
for Cheyenne County Hospital
Association, Inc. d/b/a Sidney
Regional Medical Center (the
“Hospital”), including ancillary
parking areas, landscaping
and associated site work, buildings and other improvements
(the
“Project”), located at 1000
Pole Creek Crossing, in the City
of Sidney, Nebraska, and, as
applicable, funding debt service reserve funds, capitalized
interest, and paying costs of
issuance associated with the
Bonds and the approval and
issuance by the County of up
to Thirty-Two Million Dollars
($32,000,000) of revenue bonds
(payable solely from the
revenues of the Project and
other security provided by the
Hospital). A motion was made
by Olson, seconded by
McMillen that said Resolution
2014-28 be adopted. Roll Call:

Board
reviewed
Resolution 2014-29 allocating
real and personal property tax
for fiscal
year 2014-2015 to political
subdivisions. Tammy Nelsen
and Ed Bivens were present.
Ms. Nelsen spoke regarding the
allocation of tax dollars to the
Cheyenne County Historical
Association. A motion was
made by McMillen, seconded by
Olson to adopt Resolution
2014-29 allocating real and
personal property tax for fiscal
year 2014-2015 to political
subdivisions as follows:

At 9:52 A.M., a public hearing
was held to review and consider
approval of an application
from Kathleen K. and Quentin
E. Hodges for a 10 acre subdivision located in the South Half
of the North Half of Section 4,
Township 13 North, Range 47
West of the 6th P.M.,
Cheyenne County, Nebraska
to be known as Hornicek
Subdivision and an application to rezone the property
from Agricultural to Residential
Estate. Present were Cheyenne
County Planning and Zoning
Administrator Colleen Terman,
Bruce Nienhuser and Quentin
Hodges. Administrator Terman
reported that on July 28, 2014,
the applications were reviewed
by the Planning and Zoning
Commission with the recommendation that they be forwarded to the
Board of Commissioners for
final approval. A motion was
made by Olson, seconded by
McMillen to adopt Resolution
2014-30 approving the applications as presented. Roll Call:

Jeff Kelley from the Panhandle
Area
Development
District
updated the Board on the
activities of the District.
Kip Miller, treasurer of the
Cheyenne County Fairboard,
reported on the activities of
the 2014 County Fair. Weston
Gouger from 360 Energy
Engineers, introduced himself
and provided information
regarding the services the
Company provides such as
design, implementation of capital, infrastructure and energy
improvements to facilities.
Highway Superintendent Tom
Noel updated the Board on road
activities. There were no comments from the public.
There being no further business to come before the Board,
Chairman Winkelman declared
the meeting adjourned at
11:30 A.M.

Sidney Watershed Project

2014

Design will begin on the
water quality and flood controls
measures proposed in the East
Sidney Watershed Project. The
measures will help slow down
runoff, filter out pollutants and
reduce potential damage due to
flooding. The project includes
bioswales and bioretention
areas. Funding for the project
has been applied through a loan
with the Nebraska Department
of Environmental Quality State
Revolving Loan Fund (SRF). The
Joint East Sidney Watershed
Authority (JESWA) is comprised
of officials from the City of
Sidney and South Platte NRD.
The City of Sidney is the applicant for the SRF; however, the
South Platte NRD is committed
to funding and providing in-kind
support for the project.
Previously, the project was
presented at City Council meetings and NRD Board meetings.
Now, a public meeting will be
held to ask the public to share
thoughts and concerns about
the project so design engineers
can incorporate public feedback
into the design.
Construction on the project is scheduled to start next
summer and be substantially
complete by early 2016. The
construction schedule will be
dependent upon the permitting
requirements and right-of-way
acquisition process.
