PROGRAMME MAP INTRODUCTORY | DRAFTING UNIT ONE Introduction This Unit serves as an introduction to the banking industry of India as we see it today. In this Unit, we will briefly look at the history and evolution of modern banking around the world. We will then try and understand what it means to be a commercial bank in today’s world. Finally, we will look at the key milestones in the evolution of banking institutions in India. UNIT TWO General Principles of Drafting In this Unit, practical issues of style and format are discussed to assist students in setting up their documents. The Unit then moves on to a discussion of how drafters identify the issues that need to be included in documents. UNIT THREE The Legal Framework for Contracts The Indian Contract Act, 1872 governs contracts in India. In this Unit, students are taken through the major provisions of the Act, how it effects the structuring and provisions of contracts, and what elements need to be present to ensure that a contract is valid. UNIT FOUR Structuring a Commercial Contract Students learn the most effective manner in which to structure a commercial contract, and understand the kinds of things that need to be kept in mind while structuring contracts. Students are also provided with a set of rules that must be followed when drafting any contract. UNIT FIVE Identifying Issues and Negotiating Terms of a Contract In this Unit, students learn about different negotiation strategies and will understand the importance of healthy negotiations, and how that helps the drafting process. The Unit will also provide valuable practical advice on how to incorporate negotiation points into contractual documentation. UNIT SIX Drafting Notices This Unit moves on from contracts to consider another important form of legal document, the notice. Students learn how to identify those situations in which it is suitable to use a notice, as well as the tone and style of the document. Finally, the Unit sets out the main elements of all legal notices. UNIT SEVEN Basic Rules for Drafting Pleadings This Unit covers the fundamental aspects of constructing proper and effective pleadings. There is a discussion of the function of pleadings, before moving on to an outline of the different kinds of pleadings, and the basic rules for drafting them. UNIT EIGHT Reviewing and Editing Your Drafting In this Unit, the final steps in every drafting process are laid out. Students learn that it is professional and proper to take the time to properly review and edit all legal documentation.
