Illias Pardalidis, January 27, 2004 Respondent, a licensed mobile food vendor, appeals a finding of violation of section 81.15(a) of the New York City Health Code for selling food without having a food protection certificate available for inspection. The notice of violation charged that on 2/05/01, the issuing officer ("IO") observed the respondent selling shishkabob, hot dogs and sodas from a processing push cart without his food protection certificate. Section 81.15(a) requires any person who is charged with the supervision of the operations of a food service establishment or non-retail food processing establishment to obtain a certificate issued by the Department of Health after successfully completing a course in food protection and passage of an examination. Subsection (b) provides that "Such certificate shall be available for inspection at all times by the Department." The administrative law judge ("ALJ") found that the food certificate was not immediately available for inspection by the IO. On appeal, Respondent submits the food protection certificate, dated 4/18/80, and reiterates his explanation that he was busy with 2 or 3 customers when the IO approached and asked for his documents. He gave the IO his license, which he was wearing and admits the food protection certificate was not immediately available but was shown to the IO shortly after he finished serving his customers. Petitioner did not answer the appeal. A review of the audiotape of the hearing confirms that respondent admitted that the food protection certificate was not immediately available for inspection. The statute is clear that the certificate must be available for inspection at all times and does not provide any exceptions. Assuming without deciding that the 1980 food protection certificate is valid in 2001, it was not made available immediately.
