Recruitment Industry
Definitions
Client
An organisation, including government, engaging and utilising the services of a provider of
on-hire worker services, contracting services, contractor management services, permanent
placement services or workforce consulting services.
Candidate
A person seeking work through a recruitment or on-hire firm, whether as an employee,
independent contractor, officer or otherwise.
Permanent Placement
The placement of a candidate with a client by a recruitment firm where that client employs or
engages the candidate directly.
Consultant
An individual engaged by a recruitment or on-hire firm to provide professional recruitment
or consulting service assistance to candidates to assist them to obtain suitable work and to
assist clients to find suitable candidates and on-hire workers.
Contractor
An independent contractor (see definition below).
Contracting Services
A commercial (business to business) service where an organisation, in return for a fee,
completes a defined scope of work for a third party (Client). Such services may be performed
utilising employees or sub-contractors employed or engaged by the service provider.
Workforce Consulting Services
A commercial service where a firm, in return for a fee, identifies and/or responds to client
workforce issues and implements strategies designed to assist clients to achieve business
success. For example, work health and safety, equal employment opportunity, employee
relations, human resource management, change management, organisational development
and outsourcing.
Managed Project/ Contract
Services
The provision of project/contract services to an organisation where the client has outsourced
defined operational functions. Typically, organisations providing this service shall be
responsible for the delivery of a contract package including labour, plant, management, and
associated systems of work.
The service provider directly engages, manages, supervises and instructs employees and
sub-contractors in the performance of work to ensure contract completion.
On-Hire
The on-hire of a worker by an on-hire firm to a client, where such worker works under the
general guidance and instruction of the client or a representative of the client.
On-Hire Employee
An individual employed and on-hired to perform work for his or her employer’s client under
that client’s general guidance and instruction at a location nominated by the client.
On-Hire Firm
An organisation which, in return for an hourly fee, on-hires employees and/or independent
contractors to perform work for a third party (client) under the third party’s general guidance
and instruction.
On-Hire Worker
An individual engaged as either an employee or independent contractor to perform work,
on assignment, for a client of an on-hire firm under that client’s general guidance and
instruction.
On-Hire Employee Services
The provision of services by an organisation that on-hires one or more of their employees
to clients to perform work under that client’s general guidance and instruction at a place
nominated by the client.
On-Hire Worker Services
The provision of services by an organisation that on-hires employees or independent
contractors to clients to perform work under that client’s general guidance and instruction at
a place nominated by the client.
Placement
The supply of a candidate to a client who subsequently employs or engages that candidate
directly.
Permanent Placement Services
A commercial service where an organisation, in return for a fee, recruits on behalf of a
third party (client) candidates that match a desired profile for employment or engagement by
the client.
Assignment
The assignment of an on-hire worker to a client to perform work for the client in accordance
with the client’s needs.
Recruitment Services
The provision of services where an organisation acts to recruit appropriate candidates that
match a desired profile, on behalf of a client, for employment or engagement by the client.
Casual Employment
The engagement of an individual where the contract of employment is by the hour. The
hourly rate of pay of casual employees typically incorporates a loading to compensate for
additional entitlements commonly enjoyed by permanent employees.
Fixed Term Employment
The engagement of a permanent employee for a specified period or “fixed term.”
Outsourcing
Where an organisation, that has been carrying out certain functions in-house (using
direct employees), arranges to have that work performed by an external service provider.
Outsourcing usually occurs when an organisation decides to concentrate on “core” business
and to outsource activities which are deemed to be non-core.
Independent Contractor
An individual who operates his or her own business and who is engaged under a contract for
services (a commercial contract rather than an employment contract). It includes situations
or arrangements where the worker has a direct relationship with a client as well as where
they obtain work through an intermediary like an on-hire firm. Independent contractors are
more likely to be focused on the provision of personal service to clients than upon managing
staff or a business and may include individuals engaged as sole traders or through a
partnership, trust or company.
Candidate Fees
The charging of a sum for the provision of representation services for a candidate.
Deemed Employees
Individuals engaged as independent contractors considered by the courts, or a tribunal, to be
employees at law because of the ‘employee-like’ way they work. Commonly such workers are
deemed to be employees because of a range of factors called ‘indicia’.
Member
Means a person or company who holds any category of membership of RCSA that is
recognised under its constitution and who has signed, or is required by the Board to sign,
a statement of commitment to the Constitution, the Code for Professional Conduct, the
Disciplinary and Dispute Resolution Procedures, and the By Laws; and includes APRCSA,
MRCSA, FRCSA, FRCSA (Life) and Affiliate for Individual members.
Professional Practice
Means a practice in connection with or in the course of providing an employment Service.
Board
Means the Board of Directors of RCSA.
