Mayor Arlene J. Mulder called the meeting to order at 7:15 PM.

1. CONSIDERATION OF RECOMMENDING TO THE LIQUOR COMMISSIONER THE

ISSUANCE OF A CLASS “E” LIQUOR LICENSE TO TNL RESTAURANT, INC., DBA

BURGER BARON II, LOCATED AT 132 E. GOLF ROAD. (FORMER GARIBALDI’S

RESTAURANT)

Mayor Mulder swore in Sam, George, and Toula Louckes who were present for consideration of a

“Class E” (Beer & Wine only) license to the Burger Baron II restaurant.

Ms. Mikula presented the staff report for Burger Baron II. She conducted a site visit on January

16. The applicants opened the restaurant in March 2012 and determined that as an added amenity for their customers, they would like to offer beer and wine for sale. The applicants propose to sell bottles of beer and wine which will be located behind the counter in an upright cooler. No physical modifications will be necessary.

Ms. Mikula further reported that on December 13, 2012, the Arlington Heights Police Department conducted a background check on Sam, George, and Toula Louckes. Sam has 50% interest,

Toula has 40% interest and George has 10% interest in the business entity. No convictions were disclosed and no derogatory information was found.

In the liquor application, Sam Louckes disclosed that he holds a liquor license for the Burger

Baron located at 1381 W. Grand Avenue, Chicago, IL. The Arlington Heights Police Department contacted the City of Chicago and found that in 1995 there was a liquor violation of a sale to a minor. This was disclosed by Mr. Louckes on his Arlington Heights liquor application.

In response to various questions the applicants indicated that they all received Basset training.

Their closing hours are 9 PM during the week and 10 PM on weekends. They also indicated they would look into recycling for the bottles and cans.

Various Trustees indicated that good reviews have been received about their food. The Louckes indicated they enjoy hosting community and school groups.

TRUSTEE HAYES MOVED, SECONDED BY TRUSTEE GLASGOW TO RECOMMEND THAT THE

VILLAGE BOARD OF TRUSTEES RECOMMEND TO THE LIQUOR COMMISSIONER THE

ISSUANCE OF A CLASS “E” LIQUOR LICENSE TO TNL RESTAURANT, INC., DBA BURGER

BARON II, LOCATED AT 132 E. GOLF ROAD. (FORMER GARIBALDI’S RESTAURANT)

Upon a voice vote, the motion passed unanimously.

VOTE: 6 AYES – 0 NAYS

At this point, Trustees Breyer, Farwell and Scaletta arrived.

2. DISCUSSION OF A CLASS “AA” LIQUOR LICENSE FOR STAR CINEMA GRILL,

LOCATED AT 53 S. EVERGREEN AVENUE (FORMER ARLINGTON THEATERS).

Mayor Mulder swore in Umer Khan who was present for the discussion of a “Class AA” (Full

Service Restaurant) liquor license at 53 S. Evergreen Avenue.

The applicant is scheduled before the Plan Commission on Wednesday, January 23, 2013. If this project receives a favorable recommendation from the Plan Commission, the matter of the liquor license will be brought back to the Board at a subsequent meeting.

Ms. Mikula presented the staff report for Star Cinema Grill. Star Cinema Grill’s concept is a dinein movie theater format where patrons sit at a table and are provided food and drink service from a dedicated server. She referenced the attached business plan and photos which describe the dine-in movie theater concept.

On December 18, 2012, the Arlington Heights Police Department conducted a background check on Umer Khan who has 100% interest in the business entity. No convictions were disclosed and no derogatory information was found.

In the liquor application, Mr. Khan disclosed that he holds a liquor license at three Star Cinema

Grill locations in Texas. He indicated he has never had a liquor violation in his eight years of operation.

Mr. Khan indicated that he will be installing a full kitchen which will consist of approximately 100

“American Grill Style” menu items. All food and drink service is seat side. Just as in traditional restaurants, there is a server assigned to each table. Inside the tables there is a copy of the restaurant menu along with order cards. If the guest would like to order anything from the menu, they write down the desired items and press the paging button that is located on the table. When paged to the table, the server will review the order with the guest and then input it to the system. Once prepared, the items are delivered to the guest’s table.

Star Cinema Grill will have six auditoriums. Each auditorium has a row of tables in front of every row of movie theater chairs. There is one table for every two chairs which are leather lounge chairs.

In response to questions about server training, Mr. Khan indicated that each server goes through a weeklong training program that includes classroom and practice time. During this training they are tested on menu and policy knowledge. Part of the classroom aspect of training includes Alcohol Serving Guidelines. Some of the Alcohol Serving Guidelines include:

 Every guest consuming alcohol must have a valid, picture, government issued

Identification.

 Only one Alcoholic Beverage per Identification at a time shall be served.

 Anytime a guest has consumed three alcoholic beverages, and is attempting to order a fourth, a member of management must be notified and approve the request.

 Everyone involved in Alcohol Service has to have an up to date, valid BASSET card.

The servers are also trained to deal with disturbances so all guests can enjoy the movie experience. 90% of orders are taken before the movie begins. They stop selling food and drinks

30 minutes before the end of the movie so the servers can process payments.

Mr. Khan stated that the planned hours of operation will be from 11 am until 1 am Sunday through Thursday and 11 AM until 2 AM Friday and Saturday. Movie times vary based upon demand and movie releases including some midnight screenings.

In response to security and employee questions, Mr. Khan indicate that during the peak summer season they employ up to 120 people and off-season employment is around 75. General

Managers will consist of those with more restaurant experience. He will also hire security personnel during various weekends, holidays and prime movie releases from 6pm to close.

He has a 15 year lease including (2) 5 year extension options. He anticipates the price point for movie tickets will be $9 to $10 per head as he wants to keep pricing competitive.

The proposed age restriction in Arlington Heights would differ from the Texas operations where they normally do not allow anyone under the age of 18 without a parent or a guardian at any time. This has proven to be a very vital part of their operation and one of the main reasons of their success. In Arlington Heights the plan is to adopt an all-ages policy until 6 PM, where there would not be any age restrictions for guests. After 6 PM, anyone under the age of 18 years old would have to be accompanied by a parent or a guardian.

When asked how employees check IDs and turn away someone who does not have an ID or does not appear old enough, Mr. Khan stated that it is a judgment call and they can ask to meet with management so they are known to the theater. He said many people are repeat customers and staff gets to know them.

Various Trustees asked about the age restriction after 6pm. Mr. Khan indicated that he is trying to find a balance between anyone under 18 being accompanied by an adult as his three existing movie theaters have good behavior by patrons and is a positive movie experience for all. They are extremely family friendly with family films being some of the highest grossing movies.

Various Trustees stated their opinions that they believe the age restriction will alienate teenagers and parents. Teens that can drive will go to nearby Randhurst rather than staying in

Arlington Heights. Teens are used to going to the movies at Arlington Town Square and parents feel it is a safe environment.

Mr. Khan responded that he has not drawn a hard line on the age restriction. After hearing feedback he is open to making it all ages and testing it to see how it works. He wants to be perceived as friendly to all ages and be a valued business in Arlington Heights.

Mayor Mulder thanked Mr. Khan for his consideration of removing the age restriction and notes that he is adaptable to modifying his business plan. With the significant family population of

Arlington Heights, this consideration will be appreciated.
