PLEASE READ THIS DOCUMENT CAREFULLY AND KINDLY INITIAL EVERY PAGE OF THIS DOCUMENT
To use the internet and email facilities at Blake Hall College (“the College”) the policy is being implemented as the College
believes that the electronic media is a valuable tool that contributes and enhances learning and it should be protected to
ensure that the ongoing processes are to the benefit of all users.
The College is committed to ensure academic freedom. Therefore, the College will use the policy as a tool to guarantee the
appropriate and proper use of the facilities to the benefit of all the users at the College.
The use of the College’s electronic communication facilities is subject to the official Electronic Communication Policy as set
out in the policy and in any other relevant policy provisions and procedures that the College will from time to time append.
If a user does not agree with this policy he or she has no right to the use of the facilities.
The College hereby informs and reminds the users of the internet and email facilities at the College, that failure to comply
with the policy might lead to legal consequences and/or possible expulsion from the College. Users are to note that use of
the facilities might be monitored and prompt the College to respond to any potentially damaging or harmful actions whilst
using the facilities, which in turn might lead to the loss of the access to all or some facilities.
Should failure to comply with the policy lead to any cost implications, the College expressly reserves the right to a user in
the absence of an agreement to the contrary.
Offensive material that is distributed in any way by a user will lead to a disciplinary action from the College and/or may
lead to legal action.
Please note the following:

Use of the facilities is primarily for use in your studies.
Personal use is to be restricted as users will be allowed to store up to 30 MB data on the College network (X: ).
Should you need more space, you will be able to obtain it at £5 per 10 MB.
(Apply in writing to the Head: IT & Administration and motivate your request. Upon approval please allow 1 work
week for the extra space to be activated. This will be implemented as from 01 April 2006 but is subject to change
without prior notification.)
It is forbidden to transfer/ download/ copy the following data types for personal use:

Any information that would infringe copyright, unless written authorization from the author or distributor is
issued.

Any form of audio files (e.g. .mpeg)

Any form of video files (e.g. .avi)

Any form of graphic files (e.g. .jpeg, .bmp, .gif)

Any executable files (e.g. .exe)

Any software that has not been authorised in writing by the Head : IT and Administration

Or any combination of the above
The user shall under no circumstances use the facilities at the College:

To create, send or store any offensive, obscene or indecent images, data or other material, or any data capable
of being resolved into obscene or indecent images or material

For the purpose to create, send or store communications which in the discretion of the Principal or his nominee
may lead to a breach of confidentiality

In any manner that would infringe upon any other person’s right of personality or intellectual property rights.

For the purpose of making available any personal information in the possession of the College, obtained through
the use of facilities to a third party without prior permission of such a person.

To violate or attempting to violate the terms of any telecommunications license (e.g. privacy, confidentiality and
security)

To access or attempt to unlawfully access the computer network or any electronic system of the College or any
other system or gaining or attempting to gain unauthorized access to any person’s computer, email or voicemail
facilities or equipment

To obtain or attempt to obtain any communication not intended for the user. The user shall in particular not
attempt to intercept or inspect communications transmitted or being transmitted or stored by means of the
College’s facilities or by means of any hardware connected to these facilities, unless the information is intended
for the user

For the purpose to damage, alter or attempt to alter the hardware and system configurations of the facilities
unless authorised to do so
To the contravention with regard to the use of passwords (see “the user is responsible to:” section)
To create, send or store material which is designed or likely to cause annoyance, inconvenience or needless
anxiety
To create, send or store material likely to offend or upset which might result in legal action
To transmit material that infringes copyright
To send unwanted commercial or advertising material to any other organizations connected to other networks
Download software that has not been authorised by the Head: It and Administration
Deliberate unauthorised access to facilities or services accessible via the Internet
Deliberate Activities with any of the following characteristics:
 Corrupt or destroy other users’ data
 Violate the privacy of others
 Use the internet in a way that denies access to the others
 Any other misuse of the internet or network such as the introduction of viruses
The user is responsible to:

Safeguard passwords or any other related security information to the facility that has access to the College
network whether permanently linked or not

Take reasonable precautions to prevent unauthorised use of the facilities by other persons, including
maintenance and file protection measures

Use the facilities only for the purpose for which the user has been authorised

Verify his/ her identity in the electronic environment and keep passwords safe

To log off from open sessions of the facilities. Should the user fail to comply with this responsibility he/ she shall
be responsible for any activities that may take place under his/ her username as a result of such failure. This will
include any account damage that may rise from the said activity.
The user shall not at any time or for any reason use a password or username belonging to another person, not even with
express permission, provided that a user may allow another user the right to access to his/ her electronic accounts.
Should the networks of another organization be accessed from the college facilities, users are to comply firstly with the
policy of the College, then with the policies of the other organization.
Consequences of violation:
The violation of the aforementioned policy shall be treated as misconduct and may result in one or more of the following
actions:

Restriction, suspension or termination of the user’s access to the facilities including temporarily suspension of
his/ her access or rights pending further investigations

Legal proceedings by the College including but not limited to criminal prosecution under applicable laws

Disciplinary actions against the user which the user which may in the end lead to his/ her suspension or dismissal

(hereinafter referred to as “the Student”) agree to and confirm the following terms and conditions (set out below) in
respect of my studies and all activities relating to such studies, in whatsoever manner and accept this agreement as
being contractually binding and acknowledges my responsibility to adhere to these terms and conditions of Blake Hall
College (“BHC”) as set forth below:

RULES OF BLAKE HALL COLLEGE
The Student agrees and submits to the rules, regulations and procedures of BHC in respect of all aspects of his/her
association with BHC and confirms that he/she takes full responsibility to acquaint him/her with such rules, regulations
and procedures. All these rules, regulations and procedures are available on our website (http://blakehallcollege.co.uk)
and soft copies are available on request
1.1. The Student agrees that BHC may amend such rules, regulations and procedures and confirms that such
amendments will become effective after being given reasonable notice by BHC.
1.2. It is the student’s sole responsibility to ensure that current and up-to-date particulars (including personal
contact details and visa status changes) are communicated in writing within 7 days of such change.
1.3. Disciplinary action will be taken against students for any inappropriate form of behaviour or conduct which
can lead to suspension/termination.
INDEMNITY
The Student agrees and confirms to undertake all studies and related activities at his/her own risk and that no action
for damages or loss (including but not limited to theft, injury or death) arising from any cause or nature whatsoever;
be considered the responsibility of BHC, regardless of the fact that such damage or loss may have been occasioned by
negligence on the part of BHC or its personnel, agents or any other person for whom BHC may be vicariously liable.
2.1. The Student agrees and undertakes to indemnify BHC and not to hold BHC responsible in respect of any
damages or losses considered above.
2.2. Changes may occur to time tables and the academic year plan. Students are therefore advised to check with
the Student Union or their Course Leaders about term dates before planning holidays or breaks from the
College. The College cannot be held responsible for any bookings that have been made for incorrect dates.
STUDENT VISAS
Under circumstances where the granting of a student visa is a prerequisite for study; the following terms are agreed
to by the student and will specifically apply:
3.1. BHC does not affect such applications and is not responsible for the success of any application. It is recorded
that the United Kingdom Border Agency grants such applications within its sole discretion.
3.2. The Student will specifically adhere to all rules, regulations and requirements as stipulated by the Home
Office and BHC regarding a student visa. These rules, regulations and requirements are available on
https://www.gov.uk/government/organisations/uk-visas-and-immigration
and regular links are updated on the BHC website referring to Tier 4 visa updates by UKVI.
3.3. Students that are in the UK and applying for a new CAS are required to provide a certificate of posting as
evidence that he/she has submitted an application to the UKVI.
3.4. Should the student fail to adhere to the rules of the Home Office, BHC is sanctioned to report the student to
the Home Office.
3.5. The student understands and agrees that in the event of the student being subject to student visa regulations
(and if the student does not adhere to the regulations), BHC can provide the Home Office with the student’s
personal contact details.
3.6. The student understands that in the event that he/she completes their studies before their visa expires, BHC
is required to inform UKVI of their completion. If the student intends to continue with further studies, they
must re-enrol in their chosen course prior to the end of their academic year in order to ensure that a new
CAS can be issued and UKVI informed of the change promptly. The student should be aware that a new CAS
can be issued only if the continuation of studies represents an academic progression from the previous study
(see the Tier 4 Policy Guidance version 07/2014 at

3.7. The student is required to attend all academic classes, according to the rules, regulations and requirements
as stipulated by the Home Office and BHC regarding a student visa.
3.8. The College will reassess the student and may issue the student with a new CAS subject to satisfactory
performance. Once the CAS has been issued it is recommended that the College should require the student
to provide a certificate of posting as evidence that he/she has submitted an application.
4.
FEES
The Student agrees and confirms that no refund of fees will be made, under the following circumstances:
4.1. Regardless of whether or not a course has commenced and whether or not the student is able or unable to
start or continue the course due to matters beyond the control of the student
4.2. In the event of a declined student visa where the student was unable to meet the criteria of the visa
application (i.e. insufficient funds or inadequate sponsors, incomplete application submission or any reason
where the applicant is accountable for)
4.3. BHC (in its sole discretion), may consider to refund the student in the case of an unsuccessful visa application
(except for reasons pointed out in 4.1 & 4.2 stated above) subject to:

4.3.1. Fees paid to 3rd parties are non-refundable
4.3.2. An administration fee of £250.00 will be withheld
4.3.3. An administrative fee of £500.00 will be withheld if the student joined the College under the Refer-AFriend scheme.
4.3.4. Any refund amount payable (referred to in 4.2), will be retained by BHC until such time as BHC
receives notification in writing together with satisfactory and official correspondence from the Home
Office i.e. GV51 form (all pages
relating to refusal) and/or AIT-2 form (in case of appeal/s ) on the
declined
student visa and all original documentation issued to the student is returned (as
per the refund policy and procedure form RF01)
Once the student has commenced the course, fees will not be refunded. In exceptional cases, fees will be
deferred for a period as per the Principal’s approval and in line with the UKVI regulations
No fees will be refunded 6 months after the enrolment date
An administration fee of £250 will be applicable to all refunds
BHC reserves the right to cancel or postpone a course, or part of a course, if there is insufficient demand
In the event where a student loan agreement is entered into; the student agrees to the following:
4.8.1.1. It is the student’s responsibility to ensure payments are made in accordance with the
agreement
4.8.1.2. In the event where the student does not meet a payment date:
4.8.1.3. Late payment charges of £50 per instalment per month will be levied for the arrear instalments
and is cumulative
4.8.1.4. BHC reserves the right to claim the full outstanding balance on the student’s account with
immediate effect
4.8.1.5. A £100 administration charge will be levied where a new payment plan is issued
4.8.1.6. BHC holds the right to:
4.8.1.6.1. Cancel the students registration and/ or
4.8.1.6.2. Withhold any results/academic records (certificates etc) and/ or
4.8.1.6.3. Refrain from registering the student for any given assessment (s)/ examination (s)/
assignment (s) and/ or
4.8.1.6.4. Prohibit the student from sitting any given assessment (s)/ examination (s)/
assignment (s).
4.8.1.7. Such cancellation will not affect the student’s obligation to settle the outstanding balance on
his/her account. Any fees (including but not limited to debt collection agencies and small claims
court costs incurred in the collection of the outstanding amounts) will be charged to the students
account and considered payable immediately
4.8.1.8. BHC may take any reasonable action which it may consider necessary to
recover
the
outstanding monies
4.8.1.9. BHC reserves the right to prohibit the student from accessing the premises of BHC

EXTENSION OF ENROLMENT PERIOD
In the event where the student fails to complete his qualification within the period he/she has registered for he/she
will have to extend his enrolment and pay the extension fee applicable (2012 - £780 per quarter)
5.1. Where the student has enrolled in advance for a further year of study and fails to complete his/her current
year in the prescribed time; a proportion of the fees paid in respect of the next year of study will be
proportionally allocated to cover the period of extension and the student will have to settle the shortfall in
respect of the further year of study as per new agreed payment plan.
SPONSOR’S RESPONSIBILITY
Where the student obtained a sponsor in support of his/her student visa application, the student accepts:
6.1. Failure to settle any outstanding fees to BHC triggers the sponsor’s responsibility of supporting the student
“in the event of the student not being able to support him/herself” and BHC can pursue any outstanding fees
from the sponsor
6.2. It is the student’s responsibility to inform the sponsor of this risk and responsibility
ATTENDANCE SYSTEM
7.
The College's intensive efforts to enhance student employability and academic progress depend on students fulfilling
their contract with the College by attending prescribed classes. A record of attendance is maintained for each
student of BHC, which is done through:


Biometric fingerprint system, and
Paper based attendance registers, which includes an Optical Character Recognition (OCR) system.
Biometrics units are installed in every classroom and students are required to touch in and touch out to mark their
attendance of each morning or afternoon session.
7.2 Classes at the College will occur between 8: 00am and 6pm and attendance is be compulsory. In case a
student has attended less than 80% of classes without any proven and accepted extenuating circumstances,
the College will have the right to refuse the acceptance of student assessments or sitting for course
examinations.
7.3 Students who leave classes before their conclusion without the permission of the lecturer will be regarded
as not having attended the class and marked as absent on the Optical Character Recognition (OCR)
attendance register.
7.4 Unless there are exceptional extenuating circumstances, late submission of assignments will not be allowed
and no extensions will be provided. In case a lecturer has refused an extension of the date of submissions,
only a decision by the Director of Studies in consultation with the Course Leaders can overturn the refusal
based on reasonable grounds.
7.5 Lecturers have the right to allow break periods, but students are expected to return and be seated before
the end of the break period arranged by the lecturer. Lecturers have the right to deny students who come
late after the break period entry into the class or to impose reasonable and proportionate extra academic
duties on them.
COUNCIL TAX LETTERS
8.
Council tax letters will only be issued where students meet the requirements.
These requirements are as follow:

Attendance is in line with BHC requirements as published in the Student Handbook of Academic
Regulations.
8.3
Should the circumstances change, it is the student’s responsibility to inform the council accordingly
8.4
The student acknowledges that BHC will not be held liable for fraudulent use of council tax letters and
accepts full responsibility to ensure the requirements are met and adhered to on a continuing basis

Where BHC becomes aware of misuse, BHC may inform the relevant council accordingly

LIBRARY
Library books are to be used in the library only and are not to leave the premises at any time

Students not adhering to these rules can be penalised by:

Being issued a fine to compensate for the damage caused.
CANCELLATION OF STUDIES

In the event of the student having been issued with a Confirmation of Acceptance of Study (CAS) number upon
cancelling his/her studies, he/she will be liable for the outstanding balance of the fees and BHC may take the
necessary steps to recover any outstanding amount together with costs incurred in the collection anywhere in the UK
or the student’s home country

The student has hereby given permission to BHC to pass his/her contact details and personal information onto the
Immigration Authorities where he/she does not adhere to the Student visa rules and regulations
11.1 The student accepts and approves of the fact that BHC may pass their personal details onto a 3rd party debt
collection agency where he/she is not

11.2 The student accepts and approves of the fact that BHC may pass personal details onto
the

Collaborative Partners and Awarding Bodies.
ACADEMIC TERMS AND CONDITIONS
Blake Hall College welcomes the opportunity to assist its students to fulfil their dreams and professional ambitions.
To support and guide all those who are serious about their studies and professional employability, the following
conditions will apply to all courses, diplomas and degrees taught at the College.
12.
English testing as a prerequisite
Good English is a precondition for employability and academic success. New students will therefore
not
be
registered for the biometrics or be issued any letters for the bank and other facilities unless they have achieved the
required score on a Secure English Language Test (SELT). Those who are late entering into the College during a term
will not be biometrically registered or receive any letters for the bank and other services unless they show
Administration a SELT which meets the entry criteria of their course.
13.
Academic and professional standards
It is expected that students will take responsibility for their academic progress and professional development, and the
college will support all those who are committed in this regard.
Postgraduate students who have failed a course assignment or examination will be allowed one further chance and
undergraduate students two further chances to write an assignment or examination, subject to payment of a set fee.
13.1 Any student, postgraduate or not, will be held to have an unsatisfactory academic performance when one or
more of the following conditions are deemed to exist:
13.2 Has failed 40% or more of the enrolled course load in any given teaching period.
13.3 Has failed to comply with conditions prescribed in an academic performance improvement plan.
13.4 Has failed a course for the second time.
13.5 Has demonstrated that progress through the programme will not allow completion of the course in the
maximum time allowed for that programme.
13.6 Has demonstrated that progress through a course will not allow completion of that course in the expected
duration for that course and has not shown compelling circumstances to explain the lack of progress.

13.7 Has failed to meet progress requirements prescribed by UKVI or other regulations that affect eligibility for a
student visa.
13.8 Has been deemed not yet competent in the same course/module for the second successive enrolment.
A student who has demonstrated unsatisfactory academic performance in a semester or other quarter, depending
on the time span of the module offered, or whose performance suggests that they may be in need of explicit
learning support to maintain good academic progress will be deemed ‘at risk’ of unsatisfactory progress.
A student who has been found to make unsatisfactory academic progress for a second teaching period in the same
program may be deemed to have established unacceptable academic progress. A student who is deemed to have
established unacceptable academic progress will be required to show cause why they should not be excluded from
the college.
In the case of students studying on a student visa, UKVI requirements may be breached if unacceptable academic
progress is established. The college is obliged to make reports to relevant parties at the conclusion of any internal
and external appeals processes.

Plagiarism
Plagiarism is the act of taking ownership of someone else’s words without permission. Students should be aware that
BHC considers plagiarism a serious offence and will follow the procedures outlined in the Academic Misconduct Policy
to deal with allegations of plagiarism. Depending on the individual case, the penalties may range from a mark of zero
being awarded for the assessment in question to exclusion of the student from the College.

OTHER
In the event where any clause or sub-clause are for whatever reason nullified, the nullification will only be applicable
to that clause or sub-clause and will not affect any other clauses and sub-clauses in this agreement and the
agreement will stay in force
16.1 Where previous terms and conditions were signed by the student; this agreement will replace such
agreements from the date of signature
16.2 Student will be notified of any amendment on this policy, and amended policy should replace this policy
from the date of notification.

16.2 Any party shall be able to change his address details by written notice to the other. Such change of address
details shall take effect on the fourteenth day after the delivery to the other parties of the notice referred
to therein
All notices in terms of this agreement shall be in writing and shall be either:
16.2.1. Delivered by hand to the address details of the other party, in which case it shall be deemed
to
have been given and such other party shall be deemed to have been informed of the contents of the
notice when the notice is so delivered; or
16.2.2 Posted by prepaid registered post to such other party at the address details of the other party, in
which case it shall be deemed to have been given to the other party and such other party shall be
deemed to have been informed of the contents of the notice on the seventh day after posting
16.2.3 Sent by facsimile/email to the address details of the other party, in which case it shall, on receipt of
successful transmission report, be deemed to have been given to the other party and such other party
shall be deemed to have been informed of the contents of the notice on the day on which it was sent

16.2.4 It is the student’s responsibility to update the College regarding all changes in contact details and
circumstances as soon as this has occurred.

Consequences of violation:
The violation of the aforementioned policy shall be treated as misconduct and may result in one or more of the
following actions:
 Restriction, suspension or termination of the user’s access to the facilities including temporarily suspension of
his/ her access or rights pending further investigations
 Legal proceedings by the College including but not limited to criminal prosecution under applicable laws
 Disciplinary actions against the user which the user which may in the end lead to his/ her suspension or
dismissal
